INSTRUCTIONS FOR FORM LPSD 11-21 &SUPPORTING DOCUMENTATION
Documents shall be prepared in accordance with 15A NCAC 02T .0306,and all relevant Division Policies. Failure
to submit all required items will necessitate additional processing and review time.

General—This application is for municipalities, counties, local boards or commissions, water and sewer authorities, or
groups of municipalities and counties applying for approval of local programs for permitting construction, modification,
and operation of public and private sewer systems in their utility service areas pursuant to G.S. 143-215.1(f). When
submitting an application, please use the following instructions as a checklist in order to ensure all required items are
submitted.
The Applicant shall submit one original and two copies of the application and supporting documentation.
A. Cover Letter
® Submit a cover letter listing all items and attachments included in the permit application package,as well as a brief
description of the requested activities to be delegated.
® Include a list of any items required in these instructions that were not submitted, and include an explanation as to
why they were not relevant to the type of delegation being requested.
B. No Application Fee Required for Local Delegation Request
O Include the proposed fee structure the local program will utilize.
C. Local Program Sewer Delegation(FORM: LPSD 11-21)Application:
O Submit the completed and appropriately executed Local Programs for Sewer Systems (FORM: LPSD 11-21)
application. Any unauthorized content changes to this form shall result in the application package being returned.
If necessary for clarity or due to space restrictions, attachments to the application may be made, as long as the
attachments are numbered to correspond to the section and item to which they refer.
NOTE: The Authorized signing official listed in Section I.4 should match with that of the Applicant certification
page in accordance with 15A NCAC 02T .0106(b). Per 15A NCAC 02T .0106(c), an alternate person may be
designated as the signing official if a delegation letter is provided from a person who meets the criteria in 15A
NCAC 02T.0106(b).
D. Program Administration(All Application Packages):
O Submit an organizational structure containing position types or contracts meeting the requirements of 15A NCAC
02T .0306 and adequately support the local program by providing, at a minimum the following:
0 Adequate administrative staff.
® A Professional Engineer on staff or retained as a consultant.
O Engineering/technical staff.
® Staff to inspection each project for compliance at least once during construction.
® Enforcement and compliance.
® Financial support for the delegated program.
0 Submit a description (flow chart) of the permitting process and the construction and inspection certification
program.

E. Sewer Use Ordinance(All Application Packages):
El Submit a properly executed and signed sewer use ordinance or local law.
® The requirements of the ordinance or local law shall be compatible with the requirements imposed by G.S. 143-
215.1. The requirements established in the ordinance or local law shall include at a minimum,the following:
® The authority to issue and enforce permits.
® The authority to assess penalties as a result of enforcement action.
® The authority to inspect facilities.
® Clearly defined appeal process of local decisions(e.g.permit denial).
® Provides that the Division and appropriate Division Regional Office receive a report of all permitting actions on
a quarterly basis.
® Provides that plans and specifications shall be prepared by or under the direct supervision of a licensed North
Carolina Professional Engineer when required by G.S. 89C.
® Provides for adequate administrative organization,engineering staff,financial and other necessary resources.
® Design criteria for sewer systems consistent with 15A NCAC 02T. The ordinance or local law my reference a
separate document(e.g.minimum design criteria document)for providing detailed requirements. The ordinance
or local law shall provide the title of the separate document and provide information on how it will be maintained.
F. Minimum Design Criteria(i.e.Specifications)(All Application Packages):
® Submit minimum design criteria for construction of sewer systems to be permitted. Minimum design criteria shall
meet or exceed all State requirements established in 15A NCAC 02T,Division Minimum Design Criteria and any
other applicable state rules:
® 15A NCAC 02T
® Minimum Design Criteria for Gravity Sewers
® Minimum Design Criteria for Pump Stations and Force Mains
® Alternative Design Criteria for Minimum Separation of Sewer Systems to Wetlands
G. Local Program Permit Application Forms(All Application Packages):
® Submit the local program's proposed permit application form for the type of sewer system(s)the local program is
requesting for delegation.
H. Local Program Permit Template(All Application Packages):
® Submit a permit template or template(s)addressing all activities proposed for delegation meeting the requirements
of 15A NCAC 02T.
I. Inspection and Certification Procedures(All Application Packages):
• Submit the inspection and certification procedures (SOPs,checklists,etc.) to be utilized for each project permitted
by the local program.
❑ Submit a template of the certification document(s)placing the project into operation after construction.
J. Downstream capacity assurance(All Application Packages):
® Submit the method for tracking the downstream capacity for each project permitted by the local sewer system
program.This documentation may mirror the Flow Tracking for Sewer Extensions form as issued by the Division.
K. Wastewater Treatment Authorization(Programs discharging to separate jurisdiction):
❑ Submit a written statement from that local unit of government that the proposed program complies with all its
requirements and that the applicant has entered into a satisfactory contract which assures continued compliance.
> NOTE: Only required if the treatment and disposal system receiving the waste is under the jurisdiction of another
local unit of government.

Local Program Sanitary Sewer Extension Application
(Form: TOHS LPSSEA 06.22)
This application is for public gravity sewer,public pump station,and/or public force main sewer extensions in the
Town of Holly Springs(Town),North Carolina. Prior to the submittal of a Local Program Sanitary Sewer Extension
Application(LPSSEA)package,the engineering plans and specifications shall be approved through the appropriate
technical review process as required by the Executive Director of Utilities&Infrastructure Services and defined by
the Town of Holly Springs Development Ordinance(s). Plans, specifications and supporting documents must be
prepared in accordance with the requirements of 15A NCAC 02T,the North Carolina Department of Environmental
Quality Division of Water Resource(Division)'s Minimum Design Criteria(Gravity Sewer&Pump Stations/Force
Mains), the Town of Holly Springs Engineering Design and Construction Standards, and good engineering
practices.
Projects not eligible for review via the Town of Holly Springs' Local Program process(must be submitted for full

technical review to the Division)include but are not limited to:
>Private sanitary sewer extensions
Projects that do not meet any part of the minimum design criteria(MDC)documents;
>Projects that involve any variance from the requirements of 15A NCAC 02T;
Pressure sewer systems utilizing simplex septic tank-effluent pumps(STEPs)or simplex grinder pumps;
>Simplex STEP or simplex grinder pumps connecting to pressurized systems(e.g.force mains);
Vacuum sewer systems.
The Town of Holly Springs will not accept this application unless all of the instructions listed below are followed.
Failure to submit all required items will necessitate additional processing and review time,and may result in
return of the application.
A. Cover Letter/Narrative Description:
❑ List all items included in the application package,as well as a brief description of the requested permitting
action.
• Be specific as to the system type,number of homes served,flow allocation required,etc.
• Include the Authorization to Construct (ATC) number/status of any other required sewer permits
(downstream/upstream)
• If necessary,include attachments to the application form. Such attachments will be considered part of
the application package and should be numbered corresponding to the section to which they refer.
B. Application Fee:
Each application shall be subject to fees in accordance with the current Town of Holly Springs Fee Schedule
(viewable on the Town of Holly Springs website at www.hollyspringsnc.gov).

❑ Include an aerial location map showing general project area(such as street names or latitude/longitude).
E. Digital copy of the plans:
❑ Submit one digital copy of the complete design drawings in PDF format.
F. Existing ATC (Application Packages for Modifications to an Existing Permit):
❑ Include a descriptive and clear narrative identifying the previously permitted items to remain in the
ATC, items to be added, and/or items to be modified. The narrative should also include whether any
previously permitted items have been certified.
❑ The narrative should clearly identify the requested permitting action and accurately describe the
sewers to be listed in the final ATC.
G. Power Reliability Plan(Required if portable reliability option utilized for Pump Station):
❑ Per 15A NCAC 02T .0305(h)(1),submit documentation of power reliability for pumping stations.
➢ This alternative is only available for average daily flows less than 15,000 gallons per day(GPD)
> If the portable power source or pump is dedicated to multiple pump stations,an evaluation of all
the pump stations' storage capacities and the rotation schedule of the portable power source or
pump, including travel timeframes, shall be provided in the case of a multiple station power
outage.(Required at time of certification)

be applied for and obtained by the petitioner. An active ATC permit must be maintained until
full final approval has been issued for the infrastructure defined in the ATC permit. Written
requests for an extension of time received prior to expiration of the ATC permit may be granted
by the Executive Director of Utilities & Infrastructure Services (Director)for good cause shown.
The Director reserves the right to deny the ATC permit, subject to the provisions in the Town of
Holly Springs Code of Ordinances, Chapter 16 - Public Enterprises. A denial shall be made in
writing and shall contain the reasons for the denial and the Towns' estimate of the general
changes in the petitioner's proposed activities or plan which will be required, in order that the
petitioner may obtain the ATC permit. Nothing in such estimate shall preclude or otherwise bar
the Director from denying a permit, which incorporates such changes, based upon changed
circumstances or information not previously known by the Director or the petitioner. The Director
reserves the right to modify or revoke the ATC upon not less than 14-days written notice to any
person affected. In the event of a developed or developing threat to public health or safety,
revocation and/or disconnection may occur immediately without notice. Notice to affected
persons shall occur as soon as practicable thereafter.
This cover letter shall be considered a part of this ATC and is therefore incorporated therein by
reference. If any parts, requirements, or limitations contained in this permit are unacceptable,
you have the right to request an adjudicatory hearing upon written request within 30-days
following receipt of this permit. This request must be in the form of a written petition, conforming
to Town Code of Ordinances, Chapter 16, Article 1, Division 2, Section 16-27, and filed with the:

to the following specified conditions and limitations:
1. In the event that construction does not commence within 12-months of the issuance of
the Authorization to Construct (ATC) permit, the ATC permit shall expire and a new ATC
permit must be applied for and obtained by the petitioner. An active ATC permit must
be maintained until full final approval has been issued for the infrastructure defined in the
ATC permit. Written requests for an extension of time received prior to expiration of the
ATC permit may be granted by the Executive Director of Utilities & Infrastructure Services
(Director) for good cause shown.
2. This permit shall become voidable unless the facilities are constructed in accordance
with the conditions of this permit; 15A NCAC 02T; the Division of Water Quality's Minimum
Design Criteria (MDC) for the Permitting of Gravity Sewers adopted February 12, 1996
and/or the Division of Water Quality's MDC for the Permitting of Pump Stations and Force
Mains adopted June 1, 2000, as applicable; the Town of Holly Springs Engineering Design
and Construction Standards (Town Standards); the Town of Holly Springs' ordinances,
policies, and standard details; the approved plans; and other supporting data. If a
modification to the approved plan is needed, the Petitioner shall request a permit
modification in writing. Permit modifications shall be subject to current design standards.

3. This permit shall be effective only with respect to the project scope, nature and volume
of wastes described in the LPSSEA for Project Title.
4. Construction of the gravity sewers, pump stations, and force mains shall be scheduled so
as not to interrupt service by the existing utilities nor result in an overflow or bypass
discharge of wastewater to the surface waters of the State. Prior to initiating any work
on an active sanitary sewer system, the Petitioner's contractor must provide the Town of
Holly Springs Development Construction Manager and the Petitioner's engineer with a
construction work plan for review and documentation. The construction work plan must
clearly detail how the existing sanitary sewer system will be maintained during the
construction process, including but not limited to any temporary losses of service, system
draining, bypass systems, temporary pumps, temporary in-system storage and/or parallel
systems. The Petitioner's engineer will need to review and approve the Contractor's work
plan and submit adequate documentation to the Town of Holly Springs' Development
Construction Manager.
5. Deviations from the approved plans and specifications or site conditions affecting
capacity, hydraulic conditions, or any provisos stipulated in this ATC permit must be
approved prior to further construction or installation. An ATC permit application
package, consisting of the revised engineering drawings and the supporting
documentation, must be submitted to the Executive Director of Utility & Infrastructure
Services (Director) for approval and issuance of a new ATC permit, before any
construction work affected by such deviations is initiated. All proposed deviations shall
be required to comply with 15A NCAC 02T, the Division's MDC (Gravity Sewer & Pump
Stations/Force Mains), Town Standards, Town of Holly Springs ordinances, policies, and
standard details; the approved plans; and other supporting data.
6. Upon completion of construction and prior to the operation of these permitted facilities,
the executed Engineering Certification form attached to this permit; sealed record
drawings in PDF and ACAD formats; copies of the legal documentation regarding the
transfer of all utility easements to the Town of Holly Springs, by recorded plat or deed;
and sealed pump station as-built calculations, as applicable, must be submitted to the
Town of Holly Springs. The certification must be completed and sealed by a professional ii
engineer, certifying that the permitted facility has been installed in accordance with this
permit,the approved plans and specifications, and any other supporting materials. If the
project is to be completed in phases and partially certified, the Petitioner shall retain the
responsibility to track further construction approved under this permit, and shall acquire
a final certificate of completions once the entire project has been completed. Sealed
record drawings in PDF and ACAD formats;copies of the legal documentation regarding
the transfer of all utility easements to the Town of Holly Springs, by recorded plat or deed;
and sealed pump station as-built calculations, as applicable, indicating the facilities
constructed in the phase being certified, shall be submitted for approval to the Town of
Holly Springs.

7. In the event that the wastewater collection facilities fail to perform satisfactorily, including
the creation of nuisance conditions, immediate corrective actions, such as the addition
or replacement of facilities, shall be taken by the Petitioner.
8. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 02T;
the Division's MDC for Gravity Sewer adopted February 12, 1996, as applicable; the
Division's MDC for the Fast-Track Permitting of Pump Station and Force Mains adopted
June 1, 2000, as applicable; Town Standards; Town ordinances, policies, and standard
details; and other supporting materials may subject the Petitioner to an enforcement
action by the Town of Holly Springs, NCDEQ and other applicable agencies, in
accordance with Federal, State, and Local regulations and as stipulated in Chapter 16
of the Town of Holly Springs Code of Ordinances.
9. Any wastewater flow made tributary to the sanitary sewer wastewater collection system
extension prior to completion of this Engineering Certification shall be considered a
violation of the permit and shall subject the Petitioner to appropriate enforcement
actions.
10.The issuance of this permit shall not exempt the Petitioner from:
a. Complying with any and all statutes, rules, regulations, or ordinances that may be
imposed by government agencies (Local, State, and Federal) that have
jurisdiction, or
b. Obtaining other permits which may be required by the Town, Division,or any other
Federal, State, or Local Government agencies (including but not limited to
applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation
control requirements in 15A NCAC Ch. 4 and under the Division's General Permit
NCG0100000, and any requirements pertaining to wetlands under 15A NCAC 2B
.0200 and 15A NCAC 2H .0500.)
11.This permit shall not be transferable. In the event there is a desire for the wastewater
collection facilities to change ownership, or there is a name change of the Petitioner, a
formal ATC request must be submitted to the Director accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The Director reserves the right to approve or disapprove the request based
on the format ATC merits.

ELECTRONIC RECORD AND SIGNATURE DISCLOSURE
From time to time,Town of Holly Springs (we,us or Company)may be required by law to
provide to you certain written notices or disclosures. Described below are the terms and
conditions for providing to you such notices and disclosures electronically through the DocuSign
system. Please read the information below carefully and thoroughly, and if you can access this
information electronically to your satisfaction and agree to this Electronic Record and Signature
Disclosure(ERSD),please confirm your agreement by selecting the check-box next to `I agree to
use electronic records and signatures' before clicking `CONTINUE' within the DocuSign
system.
Getting paper copies
At any time,you may request from us a paper copy of any record provided or made available
electronically to you by us. You will have the ability to download and print documents we send
to you through the DocuSign system during and immediately after the signing session and,if you
elect to create a DocuSign account, you may access the documents for a limited period of time
(usually 30 days)after such documents are first sent to you.After such time,if you wish for us to
send you paper copies of any such documents from our office to you,you will be charged a
$0.00 per-page fee.You may request delivery of such paper copies from us by following the
procedure described below.
Withdrawing your consent
If you decide to receive notices and disclosures from us electronically,you may at any time
changeyour mind and tell us that thereafter you want to receive required notices and disclosures

Consequences of changing your mind
If you elect to receive required notices and disclosures only in paper format,it will slow the
speed at which we can complete certain steps in transactions with you and delivering services to
you because we will need first to send the required notices or disclosures to you in paper format,
and then wait until we receive back from you your acknowledgment of your receipt of such
paper notices or disclosures. Further, you will no longer be able to use the DocuSign system to
receive required notices and consents electronically from us or to sign electronically documents
from us.

Unless you tell us otherwise in accordance with the procedures described herein,we will provide
electronically to you through the DocuSign system all required notices, disclosures,
authorizations, acknowledgements,and other documents that are required to be provided or made
available to you during the course of our relationship with you. To reduce the chance of you
inadvertently not receiving any notice or disclosure, we prefer to provide all of the required
notices and disclosures to you by the same method and to the same address that you have given
us. Thus,you can receive all the disclosures and notices electronically or in paper format through
the paper mail delivery system. If you do not agree with this process,please let us know as
described below. Please also see the paragraph immediately above that describes the
consequences of your electing not to receive delivery of the notices and disclosures
electronically from us.

You may contact us to let us know of your changes as to how we may contact you electronically,
to request paper copies of certain information from us, and to withdraw your prior consent to

If you created a DocuSign account, you may update it with your new email address through your
account preferences.
To request paper copies from Town of Holly Springs
To request delivery from us of paper copies of the notices and disclosures previously provided
by us to you electronically,you must send us an email to jeff.wilson@hollyspringsnc.us and in
the body of such request you must state your email address, full name,mailing address,and
telephone number. We will bill you for any fees at that time, if any.
To withdraw your consent with Town of Holly Springs
To inform us that you no longer wish to receive future notices and disclosures in electronic
format you may:
i. decline to sign a document from within your signing session, and on the subsequent page,
select the check-box indicating you wish to withdraw your consent, or you may;
ii. send us an email to jeff.wilson@hollyspringsnc.us and in the body of such request you must
state your email, full name,mailing address, and telephone number. We do not need any other
information from you to withdraw consent.. The consequences of your withdrawing consent for
online documents will be that transactions may take a longer time to process..
Required hardware and software
The minimum system requirements for using the DocuSign system may change over time. The

Acknowledging your access and consent to receive and sign documents electronically
To confirm to us that you can access this information electronically,which will be similar to
other electronic notices and disclosures that we will provide to you,please confirm that you have
read this ERSD, and(i)that you are able to print on paper or electronically save this ERSD for
your future reference and access; or(ii)that you are able to email this ERSD to an email address
where you will be able to print on paper or save it for your future reference and access. Further,
if you consent to receiving notices and disclosures exclusively in electronic format as described
herein,then select the check-box next to `I agree to use electronic records and signatures' before
clicking `CONTINUE' within the DocuSign system.
By selecting the check-box next to `I agree to use electronic records and signatures', you confirm
that:
• You can access and read this Electronic Record and Signature Disclosure; and
• You can print on paper this Electronic Record and Signature Disclosure, or save or send
this Electronic Record and Disclosure to a location where you can print it, for future
reference and access; and
• Until or unless you notify Town of Holly Springs as described above, you consent to
