The Division of Water Quality (Division) personnel have reviewed and approved your application for renewal and
modification of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. It is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
The following changes have been made from the previous permit:
Supplement to Cover Page:
• Section 1: Cooling Tower Slowdown is added to discharge to Outfall 001.
• Old Section 2 regarding boiler blowdown discharge to Outfall 002 is deleted.
• Old Section 3 regarding cooling tower discharge to Outfall 003 is deleted.

right to an adjudicatory hearing upon written request within thirty (30) days after receiving this letter. Your request must
take the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes, and must be
filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714.
Unless such demand is made, this permit remains final and binding.
This permit is not transferable except after notifying the Division of Water Quality. The Division may modify and re-
issue, or revoke this permit. Please notice that this permit does not affect your legal obligation to obtain other permits
required by the Division of Water Quality, the Division of Land Resources, the Coastal Area Management Act, or other
federal or local governments.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As of this permit
issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive authority to
operate and discharge from this facility arises under the permit conditions, requirements, terms, and provisions included
herein.
Tyco Electronics Corporation is hereby authorized to:
1. Continue to operate an existing 0.0175 MGD extended aeration wastewater treatment system,
combined with cooling tower blowdown, discharging from outfall 001, with the following
components:
• Bar screen,
• Aeration basin with dual blowers providing diffused air,
• Hopper -style rectangular clarifier with skimmer and sludge returns,
• Tablet chlorinator,
• Chlorine contact chamber, and
• Tablet dechlorinator.
2. Continue to discharge groundwater remediation wastewater from outfall 004 from a GWR facility
with the following components:
• 6 Extraction wells,
• Dual air strippers,
• Four carbon filters
• Groundwater monitoring wells.
3. This facility (with all outfalls) is located near Fairview at the Tyco Electronics WWTP at 1396
Charlotte Highway in Buncombe County.
4. Discharge from said treatment works at the locations specified on the attached map into Cane
Creek, classified C-Trout waters in the French Broad River Basin.

1. Instream sample locations shall be determined by joint decisions by Tyco Electronics Corporation, NCDENR
(as represented by permit staff from the Asheville office) and the contract operator, James & James for both
Upstream and Downstream locations. Once the sample locations are defined, all future instream sampling must
be taken at those two locations.
2. The Division shall consider all effluent TRC values reported below 50 µg/L to be in compliance with the permit. However, the Permittee
shall record and submit all values reported by a North Carolina certified laboratory (including field certified), even if these values fall below
50 µg/L.
3. The effluent temperature shall not cause an increase in the temperature of the receiving stream of more than 0.5°C. In
no case shall the effluent temperature cause the receiving stream temperature to exceed 20°C.
4. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units.
There shall be no discharge of floating solids or visible foam in other than trace amounts.
There shall be no chromium, zinc or copper added to the cooling water. The permittee shall obtain
approval from the Division's Environmental Sciences Section prior to the use of any biocide in the cooling
water (see A. (4.)).

A. (3.) CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (Quarterly, 004)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of 5.6%.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the
"North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent
versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February
1998) or subsequent versions. The tests will be performed during the months of February, May, August and
November. Effluent sampling for this testing shall be performed at the NPDES permitted fmal effluent
discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit
limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months
as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February
1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest
concentration having no detectable impairment of reproduction or survival and the lowest concentration that
does have a detectable impairment of reproduction or survival. The definition of "detectable impairment,"
collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase
II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for
the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate
signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is
employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the
report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to
the Environmental Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be
required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls, shall
constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day
of the month following the month of the initial monitoring.

A. (4.) Biocide Condition
The permittee shall obtain approval from the Division prior to the use of any biocide in the cooling water
discharged from this facility. Approval should be requested at least 90 days in advance of the planned use of
any biocide which may be toxic to aquatic life (other than previously approved compounds). The request
should be submitted to the Aquatic Toxicology Unit of the Division's Environmental Sciences Section at the
following address:

Consult the Aquatic Toxicology Unit for specific items that should be submitted with each request (such as
Biocide Worksheet Form 101, MSDS documentation, etc.). Completion of Biocide Worksheet Form 101 is not
necessary for those outfalls with toxicity testing requirements.
Concentrations of chromium, copper or zinc added to biocides shall not exceed applicable water quality
standards (or action levels) in the receiving stream. These concentrations should be calculated using the
Biocide Worksheet Form 101 with the Supplemental Metals Analysis Worksheet.
A. (5.) Reopener Clause
If the permittee makes piping changes in order to reuse cooling tower blowdown and not discharge it as a
heated water wastestream, the Division may reopen the permit and remove the temperature discharge limits and
instream temperature monitoring requirements from Special Condition A. (1.) Effluent Limitations And
Monitoring Requirements (001).

Summary:
• This permit was originally issued in 1977 to Communications Instruments, Inc. The permit included 3
outfalls, 001: 0.018 MGD 100% domestic, 002: Boiler blowdown, and 003: Cooling Tower Blowdown.
• The 1996 renewal authorized addition of 0.288 MGD Groundwater Remediation through new outfall 004.
• The company name was changed to CH Technologies, CII Division in November, 2000.
• The company name was changed to Tyco Electronics Corporation sometime between November, 2000 and
September, 2005.
• The current permit expired on December 31, 2010. A renewal application was submitted on July 1, 2010.
A permit modification was requested to delete boiler blowdown outfall 002, as it is no longer used, and to
combine cooling tower blowdown outfall 003 with the WWTP discharge to outfall 001. Groundwater
remediation discharge will remain at 004.
Facility Description:
The facility operates a 0.0175 MGD extended aeration basin with a 17,500 gallon treatment facility, clarifier, with
tablet chlorination , chlorine contact chamber, and tablet dechlorination, serving restrooms and hand sinks for 219
factory employees. Intermittant cooling tower blowdown (approximately 0.00008 MGD) will be piped to Outfall
001 from existing Outfall 003. The cooling tower blowdown is entirely City of Asheville City water, with no process
contact and no added chemicals. Sludge from the WWTP is removed by a pumping service and hauled to the
Brevard WWTP for disposal. The average flow from the WWTP is 0.0020 MGD, or about 11.4% of capacity. The
maximum flowrate for the past 3 years is 0.0060 MGD, or 34% of design. The cooling tower blowdown should not
create any flow limit problems.
The facility operates a GWR designed to remove volatile organic compounds from groundwater. The GWR consists
of six extraction wells with dual air strippers and four carbon filters, a SCADA system, and about 40 monitoring
wells. The treatment process generates no solids or sludge; therefore, no special handling or disposal of generated
solids/sludge is required.
Basin Plan:
Cane Creek at the discharge site is classified as C, Trout and is not impaired. A short distance downstream, at
Ashworth Creek, Cane Creek is listed on the 2010 303(d) list as impaired for biological integrity. All streams in NC
are listed as impaired for mercury resulting from aerial deposition.

Compliance Review:
A Compliance Inspection performed on May 10, 2011 found the facility was operated and maintained very
well, and appeared to be in compliance with the permit limits.
Whole Effluent Toxicity (WET) Test:
Quarterly sampling data was reviewed from January 2009 to November 2011. All 11 chronic WET tests Passed.
DMR Instream and Effluent Data Review:
Old Outfalt 002 (Boiler Blowdown) and 003 (Cooling Tower Blowdown) required instream monitoring. Outfall 002
has been out of service for years, so instream data was not reviewed. Outfall 003 instream data shows that there is
some variation in instream temperature, but the IWC for the cooling tower blowdown is 0.0002%, so the cooling
water could not make much of a change in stream temperature. Instream monitoring has been added to Outfall 001
with the addition of the cooling tower blowdown to this outfall.
The average flow for the period of January 2009 to November 2011 was 0.0020 MGD (11.4 % of permitted flow).
Proposed Modifications:
• Per the permittee's request, Outfalt 002 (Boiler blowdown) and 003 (Cooling tower blowdown) have been
deleted from the permit.
• Cooling tower blowdown has been added to Outfall 001 - domestic wastewater treatment discharge.
• The monitoring frequency for Carbon Tetrachloride, 1, 1-Dichloroethene, 1, 2-Dichloropropane,
Tetrachloroethene (PCE), and Trichloroethene (TCE) was reduced to Semiannual from Quarterly as the
result of RPA.
• Monitoring for Toluene was removed.

If the permittee makes piping changes in order to reuse cooling tower blowdown and not discharge it as a heated water
wastestream, the Division may reopen the permit and remove the temperature discharge limits and instream temperature
monitoring requirements. This will be considered to be a minor modification that does not require public notice in
accordance with 1 SA NCAC 02H .0 l 14(b)(1).
What do you think? I would like to get this one out next week if possible.

Mr. McKay,
After the submittal of our previous comment on the draft permit on March 5, 2012, I have had additional discussions,
including with our contract operator James & James, regarding the temperature limits and monitoring requirements for
Outfall 001 in the draft Permit No. NC0033227. Based upon these discussions, we request that the temperature limits for
Outfall 001 in the draft permit be eliminated. We agree to monitor the temperature but do not believe temperature limits
are warranted as outlined below.
• At the permitted flow of 0.0175MGD and a 7Q10 low flow for Cane Creek, the discharge from Outfall 001 would
be less than one-half of 1 percent of the stream flow. This discharge flow will not have a thermal impact on the
stream.
• The cooling tower flow (which we propose to discharge into the sanitary wastewater treatment system) is
approximately 100 gallons/day. This volume is only approximately one-half of 1 percent of the Outfall 001 flow
and 0.002 percent (so 0.00002) of the 7Q10 stream flow. Clearly the thermal discharge flow of 100 gallons per
day will not have any thermal impact on the stream.
• There are numerous other potential causes of changes in the stream temperature in the near vicinity, upstream
and downstream of our permitted outfalls. There are permitted discharges from the Ledgestone development
WWTP and from the Fairview Elementary School WVVfP. There are tributaries to Cane Creek. There are
different flow conditions — ripples and placid areas. And there are other factors — for example, shaded versus
unshaded areas that have different solar gains and stormwater runoff from paved roads and highways.
• Additionally, as presented in my 2/28/12 email to you, in the summer months (June through September) of 2003
to 2011, we have documented that the upstream temperature exceeded 20 C in 15 of the 36 months.
While we understand that the permit does have the qualifying language "the effluent temperature shall not cause..." the
stream temperature to exceed the trout stream based water quality standards, we do not see any benefit to temperature
limits being included in the permit. There will be summer months when the stream temperature exceeds 20 C for many
reasons totally outside the control of Tyco Electronics Corporation. We will be placed in the position of proving that we did
not cause the temperature increase — of proving a negative. Thus, we respectfully request that the temperature limits be
eliminated from the draft permit.
Regardless of whether the temperature limits can be eliminated or not, we also request that footnote #1 in section A.(1.),
which defines the upstream and downstream temperature sampling locations, be amended. Because of the many
potential other factors that could impact the stream temperature, these locations should be carefully selected so that to
the extent possible, the temperature influences of the many factors above are eliminated or minimized. We propose that
these locations be selected and mutually agreed upon by Tyco Electronics Corporation and NCDENR (as represented by
permit staff from the Asheville office) with technical assistance provided by our contract operator, James & James.

I did discuss the idea of reclassification of Cane Creek to "C" instead of "C-Trout" with Elizabeth Kountis today.
She said in order to do that, we would have to prove that there have not been trout in the stream since 1975 to
the present, or from the time of classification to the present. She said that NC has done that one time only, in
an unusual case. Her number is (919) 807-6418 if you would like to try.
I have trouble thinking that the discharge is capable of affecting the stream temperature. Adding the flow from
old outfall 001 and 003, it looks like the total will be about 0.04% of the 7Q10 stream flow. Any temperature
difference between upstream and downstream would have to be caused by solar heat or some other factor.

planning section. I have summarized the data and presented my question below.
Attached is a spreadsheet presenting certain historical temperature data for Outfall 001. By certain, I mean that
have only included the stream temperatures, including upstream temperatures, which equal or exceed 20 C. I
also only looked back to 2003.
If you define summer months as June through September and look at years 2003 through 2011, then the
upstream temperature has exceeded 20 C in 15 of the 36 months.
Cane Creek is classified as a trout stream from its source to its confluence with Ashworth Creek. This confluence
is near where Cane Creek crosses Rt. 74, about a few hundred yards downstream of Outfall 001. I understand
that the temperature requirements for Outfall 001 in the draft reissued permit are based on this classification of
this portion of Cane Creek as a trout stream. Given the upstream temperatures discussed above, my question is
whether this classification as a trout stream (using the confluence as a point of demarcation) is correct.

Tyco Electronics is requesting that consideration be given to combining the discharge
of Cooling Tower Water - Outfall 003 with Sanitary Wastewater — Outfall 001 as part of
the permit renewal request. The water discharge for Outfall 003 is a direct pass through
of city water (City of Asheville) with no contact with process activity and no chemical d t<
additions for tower treatment. The amount of discharge from Outfall 003 remains the
same as originally submitted in the permit renewal request letter dated June 23, 2010.
By this updated request, Tyco Electronics proposes only have two discharges for the
NPDES Permit from the facility, Sanitary Wastewater - Outfall 001 and Groundwater —
Outfall 004. This request consideration has had prior review with Jeff Menzel,
Environmental Specialist - NCDENR/DWQ/SWP — Asheville Regional Office, and
James & James, ORC, representatives for comments.

1.0 Introduction
Tyco Electronics Corporation (TEC) owns and operates an industrial manufacturing facility in
Fairview, North Carolina. The facility is currently permitted to discharge wastewater from the
following four outfalls:
• Outfall 001- Treated sanitary wastewater
• Outfall 002 - Boiler blowdown water
• Outfall 003 - Cooling tower water
• Outfall 004 - Treated contaminated groundwater
This application package includes the information required by the North Carolina Department of
Environment and Natural Resources (DENR), Division of Water Quality (DWQ) to renew the National
Pollution Discharge Elimination System (NPDES) permit for Outfalls 001, 003, and 004. This
application package does not contain information related to outfall 002, because TEC no longer
requires the boiler blowdown water discharge (outfall 002) and requests that this be removed from
the re -issued permit.

2.0 Sanitary Wastewater - Outfall 001
This outfall includes sanitary wastewater from the bathrooms, breakrooms, drinking water
fountains, and hand sinks used by the employees at the TEC manufacturing facility. Wastewater
from industrial processes is not discharged to this outfall.
The location of outfall 001 is indicated on Figure 1. The latitude and longitude of outfall 001 are 35
degrees, 31 minutes, 34 seconds north and 82 degrees, 24 minutes, 10 seconds west, respectively.
Appendix A includes NPDES Application Form D related to this outfall.
Wastewater discharged to this outfall is treated by an extended aeration wastewater treatment
system. A schematic of the flow through the treatment system associated with this outfall is
included as Figure 2. The sanitary wastewater treatment system is operated by a contract
operator, James & James Environmental Management, Inc. (James & James). Appendix B includes a
letter from James & James describing the solids management at the facility. Laboratory analytical
results are summarized on the form in Appendix A.

3.0 Cooling Tower Water - Outfall 003
This outfall includes water discharged from a cooling tower. According to James & James, the
operator for the site, until recently discharge from the cooling tower did not occur. Discharge from
the cooling tower currently occurs on an intermittent basis. The system is designed to discharge
based upon water conductivity. During the summer months discharge occurs every three to five
days. During the winter months discharge should occur about once every two weeks. When
discharge occurs, its duration is about 24 hours. During the 24-hour period approximately 100-
gallons is discharged at a constant rate (about 4.17 gallons per hour).
The location of outfall 003 is indicated on Figure 1. The latitude and longitude of outfall 003 are 35
degrees, 31 minutes, 25 seconds north and 82 degrees, 24 minutes, 24 seconds west, respectively.
Appendix C includes NPDES Permit Application Short Form C - Minor Industrial which is related to
this outfall. Total residual chlorine, pH, and temperature measurements from the cooling tower
discharge are summarized on the form in Appendix C.

4.0 Groundwater - Outfall 004
This outfall includes treated groundwater associated with a remediation system operated in
accordance with an Administrative Agreement issued by the DENR, Division of Waster Management
(DWM), Superfund Section, Inactive Hazardous Sites Branch (IHSB).
The location of outfall 004 is indicated on Figure 1. The latitude and longitude of outfall 004 are 35
degrees, 31 minutes, 25 seconds north and 82 degrees, 24 minutes, 10 seconds west, respectively.
Appendix D includes NPDES Permit Application Short Form C - GW which is related to this outfall.
Groundwater is extracted from six wells and pumped to a treatment system. Groundwater
discharged to this outfall is treated by air stripping and activated carbon. A site plan map showing
the locations of the groundwater extraction wells and treatment system is included as Figure 3.
The current permit requires sampling of the effluent from outfall 004 on a quarterly basis. Effluent
samples are analyzed for chronic toxicity and the following volatile organic compounds (VOCs):
carbon tetrachloride, 1,1-dichloroethene, 1,2-dichloropropane, tetrachloroethene, trichloroethene,
and toluene. None of the listed VOCs were detected in the last five years. Laboratory analytical
reports for the spring 2010 monitoring event are included as Appendix E.

The Outfall 001 wastewater is sanitary wastewater from employee restrooms and hand sinks.
The treatment process includes an existing 0.0175 million gallon per day (MGD) extended
aeration treatment system with tablet chlorination followed by a dechlorination flow through
cell. Assuming typical wastewater charecteristics, BOD and TSS removal efficiency -is about
98% and amonia nitrogen removal efficiency is about 90%. Phosphorus is not monitored
parameter.
