Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as
subsequently amended).
This final permit includes the following changes from the draft permit sent to you on July 6, 2005:
• The monitoring frequency for phenol has been changed to monthly for outfalls 001 and 002 . This
change was made in keeping with North Carolina's updated permitting strategy regulating discharges
from petroleum bulk storage facilities. Neither outfall has an associated limit for its discharge of
phenol, based upon the facility's discharge history.
• More extensive footnotes have been added; however, their content is essentially the same as found in
the draft and in your current permit.
• For outfall 002 (only) the frequency for Acute Toxicity testing has been increased from annual to
quarterly monitoring. This change was based upon application of the updated strategy mentioned
above with respect to the toxicity discharge history of this outfall. Results of toxicity testing from
outfall 002 have yielded results of an LC50 of less than 100% in three of the past five years. The
Division will be willing to consider a request to reestablish an annual monitoring frequency for this
parameter upon the submittal of 5 consecutive quarterly results with an LC50 of >100%.
• In a transmittal letter to the previous permittee dated July 30, 2001, the Division informed the
permittee with regard to EPA Method 625 testing: "if your facility collects eight to ten samples in
which none of the 625 compounds are detected, you may submit a request to the Division that this
sampling requirement be eliminated." While entries have been made on the DMRs showing the 625
testing has been conducted, complete results of the analyses have not always accompanied the DMRs
for each outfall, and therefore the Division could not conduct a complete examination of the record to
determine the continued need for this monitoring. If you can provide adequate records from each
outfall for such a review and the results meet the standard noted above, the Division will be willing to
modifiy the permit to remove the requirement for EPA Method 625 monitoring.

to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is
made, this decision shall be final and binding.

Footnotes for Outfalls 001 & 002
1. Flow Flow shall be monitored with each discharge event — During periods of no flow,
the Permittee shall submit a signed, monthly Discharge Monitoring Report (DMR)
indicating "No discharge." Flow may be monitored using any one of four methods:
a) measure flow continuously;
b) calculate flow (see Rational Equation below) based on total rainfall per unit area
draining to the outfall; exclude built -upon areas (best method for facilities with
large runoff -collection ponds);
c) estimate flow at 20-minute intervals during the entire discharge event; or
d) report flow based on discharge pump logs."
The Rational Equation: Q=KuCIA, where:
Q = flow (peak flow rate (cfs or m3/sec)
Ku = units conversation factor = 1.008 for U.S. standard units (usually ignored because
it is so close to 1), or 0.278 for SI units
C = dimensionless runoff coefficient for the watershed, loosely defined as the ratio of
runoff to rainfall
I = intensity of rainfall taken from the intensity -duration -frequency curves for the
specified design return period at the time of concentration, tc (in/h or mm/h). tc =
time of concentration (time after the beginning of rainfall excess when all portions
of the drainage basin are contributing simultaneously to flow at the outlet).
A = area of tributary watershed (acres or km2)
The rational equation is used to calculate the runoff from a region, given:
• the runoff coefficient which accounts for infiltration and other potential
losses in the region,
• the rainfall intensity to the region,
• the time it takes for runoff to travel from the region's upper reaches to its
outlet, and
• the region's drainage area.
2. Oil and Grease — Where possible, the grab sample for oil and grease should be skimmed from
the surface of a quiescent (calm water) zone.
3. Turbidity — Effluent shall not cause receiving stream turbidity to exceed 50 NTU. If receiving stream
background turbidity exceeds 50 NTU, effluent shall not cause this background value to increase.
4. Acute Toxicity Outfall 001 (Fathead Minnow, 24-hour), Annual [see Special Condition A.(3.)]..
5. Acute Toxicity Outfall 002 (Fathead Minnow, 24-hour), Quarterly [see Special Condition A.(4.)].
The facility may request the monitoring frequency be changed to annual upon the completion of 5
consecutive quarterly tests with no demonstration of toxicity (i.e., the last 5 consecutive tests have
"passed" or demonstrate a LC50 of >100%).
The Permittee shall collect Acute Toxicity samples concurrently with BTEX sampling.
There shall be no discharge of floating solids or foam visible in other than trace amounts.
There shall be no direct discharge of tank solids, tank bottom water, or the rag layer.
There shall be no direct discharge of tank (or pipe) contents following hydrostatic testing unless benzene
concentration is less than 1.19 µg/1 and toluene concentration is less than 11 µg/1.

EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A. (3.) ACUTE TOXICITY MONITORING (ANNUAL) OUTFALL 001
The Pennittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas)
24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste
treatment. The permittee will conduct one test annually, with the annual period beginning in January of
the calendar year of the effective date of the permit. The annual test requirement must be performed and
reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this
date. Toxicity testing will be performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was
performed, using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

A. (4.) ACUTE TOXICITY MONITORING (Quarterly) OUTFALL 002
The permittee shall conduct quarterly acute toxicity tests using protocols defined as definitive in E.P.A.
Document EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to
Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow
(Pimephales promelas) 24 hour static test. Effluent samples for self -monitoring purposes must be
obtained below all waste treatment. The tests will be performed on a discharge event during each
quarter (January -March, April -June, July -September, October -December).
Should there be no discharge of flow from the facility during a quarter in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the report
with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the
Environmental Sciences Section at the address cited below.

BACKGROUND
This site was formerly owned by Philips Pipe Line Co. New owner Kinder Morgan Southeast Terminals, LLC
(KMST) owns several bulk storage facilities in the state of North Carolina. Effluent water discharged from the
outfall consists of stormwater from the secondary containment areas (around the individual tanks) and
discharge water following hydrostatic testing. The stormwater is released via one of two outfalls on site.
Inspection reports on file from 2001 and forward report that loading rack water and tank bottom water are
contained on -site and then hauled off to a private contractor for final treatment and disposal.
FILE REVIEW
Correspondence
Correspondence files from 2003 — 2005 were reviewed. During this time period, the Mecklenburg County
Department of Environmental Protection (MCDEP) performed three inspections. Overall, the facility is
depicted as being adequately maintained. Effluent limitations were exceeded for turbidity and TSS on one
occasion each during the time period. Inspection reports also cited the facility for some administrative
shortcomings (monitoring frequencies, reporting issues, etc.).
DMR Review:
DMRs were reviewed from January 2003 through August 2005. The average discharge flow at 001 was
0.2693 MGD; at 002 it was 0.1489 MGD. Both have the same frequency of discharge. During 2003 and 2004
concentrations for all parameters except for turbidity and TSS were routinely reported to be at less than
detection levels. Data revealed violations for turbidity occurred in April 2003 and for TSS in July 2004. Oil
& Grease showed only one detectable hit for each pipe, both occurring during March 2004.

The facility reported collecting samples and performing the EPA Method 625 analysis on the DMRs (mostly as
non detects), but the actual values were not available for review with the DMRs.
Since 2001, outfall 001 has shown good performance with the acute toxicity tests. The reported LC50 in 2001
was 73.9, but was >100% from 2002 through 2005. For outfall 002, it reported >100% in 2003 and 2005, but
in the other years reported 84.4, 85.7 and 83 as the result of annual testing.
Reasonable Potential Analysis:
A reasonable potential analysis was performed during the last permit cycle for turbidity that led to including a
limit of 50 NTU in the permit. An RPA was reperformed for Turbidity during this renewal period. The data
indicate that effluent from both outfalls have the potential to exceed the stream standard of 50 NTU. The
maximum predicted turbidity at 001 was 173.3 NTU; the maximum predicted turbidity at 002 was 57 NTU.
Permitting Strategy
The permitting strategy for this and all oil terminals in the state is based upon a 2005 NPDES document
entitled, "NPDES Permitting Requirements for Petroleum Bulk Storage — Surface Storage Greater than One
Million Gallons 2005 Permitting Strategy." This document is an update to the Division's 2001 permitting
strategy for such facilities. It delineates monitoring frequencies and permitting limits for contaminants
commonly found at these sites. This document is heretofore referred to as the "2005 SOP."
Waste Load Allocation (WLA).
The last waste load allocation was performed in 1991, when the receiving stream was classified C waters.
Gum Branch has since been re-classified to WS-IV waters (confirmed with Aldridge Renn of the
Classifications and Standards Unit, 3/5/01). This WLA recommends BTE, lead and MTBE monitoring and
TSS and oil and grease limits.
Oil Terminal SOP:
• The flow, TSS, and oil and grease requirements specified in the previous permit and the 2005 SOP remain
unchanged. Footnotes have been updated where applicable.
• Although the SOP calls for BTEX parameters to be monitored monthly, the permit has reduced the
monitoring frequency to quarterly because there has been no detection for these parameters during the last
permit cycle.
• The limit for benzene as found in the previous permit has been dropped for the same reason.
• The facility will be required to continue to conduct the EPA 625 analysis for both outfalls because not
enough data were found attached to the DMRs that would allow for a complete evaluation of the need for
discontinuing this testing. The facility will be informed they can ask to have the requirement removed
upon the submittal of sufficient data that show none of the constituent parameters are detected in the
effluent.
• Footnotes regarding tank bottom water and hydrostatic testing have been added/updated per the suggested
language in the 2005 SOP.
• MTBE monitoring has been reduced to quarterly because it was not detected in the discharge during the
previous permit cycle.
• Turbidity monitoring and limits have been maintained as in the current permit for the reasons mentioned in
the RPA discussion above.

. • Requirements for monitoring and limits for phenol were established pursuant to the memorandum
regarding phenol loading from petroleum bulk storage facilities that accompanied the 2005 SOP because it
does discharge to water supply waters. Using the calculation provided in the memo, an allowable
wasteload concentration was established and a reasonable potential analysis was performed based upon
that concentration. Updated analysis performed by Joe Corporon established a 0.48 lbs/day phenol loading
for each of the bulk storage facilities discharging into water supply waters from the Paw Creek area. The
load for this discharge is then shared by the two outfalls. Calculations for each of the outfalls follow.
Calculation for 001:
0.24 lbs/day x 1 = 0.107 mg/1
8.34 0.2693 MGD
Calculation for 002:
0.24 lbs/day x 1 = 0.193 mg/1
8.34 0.1489 MGD
Phenol was not detected in the effluent of either outfall during the period of review. Therefore, the limit that
had been included in the previous permit was dropped, but pursuant to the 2005 SOP, monthly monitoring for
phenol has been retained.
• Toxicity As a result of the toxicity performance noted in the DMR review discussion above, outfall 001
shall retain its annual toxicity monitoring requirement (no limit). However, due to the performance at
outfall 002, application of the toxicity policy stated in the 2005 SOP calls for increasing monitoring
frequency for acute toxicity testing to quarterly. An appropriate attachment was obtained from the Aquatic
Toxicology Unit to include in the permit for outfall 002. The facility will be informed that it may ask that
the requirement be returned to annual monitoring upon the submittal of five consecutive tests showing an
LC50 of >100%.
SCHEDULE FOR PERMIT ISSUANCE
Draft Permit to Public Notice: July 13, 2005
The initial drafting of this permit was done with the permit writer not knowing that the 2001 guidance for such
facilities was being updated, so the permit was drafted using the 2001 SOP and other permit precedent as
guides. Although it went to public notice, final action on the permit was held while the 2005 SOP was being
drafted and approved. Once it was issued, the permit was reexamined in light of the terms of the new SOP and
some changes were made. The permittee was made aware of the changes from the terms of the July 2005 draft
that were being proposed. The permittee has expressed its agreement with the terms of the modified permit
and has requested it be issued as modified.
Unfortunately, because of the permit writer's inexperience, the Mooresville Regional Office was not provided
with opportunity to comment on the draft permit before it went to public notice. They had provided a staff
report that recommended renewal of the permit as requested. No objections to the terms of the permit were
expressed by MRO upon its receipt of the initial draft, although they did comment about the departure from
standard review procedure.

Hello Mr. Sullivan,
My name is Bob Sledge and I work with the North Carolina Division of
Water Quality in its Western NPDES Unit. On July 6, 2005, I sent you a
draft version of the permit for your Charlotte Terminal #1 (NPDES permit
NC0032891), but since that time I haven't been a very good
correspondent. I want to apologize for the lack of communication and
provide you with an explanation and an update on the status of the
permit.
When I drafted the permit I was not aware that our staff was revising
its permitting policy regarding petroleum bulk storage facilities. This
was brought to my attention after I sent you the draft and I was
directed to hold off on taking any final action until the permitting
guidance was finalized. This was done in early September. Delays since
that time fall on my shoulders as I digested the policy and applied it
to permits that are my responsibility. I'm sorry for not providing you

with updates on this situation and taking so long to move on this one.
Application of the policy to the permit has caused some modification of
its terms. A copy of a revised draft has been attached to this e-mail.
I wanted to take this opportunity to tell you of the changes within
this permit from the previous draft.
For both outfalls, the policy calls for monthly monitoring for phenol.
This is a change from the quarterly monitoring frequency found in the
draft. As was in the July draft, this draft contains no limit for
phenol.
For both outfalls, the new draft contains more extensive footnotes,
especially with regard to flow measurement. Most notes are the same in
content as in previous permits.
The biggest change you'll see on the attached draft is a change in the
requirement for aquatic toxicology testing on outfall 002. The
frequency has been changed from annual to quarterly per application of
the policy, which requires this change if effluent monitoring shows
anything less than an LC50 of >100% from these discharges during the
previous 5 years. However, if the discharge exhibits no toxicity in the
monitoring for five consecutive quarterly tests, the Division will
consider your written request to have the required frequency again
changed to annual monitoring. This change was made because acute
toxicity testing from outfall 002 yielded an LC50 result of <100% in
three of the last five annual tests.
I wanted to make you aware of the changes we are proposing and give you
the opportunity to comment on them. Unless I hear from you and it is
determined that modifications can be made to the draft, I would like to
issue this permit within a month's time, with an effective date of
January 1, 2006.
I truly regret any inconvenience these changes and delays have caused
you and your company. Thank you for your patience in this matter. If

On the basis of thorough staff review and application of NC General
Statute 143.21. Public Law92-500 and other lawful standards and reg-
ulations, the North Carolina Environmental Management Commission
proposes to issue a National Pollutant Discharge Elimination System
(NPDES) wastewater discharge permh to the person(s) listed below
effective 45 days from the publish date o1 this notice.
Written comments regarding the proposed permit will be accepted
until 30 days after the publish date of this notice. All comments
received prior to that date are considered in the final determinations
regarding the proposed permit. The Director of the NC Division of
Water Quality may decide to hold a public meeting for the proposed
permit should the Division receive a significant degree of public inter-
est.
Copies of the draft permit and other supporting information on file
used to determine conditions present in the draft pemat are available
upon request and payment of the costs of reproduction. Mail corn.
ments and/or requests for information to the NC Division of Water
Quality at the above address or call the Point Source Branch at (919)

The City of Gastonia (P.O. Box 1748, Gastonia, NC 28053) has applied
for renewal of NPDES permit NC0020184 for the Long Creek WWfP
in Gaston County. This permitted facility discharges 16.0 MGD at
treated wastewater to Long Creek in the Catawba River Basin.
Currently 130D. ammonia nitrogen, total nitrogen. total ph
nickel and total residual chlorine are water quality limited. is 08-
charge may affect future allocations in this portion of the Catawba
River Basin.

The Town of Dallas (210 North Holland Street, Dallas, NC 201134) has
applied for renewal of permit NC0068888 for its WWTP in Gaston
County. This permitted facility discharges treated domestic waste-
water to an unnamed tributary to Long Creek in the Catawba River
Basin. Currently BOD, ammonia nitrogen, fecal coliform and total
residual chlorine are water quality limited. This discharge may affect
future allocations in this portion of Long Creek.
Plantation Pipe Line Company has applied for renewal of NPDES per-
mit NC0084280 for its groundwater remediation site in Mecklenburg
County. This permitted facility discharges remediated groundwater to
an unnamed tributary to the Catawba River in the Catawba River
Basin. Currently manganese is water quality limited. This discharge
may impact future allocations in this portion of the watershed.
Unocal Corporation has applied for renewal 01 NPDES permit
NC0085057 for its Or Road groundwater remediation site in
Mecklenburg .Co. This permitted facility discharges remediated
groundwater to an unnamed tributary to Briar Creek in the Catawba
River Basin. Currently, chromium and nickel are water quality limited.
This discharge may impact future allocations in this portion Of the
watershed. •
Kinder Morgan Southwest Terminals, LLC has applied for renewal of
NPDES permit NC0032891 for its Charlotte Terminal 1 site in
Mecklenburg County. This permitted facility discharges storm water
from secondary containment areas to an unnamed tributary to Gum
Branch in the Catawba River Basin. Currently turbidityis water quality
limited. This discharge may impact future allocations in thls portion of
the watershed.
The BV Hedrick Gravel and Sand Co. (7 Yorkshire Street, #102,
Asheville, NC 28803) has applied for renewal of NPDES permit
N000281169 for the facility in Stanly County. This permitted facility
discharges industrial process wastewater to the Long Branch in the
Yadkin -Pee Dee River Basin. Currently oil and grease. TSS, and tur-
bidity are water quality limited. This discharge may affect future allo-
cations in this portion of the Yadkin -Pee Dee River Basin.

Dear Ms. Bryant:
This letter is in response to your December 22, 2004 letter to Mr. David Hildreth
regarding solids handling and disposal at the referenced facility. Please note that the
Kinder Morgan Southeast Terminals LLC (Kinder Morgan) Charlotte Terminal #1
removes solids approximately annually. This occurs during the pump out of oil/water
separator(s) at the facility. Solids removed with residual petroleum product are
transported via licensed contractor to a permitted petroleum reclamation facility. The
solids, once processed, are confirmed "non -hazardous" and are disposed of or are
beneficially used at an appropriate landfill.
