Dear Mr. Fox,
On behalf of Hathaway Development Partners, LLC, we are responding to the Notice of Violation issued
for the subject project on September 29, 2014. The contractor has been notified to proceed with resolving
your concerns. Our responses to your comments and concerns we as follows:
Stream Standard Violation — Other Waste (fn- stream sediment)
a. Enclosed is a map of the area affected.
b. The Sediment Removal Plan (Plan) is as follows:
• Area 1: Conditions at pipe outfall to be improved with installation of outlet
weir as addressed in response to NOV- 2014 -PC -0179.
Area 2: With the installation of live stakes in Area 3 and 4, we will believe this
will self-stabilize, however, we will continue to monitor the area to verify B,
this assumption proves to be correct.
Area3: The sediment is to be removed using manual labor and buckets to
remove approximately Machos of sediment along the stream corridor.
Area 4: Area appears to be self - stabilized. We will confiuue to monitor the
area.
• Contractors will start removing sediment weather permitting, with a
projected completion date prior to the end of February. The removal shall
take approximately 1 -week to complete.
• The removed sediment will be placed along the pond bank and stabilized by
seeding.
• By using manual labor with buckets, minimal disturbance to the stream
thereby, keeping site within compliance of turbidity standards.
c. Once work has been completed, we will submit a final report documenting the results
of the sediment removal activities to your office.
