Drawer 700 Marion, North Carolina 28752 A 7.7A Nr NCDER Subject: NPDES Permit Issuance Permit No. NC0031879 Marion-Corpening Creek WWTP McDowell County Dear Mr. Daniels: Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended.) The following modifications have been made to the final permit: • The deletion of effluent limitations for chromium, mercury, nickel, and lead based on evaluation of data and the reasonable potential analyses. These parameters will continue to be monitored quarterly under the long term monitoring plan (LTMP) of the pretreatment program. • The deletion of effluent monitoring for arsenic based on evaluation of data and the reasonable potential analyses. Quarterly monitoring will continue under the long term monitoring plan (LTMP) of the pretreatment program. • The daily maximum effluent limitations for cadmium and cyanide have been revised and updated to one half of the final acute values as recommended by the Environmental Protection Agency effective April 22, 1999. The previous daily maximum cadmium limit of 7.5 ug/1 has been revised to 15 ug/1 (for streams without a trout classification), and the previous daily maximum cyanide limit of 30 ug/1 has been revised to 22 ug/I. • The Division considered specific quantitation and detection limits for problem parameters such as mercury and cyanide where laboratory methods cannot measure down to the level of certainty required for stream -based Water Quality Standards. To clarify, the Division has added the following respective paragraph as a footnote to the effluent page: The Division shall consider all cyanide concentrations reported below 10 ug/I to be "zero" for permit compliance purposes only. A North Carolina certified laboratory should continue to report all cyanide values detected, even if these values are below the Division's specified quantitation level of 10 ug/I. Please be advised that the receiving stream, Corpening Creek, is an impaired stream listed on the State's 303(d) list due to unspecified or unknown sources. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental permits may be required. See A (2) Special Conditions of the Supplement to Effluent Limitations. 7 The Division of Water Quality shall consider all cyanide concentrations reported below 10 ug/L to be "zero" for permit -compliance purposes only. A North -Carolina -certified laboratory should continue to report all cyanide values detected, even if these values are below the Division's specified quantitation level of 10 ug/L. There shall be no discharge of floating solids or visible foam in other than trace amounts. Permit No. NC0031879 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A (2). CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 67.0%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of February, May, August, and November. Effluent sampling for this testing shall be performed at the NPDES permitted fmal effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address: Attention: Environmental Sciences Branch North Carolina Division of Water Quality 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. . Had filed a suit against the Town of Marion alleging violation of the Clean Water Act. Also wanted their grievances heard before making a decision of the renewal. Enclosed petitions requesting a hearing. 11/30/00 — NPDES responds via email to Joe Seagle of the Law Office of Charles R. Worley, acknowledging receipt of the letter and request for a public hearing on the renewal. Tells of staff shortage and that the permit had not been assigned to anyone yet. When you factor in your office's acute awareness of our requests for information- well, let's just say that we are extremely upset. We would like to give your office the first opportunity to respond and to dispel our view. Please do so immediately and without delay, as time is of the essence in this matter. Facility is a 3.0-MGD plant that discharges into Corpening Creek, a class C stream, in CTB30 subbasin. The WWTP handles domestic and industrial waste and serves a population of between 4500- 5000 people. The 1999 Catawba River Basinwide Management Plan lists Corpening Creek as partially supporting its uses. There are two segments: 1) a 4.2-mile segment from the source to the Marion WWTP with nonpoint contributors as the major source. 2) a segment from the Marion WWTP to North Muddy Creek. Possible sources of impairment are urban runoff and the Marion WWTP. Major sources are nonpoint and point. The 1997 benthos rating for the segment was fair. Corpening Creek is listed on North Carolina's 2000 303(d) list. The first listed segment is from source to Marion WWTP. The cause of impairment is unknown but potential sources are urban runoff /storm sewers. The second listed segment is from the Marion WWTP to North Muddy Creek. Again, the cause of impairment is unknown, but potential sources are municipal point sources, urban runoff / storm sewers. In Nov. 1999, several families in McDowell Co. filed a suit against Marion alleging that the plant had violated the Clean Water Act on numerous occasions. They submitted several signed petitions requesting a public hearing for the renewal of the permit based on: 1) violations of the NPDES permit 440 times since Jan. 1, 1996, 2) spills of untreated raw sewage into Corpening Creek more than 16 times since Jan. 1, 1998, 3) spills of more than 270,000 gallons of untreated raw sewage into Corpening Creek, since Jan. 1, 1998. On March 20, 2000, attorney representing the families in the suit against the City of Marion, submitted a letter to DWQ saying that a settlement agreement had been reached and they agreed to withdraw their request for a public hearing and no longer oppose the permit. Prior to March 1998, this plant had a very bad toxicity record with five (5) FAILs in 1997 (Feb., May, August, Sept. and Oct.) along with one bad test in November. There was one FAIL in August 1996 and all other tests were PASS. COMPLIANCE SUMMARY: In 2000, Avg. Qw = 0.933 MGD, BOD5=6.80 mg/1, NH3=0.30 mg/1, TSS=5.0 mg/1, TN=5.39 mg/ and TP=1.55 mg/1. Monitoring required only during May, June, July, August and September. -7c. ri P??A y /4/1D Aer a Permit Notes NC0031879 The City of Marion- Corpening Creek WWTP has requested renewal of existing permit. Facility is a 3.0-MGD plant that discharges into Corpening Creek, a class C stream, in CTB30 subbasin. The WWTP handles domestic and industrial waste and serves a population of between 4500-5000 people. The 1999 Catawba River Basinwide Management Plan lists Corpening Creek as partially supporting its uses. There are two segments: 1) a 4.2-mile segment from the source to the Marion WWTP with nonpoint contributors as the major source. 2) a segment from the Marion WWTP to North Muddy Creek. Possible sources of impairment are urban runoff and the Marion WWTP. Major sources are nonpoint and point. The 1997 benthos rating for the segment was fair. Corpening Creek is listed on North Carolina's 2000 303(d) list. The first listed segment is from source to Marion WWTP. The cause of impairment is unknown but potential sources are urban runoff /storm sewers. The second listed segment is from the Marion WWTP to North Muddy Creek. Again, the cause of impairment is unknown, but potential sources are municipal point sources, urban runoff / storm sewers. In Nov. 1999, several families in McDowell Co. filed a suit against Marion alleging that the plant had violated the Clean Water Act on numerous occasions. They submitted several signed petitions requesting a public hearing for the renewal of the permit based. on: 1) violations of the NPDES permit 440 times since Jan. 1, 1996, 2) spills of untreated raw sewage into Corpening Creek more than 16 times since Jan. 1, 1998, 3) spills of more than 270,000 gallons of untreated raw sewage into Corpening Creek, since Jan. 1, 1998. On March 20, 2000, attorney representing the families in the suit against the City of Marion, submitted a letter to DWQ saying that a settlement agreement had been reached and they agreed to withdraw their request for a public hearing and no longer oppose the permit. The facility has an average industrial flow of 0.395 MGD. The permitted industrial flow is 1.0 MGD. Qw = 0.933 MGD, BOD5=6.80 mg/1, NH3=0.30 mg/1, TSS=5.0 mg/1, TN=5.39 mg/ and TP=1.55 mg/1. Plant is currently at 31% capacity and in compliance with all oxygen consuming limits. In 1999, Avg. Qw = 1.07 MGD, BOD5=5.37 mg/1, NH3=0.07 mg/1, TSS=3.3 mg/1, TN=2.0 mg/ and TP=1.56 mg/1. In 1998, Avg. Qw = 0.934 MGD, BOD5=3.65 mg/1, NH3=1.9 mg/1, TSS=1.9 mg/1, TN=2.85 mg/ and TP=1.56 mg/1. The sludge is to dewatered by a vacuum filter and then sent to the land fill. During 1998, 187 dry tons of sludge was sent to the landfill. The City of Marion also holds a Class A Distribution Permit (Permit No. WQ0008681) issued by NCDENR to pasteurize the sludge and distribute to the local residents to land apply.
