Staff review of the plans and 'specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 21-1.1000. We are forwarding Permit No. SW8 981209 dated February 23, 1999, for the construction of Wilmington South Operating Center-CP&L. '"- This permit shall be effective from the date of issuance until February 23, 2009, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the Stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150E of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 2761 1-7447. Unless such demands are made this permit shall be final and binding. SCHEDULE OF COMPLIANCE I. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface except roads. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. h. The vegetated filter will be kept grassed with no erosion. The spreader mechanism will be kept clear. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of'HWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Decorative spray fountains will not be allowed in the stormwater treatment system. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 8. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 9. Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. 10. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. IL The runoff from all built -upon area on the project must be directed into the permitted stormwater control system. 12. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 0 State Stormwater Management Systems Permit No. SW8 981209 13. Redesign or addition to the approved amount of built -upon area. C. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS I . This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name _ change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be approiate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 3. "file issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement Stormwater management systems. 5. Deed Restriction Requirements The following statements must be recorded for all low density projects and for all projects that involve the subdivision and selling of lots or outparcels: No more than square feet of any lot, including that portion of the right-of-way between the edge of pavement and the front lot line, shall be covered by impervious structures, including asphalt, gravel, concrete, brick, stone, slate or similar material but not including wood decking or the surface of swimming pools. This covenant is intended to insure continued compliance with the stormwater permit issued by the State of North Carolina. The covenant may not be changed or deleted without the consent of the State. 2. No one may fill in, pipe, or alter any roadside swale except cis necessary to provide a minimum driveway crossing. NOTE: If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot number, size, and the allowable built -upon area for each lot. For commercial projects that have outparcels or future development the following statements must also be recorded. 3. The connection from the outparcel or future area into the stormwater system must be made into the forebay such that short -circulating of the system does not occur. 4. The original submittal to you included two engineering plans as follows. Site Plan - Sheet C101, Dated Oct 22 1998, revised 11/25/98, (1"=60') and Pond Details - Sheet C104, Dated Nov 25 1998, revised 11/25/98. Please note that the information on that submittal is contained in the newer set of Site Plans. The improvements previously shown on the 60' scale Sheet C101 are now detailed on the new 60 scale site plans and on the enlarged 30' scale site plans. The Pond Details are unchanged and shown on sheet C105. The revisions to plans have been made as the construction documents have been prepared. February 15, 1999 Page 2 The revisions to the plans that pertain to the stormwater permit application submittal are addressed below. Clarifications to grades and elevations are included in this set. The plans do include a slight modification to the pond to better accommodate grading for the swales. The calculations have been revised to reflect the pond volumes. The responses to your inquires are as follows. The descriptions are made in the order you presented them. 1. The draw down equation has been revised to reflect the an Average Head of H/2 in lieu of the Center of Pressure, H/3. The resulting revision yielded flow equal to previous of 0.0339 cfs. The draw down time is now 4.60 days in lieu of 4.67 days 2. Presently, the application does not need to be revised to reflects off -site drainage. Since that time of our original application submittal, the adjacent property has been developed. It is apparent that the landowner of the property has provided for proper management of the stormwater flows. The adjacent property has a stormwater management system constructed on the property. The flows are collected into a pond and then directed to the existing drainage easement below their property. The flows are diverted across the higher side of the CP&L property along the existing drainage easement, and continue to the south corner of the CP&L site where they leave the property. Their flows do not enter onto the developed portion of the site, nor enter the pond. Adverse impact to our stormwater management system is not apparent. The result to our application is that the drainage area of the site has been revised along the shared property line, resulting in a reduction of drainage area to 8.43 acres. The application has been reviewed as requested and no changes are required to address upstream impervious surfaces. The pond design was not affected by the decrease in off - site area. The required temporary storage volume determination was relatively unchanged as the percent impervious of the drainage area went up as the area went down, resulting in negligible change. I respectfully do not concur in any event that you were indicating the CP & L developer would have had full responsibility to treat the runoff from this upstream development in this industrial park, especially even at an arbitrary impervious rate of 90%. In addition, please note that the CP&L site is a permitted use in the industrial park and the substantial construction of the building, parking areas, and Laydown yards is approximately only 36.6%, not the 90% that you suggest. Your request to revise our submittal to treat future unknown, undefined, impervious areas is not considered applicable to this application. As stated in the regulations, section 1007.1.1b.ii, "control systems must be designed to control runoff from all surfaces generated by one inch of rainfall'. The definitions go onto to define Built -Upon Area as ".. project that is covered by impervious..". On page 2 of 4 of the application footnotes a definition of impervious area is ".. area defined as the built upon area.." . In the DENR Best Management Practices Guidelines dated 11/98, Chpt 1 Setion 11,1.c states ".. Impervious levels used for sizing sizing should be those that are expected in the final build -out of the development, and any off -site runoff that drains to the pond." Our previous design included treatment of the impervious surfaces on the site and the off -site runoff onto our site and, in my opinion, was in compliance with the regulations. The S',W15�81 021599ph_Ilr to NCOENR rev3 doc NO* MCIM & CREED February 15, 1999 Page 3 regulations do not require that a development such as this one is required to provide treatment for some future, unknown, undefined sources. In addition, there is the Attachment A form which has suggested Deed Restriction Requirements. This form is intended to be used on Low Density developments which involve the subdivision or selling of lots or outparcels. This form has statements that are to be included in deeds which include the requirement that future drainage must be directed to the permitted stormwater system. This project is not intending to subdivide or developing outparcels. Therefore this does not enter into our review either. 3. The dimensions of the Laydown yard have been provided on the Site Plan, Sheet C101, and just to check, the dimensions are the same as those presented in the design calculations, 205 ft. by 484 ft. The forebay dimensions have been added on the Grading and Drainage Sheet 2, Sheet C104. Based on your clarification, the values of the defined permanent pool elevations, and the volume of the forebay above the permanent pool, have been revisited. Surface area adjusted from 8,390 sf. To 8446 sf. Required with 12,388 sf. Provided. The volume of the forebay is 20.5 % of the total pond, as required. This value has been revised on the supplement form. 4. The revised plans C101,C102, C103 and C104 have dashed contours as requested. 5. The Gravel Storage Area completely covers the Laydown Yard. There are plan notes indicating the general limits. (see note 3 with regard to dimensioned area). 6. The 30 scale plans, C103 and C104, have spot dimensions for grading. General contours are also shown on C102. 7. Per request, the Vicinity Map includes labels for Sunnyvale road and Raleigh Street. Please see Sheets C101 and C102. 8. Catchbasin and piping elevations are shown on Sheets C103 and C104. 9. Lot 23A-R does not drain onto the site. A drainage ditch on their property and in the drainage easement conveys their runoff around the site. The drainage area boundary accurately reflects this drainage divide. See Sheet C101, C102, and C103. 10. The actual area to base the pond design on is 8.43 acres, not 12.78 acres. (Please see response to item 2.) No changes are needed of the plans except to show the drainage area smaller as described above in item 2. The pond calculations have been revisited. The project site is located approximately 1,000 feet west of US Highway 421, approximately 19 mile south of the intersection of Highway 421 (Carolina Beach Road), and SR 1101 (Shipyard Boulevard). Drainage considerations are to be in accordance with DENR Stormwater Requirements. The purpose of this project is to construct an office and storage facility for Carolina Power and Light Company operations. Existing Site Site topography in the area is relatively flat, sloping from north to south approximately 15 feet in 400 feet, or approximately 4%. Vegetation on the site consists primarily of grasses and minor ground cover, with scrub pines and a few larger pines and hardwoods, primarily oaks. Subsurface soils are primarily sands. The soil survey of New Hanover County classifies soils on the project site as Lynn Haven, Bay Meade Fine Sands, and Leon Sands. All soils are well drained, and of hydrologic soil groups A or B. 3. Proposed Improvemcnts Improvements proposed for the site include construction of a building approximately 12,170 square feet, parking and driveways totaling approximately 45,600 square feet, and a large gravel storage area and lay -down yard for material storage of approximately 2.28 acres. The total impervious area proposed for the site is approximately 159,230 square feet, or 3.66 acres. The percent impervious cover on the site is approximately 36.6% of the 9.98 acres. 4. Stormwater Treatment Considerations All Stormwater collected on the site through catch basins or yard inlets will be conveyed to a wet detention pond located in the southeast corner of the project site. The wet detention pond will provide enhanced treatment of the stormwater, and will comply with all parameters of stormwater treatment, as documented in the following calculations. There are two options which are available to you as a result of this disapproval. Side slopes will not be accepted if proposed steeper than 2 horizontal to 1 vertical, unless adequate soil information is provided that will indicate that a steeper slope can be successfully stabilized with vegetation, and ditch velocity calculations that prove erosion will not occur during the bare earth exposure within the bottom of the ditch. 2. The "V" shape ditch appears to be ill conceived considering the ditch lengths and the proposal to use them as sediment storage. A trapezoidal shape is probably necessary; however, if you can provide ditch velocity calculations that support your proposal, we will accept them. Otherwise, we request that you reconsider the shape of the ditch. 3. • The sediment storage proposal uses unacceptable assumptions. To divide sediment storage in half and assume a six month storage capacity assumes uniform rainfalls throughout the year. The past six month rainfalls have demonstrated that is obviously not the case. Sediment storage must be based on a minimum volume of 1800 cubic feet per acre and include a drainage area not to exceed 5 acres (see the "Erosion and Sediment Control Planning and Design Manual" Section 6.60). Redesign your sediment storage areas accordingly. 4. Your grassing rates, both temporary and permanent , are inadequate to ensure establishment of vegetative cover. Again, review the "Planning and Design Manual" and reconsider your seed application rates. We suggest that you consider a seeding mixture using a variety of grasses for your permanent vegetative cover. 5. The plan must clearly delineate your proposed limits of grading.
