Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes no major changes from the draft permit sent to you on July 30, 2003. This permit includes a TRC limit that will take effect on May 1, 2005. If you wish to install dechlorination equipment, the Division has promulgated a simplified approval process for such projects. Guidance for approval of dechlorination projects is attached. The Division strongly recommends connecting this discharge to the Town's wastewater collection system, eliminating the need for this permit (and any expenditures related to dechlorination). If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Description of existing or substantially constructed WWT facilities: The existing WWT facilities at outfall 001 consist of two 900 gallon capacity septic tanks acting as grease traps followed by a flow splitter box, pH adjustment using powdered soda ash, two 0.0075 extended aeration package type WWTPs connected in parallel containing bar screens, aeration and clarification, two final settling tanks on each plant (originally used for disinfection), a common chlorine contact tank with sodium hypochlorite (HTH) disinfection, a flow recorder with totalizer and V-notch weir, and one (1) aerated sludge holding tank. This facility also has an oil/water separator, which collects and treats SW from the fuel loading area, and discharges through outfall 002. f. Description of proposed WWT facilities: There are no proposed WWT facilities. g• Possible toxic impacts to surface waters: Chlorine is added to the waste stream, however, toxicity testing is not currently included in this facilities permit. h. PART IV - EVALUATION AND RECOMMENDATIONS The permittee requests renewal of the subject Permit to discharge treated domestic and industrial wastewater from an interstate car and truck restaurant and fuel refilling plaza. The WWT facilities appeared to be functioning properly at the time of the site visit. There have been no changes to the WWT facility or the waste stream during the term of the current permit. The existing facilities should be capable of complying with the current permit limitations without the construction of additional treatment facilities. The receiving stream (at outfall 001) has been found by USGS to have positive 7Q10 flow.
