TRACY DAVIS Director Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for issuance of the permit. On November 1, 2017, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) inspected Wallace Conner Outparcels, located at Courtesy Towne Square Shopping Center in Carteret County to determine the status of compliance with the State Stormwater Management Permit Number SW8 980716 modified on March 16, 2010 . DEMLR file review and site inspection revealed that the site is in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the Findings of the recent inspection. Please be reminded that it is your responsibility as the permittee of record to submit a completed and signed Permit "Transfer Application Form to the Division of Energy, Mineral and Land Resources 30-60 calendar days prior to making any of the below listed changes. This form is available on our website at: a. An ownership change including the sale or conveyance of the permitted project area in whole or in part. This does not include the conveyance of subdivided residential lots to individuals which are made subject to a recorded declaration of covenants and restrictions which contain the statements required by the stormwater permit; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Foreclosure proceedings; d. On April 30, 2010, David Cox and Chris Baker of the Wilmington Regional Office inspected the site and observed land disturbance and impervious surfaces installed on the subject development site known as Wallace J. Conner Parcels (SW8 980716) located at Hwy 70, Carteret County, North Carolina. Specifically DWQ observed the following: • A Bojangles Restaurant constructed on Parcel 2. • The Bojangles Restaurant is open for business. • According to the Carteret County GIS Site, the site was constructed in 2001. A review of DWQ files confirmed that a State Stormwater Management Permit has not been issued prior to construction of impervious surfaces at the subject site as described above. As a result of the site inspection and file review, the following violations are noted: I. Failure to Obtain an Offsite State Stormwater Management Permit Title 15A NCAC 2H .1003, in accordance with G.S. 143-214.7, requires a State Stormwater Management Permit for development activities within the 20 coastal counties that require a Coastal Area Management Act (CAMA) Major Permit or an Erosion and Sedimentation Control Plan: The inspection and DWQ file review confirms that a State Stormwater Management Permt was not obtained prior to construction of impervious surfaces at the subject site as described above. The inspection was performed to determine the status of compliance with Stormwater Permit Number SW8 980716, issued to you on May 27, 2003. The project has been found in violation of Stormwater Permit Number SW8 980716MOD, issued pursuant to the requirements of 15A NCAC 21-1.1000. The violations found are: 1. Failure to maintain stormwater facility. A field inspection revealed that the stormwater pond has not been maintained per the requirements of the stormwater permit. The swale conveyance shown for outparcel #5 has filled in by sediment accumulation. The stormwater pond and forebay have sediment accumulation in excess of allowable permit conditions. Stormwater pond side slopes are showing signs of erosion in some areas. Vegetation along the pond side slopes is overgrown. Permit conditions state: The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: f a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 2. Failure to build according plan. A field inspection and file review revealed that the property was not built according to the approved plans. Outparcels #2 and #3 have been developed but were never permitted and the built upon area is unaccounted for on the master permit. The master permit does not reflect the existing site conditions. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon is directed into the permitted system. Permit conditions require tyat the permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans. To correct these violations you must: Reestablish the swale for outparcel #5 conveyance. 2. Remove/clean out the excessive sedimentation in the stormwater pond forebay and main body to the original pond bottom elevation. 3. Stabilize pond side slopes in the areas showing signs of erosion. Mow overgrown vegetation to a maximum height of 6 inches. Modify the master stormwater permit, SW8980716MOD, to reflect the development of parcels #2 & #3. Be sure to accurately depict the built -upon -area (BUA) and stormwater conveyances for each parcel. 6. Upon completion of the modification provide an updated Designer's Certification for the stormwater system. 7. Provide a written "Plan of Action" which outlines the actions you will take to correct the violations and a time frame for completion of those actions, on or before April 3, 2010. Failure to provide the "Plan of Action" by April 3, 2010, or to correct the violations by the date designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of enforcement action which may include recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A. By copy of this letter to the Town of Newport Building Inspector, this Office is requesting that the Building Inspector consider withholding building permits and Certificates of Occupancy for this project until this matter is satisfactorily resolved. Vegetated slopes are no steeper than 3:1. 9. The inlets are located per the approved plans and do not cause short- circuiting of the system. 10. The permitted amounts of surface area and/or volume have been provided. 11. Required drawdown devices are correctly sized per the approved plans. 12. All required design depths are provided. 13.
