RE: Return of Application Elk Creek at Banner. Elk
David,
This project has been returned. There were various inadequacies with the application and several attempts to receive
the required information..
To gain 401 approval a new application will have to be submitted and reviewed.
However, The Division of Water Resources is willing to meet with applicants regarding permit applications and
associated project requirements.
You mention that there has been a misunderstanding of the scope of the project? Could you elaborate on this
statement so that we could understand your comment?
At this stage of the project if Mr. Acceturro and yourself would like to meet to discuss a new application once it is
submitted we would entertain and welcome a meeting.
Mr. Devane can be contacted for any stormwater related questions and I can be contacted for any other remaining
items. You may contact us by phone or email.
If you decide to re- submit an application and would like to schedule a meeting please let us know. We would request an
outline of the items that you would like to discuss before a meeting is scheduled.
Please let me know if you have any remaining questions.
Regards,
Tim

Tim: I have reviewed the comments in the letter you sent to me regarding aforementioned project. After readingthe letter there
appears to be some misunderstanding of the scope of this project. I think we need to have a meeting and I am willing to meet
with you and Boyd Devine if you will advise me of a time and place to resolve any misunderstanding on the scope of this project.
Mr. Accetturo,
Attached is the return letter for the Elk Creek at Banner Elk project
Please review the unresolved items that needed further clarification. Once you have addressed the problems and /or
inadequacies with your
Application as it was submitted, you will need to reapply to the Division for approval including a complete application
package and the appropriate
Fee.
We will be happy to meet with you and /or your engineer of record to work on a way to get the stormwater
management plan approved.
If you have further questions after reviewing the letter please let me know.
Thanks,
Tim
