As part of renewal, the Division conducted EPA -recommended statistical analyses on this facility's effluent data to determine the "reasonable potential" for identified metals to exceed North Carolina Water Quality Stream Standards. These and other analyses have prompted the following changes: Deleting from Permit: • The permittee shall no longer sample effluent for cadmium, lead, or nickel. The permittee shall continue to evaluate these metals under the Long Term Management Plan. • Conductivity -- due to the difficulties interpreting these data, the Division no longer requires monitoring for receiving -stream conductivity. Adding to Permit: • Because there is "reasonable potential" for copper and zinc in this facility's effluent to exceed Water Quality Stream Standards, the monitoring frequency for these two parameters shall be increased from Monthly to 2/Month. NPDES Permit No. NC0032662 SUPPLEMENT OT EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A. (2.) CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 13%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure, performed as the first test of any single quarter, results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months, as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. The Permittee's 5-year NPDES permit has expired and they have requested renewal from the Division of Water Quality (the Division). This Fact Sheet summarizes background information and rationale used by the Division's NPDES Unit to determine permit limits and conditions. This document also contains references to information sources relevant to this permit renewal (superscripted numbers in order of appearance, See References). FACILITY RECORDS REVIEW Facility Description. The City of Claremont / Claremont North WWTP (Table 1) is a 0.100 MGD Publicly Owned Treatment Works (POTW) utilizing a parallel dual -train wastewater treatment system consisting of a 0.040 MGD train and a 0.060 MGD train, both discharging to Outfall 001 1'2. Although the industrial influent to this plant represents approximately 19% (0.012 MGD) of current effluent, there are currently no Significant Industrial Users (SIUs) I. Table 1. The previous permit expired on June 30, 2000 and the Division received appropriate documentation to renew (Short Form A) on January 4, 200014. Waste Load Allocation (WLA). The Division prepared the last WLA in March 1995 and developed effluent limits and monitoring considering an in -stream waste concentration (IWC) of 13 %. The Division judges these limits and monitoring requirements to be appropriate for this renewal with the exception of the additions and deletions listed below (see PERMITTING APPROACH SUMMARY). Verifying Existing Stream Conditions. This facility discharges to Mull Creekl's, a Class WS-IV stream within the Catawba River Basins. Mull Creek is not "impaired" [not 303(d) listed]6. COMPLIANCE REVIEW Pretreatment Compliance. In January 1999 the Division recognized two (2) Significant Industrial Users (SIUs) contributing to this facility8. This is no longer true. This facility now receives approximately 0.012 MGD (19%) industrial influent, but there is currently no SIU discharging to Claremont North WWTP1. Notices of Violation (NOVs). The Division has issued no NOVs for this facility within the last two years. Whole Effluent Toxicity (WET) Test. Quarterly monitoring results for Whole Effluent Toxicity (WET) indicates "pass" for the last 22 quarters (August 1996 through September 2000)9'10. Instream and Effluent Data Review. The Division reviewed over 32 months (1998 through September 2000) of Discharge Monitoring Reports (DMR) data. Reports appear regular, thorough, and complete. Total flow for this time period averages about 0.063 MGD (- 63 % of permitted capacity)l°. Instream Dissolved Oxygen and Temperature. Instream dissolved oxygen (DO) and temperaturedata appear reasonable and seasonally appropriate. All DO values are compliant with the Stream Standard minimum of 5 mg/L. Instream Fecal Coliform. Weekly fecal coliform counts appear similar upstream to downstream. Although counts range widely on any given day, the Division found similar values comparing upstream to downstream data suggesting little or no correlation to facility discharge. Year 2000 monthly counts averaged 328 colonies per 100 ml (upstream) and 335 colonies per 100 ml (downstream) with peaks ranging from >1540 upstream and >1720 downstream. Year 1999 data indicate generally lower peaks and averages, but similar correlative conditions upstream to downstream. The Division noted with some concern that the permittee regularly reports higher -value counts using "greater -than" values instead of actual numbers of colonies. Effluent Chlorine. Based on 33 months of data (1998 through September 2000) Total Residual Chlorine (TRC) concentrations in effluent are moderate. They average less than 600 µg/L monthly, and during the year 2000, less than 400 µg/L monthly. Fact Sheet Renewal -- NPDES NC0032662 Page 2 Reasonable Potential Analysis (RPA). The Division conducted EPA -recommended RPA analyses on 32 months of data10 to determine the reasonable potential for identified toxicants to exceed Water Quality Standards. The Division compiled five parameters of concern 4' 11 listed in the previous permit and pretreatment LTMP documents including cadmium (Cd), copper (Cu), lead (Pb), nickel (Ni), and zinc (Zn). Results suggest no "reasonable potential" for Cd, Pb, or Ni to exceed Water Quality Standards. Furthermore, because these parameters are monitored under the Long Term Monitoring Plan (LTMP), they will be removed from the Effluent Limitations and Monitoring Requirements page. Lastly, data suggest "reasonable potential" for state action -level parameters Cu and Zn. Because Cu and Zn have North Carolina State Action Levels only, they are to be monitored only at a frequency of 2/month (see below). CORRESPONDENCE Staff Report. Mooresville Regional Office (MRO) prepared a Staff Report dated May 22, 2000. MRO staff found the facility "...in good operational condition..." and recommended that this permit be reissued, as requested by the permittee2. Facility Inspections. Mooresville Regional Office (MRO) described facility permit compliance as "satisfactory" and within permit limits. Site inspectors in 1999 recorded minor "deficiencies" only and issued no Notices of Violation. The Division requested the permittee to correct the following deficiencies: 1) a 12- to 16- inch sludge mat observed at the bottom of the chlorine contact chamber; and 2) intermittently inadequate flow -limit monitoring and reporting 12,13.
