Dear Mr. Reed:
In accordance with your application dated May 30, 1997, the Division is forwarding the
subject State-NPDES permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the U. S. Environmental Protection Agency dated December 6, 1983.
Please be advised that the following changes have been incorporated into the final permit:
• The monitoring frequency for BOD, TSS, pH and fecal coliform has been
changed from 2/month to weekly as per the North Carolina Administrative
Code Section 15A NCAC 2B.0500.
• The monitoring frequency for ammonia has been changed from monthly to
weekly as per the North Carolina Administrative Code Section 15A NCAC
2B.0500.
• The monitoring frequency for total residual chlorine has been changed from
weekly to 2/week as per the North Carolina Administrative Code Section 15A
NCAC 2B.0500.
• The monitoring requirement for Total Residual Chlorine (TRC) has been
changed from 135 µg/1 to 28 µg/1 as per current Division policy (i.e. TRC is
being capped at the acute level).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-
7447. Unless such demand is made, this decision shall be final and binding.

Please take notice that this permit is not transferable. Part II, E.4. addresses the requirements
to be followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirement to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, Coastal
Area Management Act or any other Federal or Local governmental permit that may be required.

hereof.
The permit shall become effective May 1, 1998
This permit and the authorization to discharge shall expire at midnight on October 31, 2002

The facility has applied for a permit renewal with no modifications.
The facility currently has a TRC limit of 135 µg/l. This limit was changed to 28 µg/1 as per current
Division Policy (it is being capped at the acute level). Upon review of the available DMR data, it is
uncertain whether or not the facility can meet this condition. Region, please comment on this issue.
Should we leave the permit condition as stated in the last permit cycle or should we give them a more
restrictive limit?
The DMR data was reviewed for the period of 1996 to present. The following violations were noted:

On the basis of thorough staff review and application of Article 21 of Chapter 143, General
Statutes of North Carolina, Public Law 92-500 and other lawful standards and regulations, the
North Carolina Environmental Management Commission proposes to issue a permit to dis-
charge to the persons listed below effective 3/30/98 and subject to special conditions. .
Persons wishing to comment upon or object to the proposed determinations are invited to
submit same in writing to the above address no later than 3/14/98.All comments received
prior to that date will be considered in the formulation of final determinations regarding the
proposed permit.A public meeting may be held here the Director of the Division of
Environmental Management finds a significant degree of public interest in a proposed per-

28779 has applied for a permit renewal for a facility located at Jackson County WWTP, River
Road (NCSR 1359),'south of Sylva, Jackson County.The facility discharges 1.5 MGD of treated
domestic and industrial wastewater from one outfall into the Tuckasegee River, a Class C-
Trout stream in the Little Tennessee River Basin which has a 7Q10 flow of 165 cfs. For some
parameters, the available load capacity of the immediate receiving water will be consumed.
This may affect future water quality based effluent limitations for additional dischargers with-
in this portion of the watershed.

12. NPDES No. NC0084441. Smoky Mountain Country Club Estates, Conleys Creek Limited
Partnership, Post Office Box 937, Whittier, NC 28789 has applied to renew their permit for .
a facility located at Smoky Mtn. Country Club Estates WWTl? Conleys Creek Road, Whittier,
Swain County.The facility is permitted to discharge 0.60 MGD of treated domestic waste-
water from one outfall into Conleys Creek, a Class C-Trout stream in the Little Tennessee
River Basin which has a 7Q10 flow of 4.21 cfs and a 30Q2 flow of 8.16 cfs. No parameters
arc water quality limited, but this discharge may affect future allocations.
13. NPDES No. NC0084981. Darren Stewart, Route 1, Post Office Box 187, Robbinsville, NC
28771 has applied to renew a NPDES permit to discharge wastewater from a prciposed
trout farm operation located at barren Stewart Trout Farm, Route 1, Robbinsville, Graham
County.The facility is permitted to discharge trout farm wastewater from 1 outfall into West

• Staff report was prepared by Bill Anderson (ARO) on August 12, 1992. The stream
classification identified in the staff report was C-TR. It appears that the stream has been
reclassified to WS-III-TR.
• WLA was prepared by Dave Goodrich on 10-26-92. Limits were determined to be secondary,
except for the limit on TRC which was established at 135 µg/1(a note will be included in the
summary page to the region to verify whether or not this limit should be reduced to the acute
level). Overall, parameters were determined to be water quality limited.
• A compliance evaluation inspection was performed by Bill Anderson (ARO) on May 1, 1996.
It was noted that the facility appeared to be in good operating condition.
