We received your application for a new post -construction stormwater permit on
11/4/2022. At this time, the submission is not administratively complete and cannot be
accepted for review in its current condition. Please provide the following submittal items
within 30 calendar days (by close of business on 12/16/2022) so that we may accept the
project and begin the review process, otherwise, the project will be returned as
administratively incomplete.
• 2x hard copies of the Application with the following corrections made (This item is
required per 15A NCAC 02H .1042(2)(a) and per Section VI, 1 of the
Application):
• Section IV, 2 — It was noted that a Preliminary Plat approved by Watauga
County Planning Commission (July 2022) was indicated in this section of
the Application. Please provide this Preliminary Plat or remove the
reference from the Application. Please note that in order to apply an older
set of rules to a new project, a demonstrated vested right is required in the
form of a local government -issued or approved site specific development
plan, a valid, unexpired building permit, or some other documentation as
listed in the applicable rule. Included.
Section IV, 10 & 11 — Per 15A NCAC 02H .1003(3)(b) any off -site
drainage area not bypassed around an SCM must be accounted for at its
full build -out potential. This can be accomplished by having the property
owners enter into a legal agreement limiting the amount of BUA and
drainage area that can be directed from the off -site area to the SCM or by
accounting for the off -site area as 100% BUA (its full build -out potential).
Please either bypass the off -site component of the drainage area around
the SCM or account for the off -site portion of the drainage area at its full
build -out potential. After corresponding with Margie Deberry on
11/17/2022 regarding this matter, we have included the off -site
drainage areas as specified into the Section IV table on the
application.
• Section VI — Please indicate that the required information in this section
have been provided by initialing in the space provided for each item. The
latest version of the Application form can be downloaded from our website
at the following address: https://deg.nc.gov/about/divisions/energy-
m i neral-and-land-resou rces/stormwater/stormwater-grog ram/post-
construction. Included.
• 1x hard copy of the complete, original Supplement-EZ Form (This item is
required per Sections V & VI, 3 of the Application). This form can be found on our
website at the following address: https://deg.nc.gov/about/divisions/energy-
m ineral-and-land-resou rces/stormwater/stormwater-grog ram/stormwater-
design. Please note that a complete Supplement-EZ form will have 3 or
more pages and uses macros to generate the relevant sheets based on the
information entered into the cover page. Included.
• 1x original, signed & notarized hard copy of the O&M Agreement Form (This item
is required per 15A NCAC 02H .1042(2)(j) and per Sections V & VI, 3 of the
Application). This form can be found on our website at the following
address: https://deg.nc.gov/about/divisions/energy-mineral-and-land-
resources/stormwater/stormwater-program/stormwater-design. Please note that
a complete O&M Agreement Form will have 2 or more pages and uses
macros to generate the relevant sheets based on the information entered
into the cover page. NOTE: It is recommended to get a second copy of this
form signed & notarized for the Applicant's records (it will be helpful when they
go to record it with the Register of Deeds). - The provided O&M Agreement form
is missing the O&M items that are being agreed to be performed. Included.
2x hard copies (one original) of the deed restriction document (This item is
required per 15A NCAC 02H .1003(7), 15A NCAC 02H .1042(2)(k), and Sections
VI, 2 & VII). More information can be found on our
website: https://deg.nc.gov/about/divisions/energy-mineral-and-land-
resou rces/stormwater/stormwater-prop ram/post-construction-prop ram/post-
construction-forms. NOTE: It is recommended to get a second copy of this form
signed & notarized for the Applicant's records (it will be helpful when they go to
record it with the Register of Deeds). Included.
1x hard copy of a soils report. This item is required per Section VI, 9 of the
Application. — It is noted that Project Soil Data was included in the Narrative
document. However, an 8.5" x 11" copy of the NRCS County Soils map with the
project area clearly delineated was not provided with the submittal. Please
provide a copy of the NRCS Soils map. Included.
1x hard copy of official documentation showing that the Applicant is in good
standing with the Secretary of State and showing the title and position
information for the signing official (This item is required per 15A NCAC 02H
.1040(1), .1042(2)(b), and per Section VI, 11 of the Application). Included.
2x signed & sealed full-sized hard copies of the plan set (minimum of 22" x 34" in
size and at a legible scale, folded to 8.5" x 14"). This item is required per 15A
NCAC 02H .1042(2)(g) and per Section VI, 8 of the Application. — It is noted that
two 11" x 17" hard copies of the plan set were provided, however two full-sized
hard copies are required. Included.
2x signed & sealed hard copies of a plan sheet (This item is required per 15A
NCAC 02H .1042(2)(g) and per Section VI, 8 of the Application.) showing the
following:
• Wetland delineation or a note on the plans stating that there are no
wetlands located on -site. This item is required per 15A NCAC 02H
.1042(2)(g)(iii) & Section VI, 8m of the Application. Please also list the
name of the individual that made this determination in a note on the plans.
Included.
NOTE: This is an administrative completeness review, not a detailed engineering
review. The following items were noted during this review, but do not need to be
addressed for this submission to be administratively complete and accepted for review
(but these issues, and possibly others, will probably be brought up during the
engineering review):
• Vegetated conveyance side slopes steeper than 3:1 require engineering
calculations and an on -site soil investigation to demonstrate stability in perpetuity
per 15A NCAC 02H .1003(2)(c)(i).
