ANNUAL MEETING OF THE NORTHWEST BUSINESS PARK OWNERS' ASSOCIATION
The annual meeting was called to order at 10:00 am. It was determined that a quorum was present with
owner Royce Bennett (Lot9), Matt Ray (Lot3) and George Ansell and Charles Morris (Lott). Proxies were
received from the following owners:
Payne Umstead Properties LLC (Lot 4)
WAS Ventures II, LLC (Lot 5)
The agenda was approved and the minutes of the last meeting were read. Matt Ray reported that the
ponds were continuing to be maintained by RPS Environmental. There were no issues at present but we
may need to have some tress removed in the future.
It was voted upon that Royce Bennett would remain as President and Matt Ray would remain as Vice
President of the association.
Under new business it was reported that three owners have not paid the annual dues. These owners
are:
Children's Castle (Lot 6, 7, & 14)- $4500.00 (2016-2019 dues)
Abbeystone Partners (Lot 10)- $400.00 (2019 dues)
MCRT3 Jacksonville LLC (Lots 11, 12, 13)- $1200.00 (2019 dues)
Matt Ray will call Abbeystone and MCRT3 Jacksonville LLC to remind them about the dues. Royce made
a motion for our attorney, Dewey Edwards, to write a letter/file lien on Children's Castle in an attempt
to collect their dues. The motion was seconded by Matt Ray.
It was also discussed that at the 2020 annual meeting we would evaluate funds and reconfigure our
financial accounts.
The 2020 annual meeting was scheduled for August 12, 20202 at 10:00 am at the officed of Ray
Properties, Inc. The annual meeting was them adjourned at 10:45 am.

MP Jacksonville LLC ("Purchaser") is the Contract Purchaser of the subject business park, LOT 10, from Creole NC
I.I.C. The Project consists of land comprising approximately 2.04 acres, LOT 10 located the Northwest Business
Park, Jacksonville, NC ("Property"); the Purchaser has filed plans with the City of Jacksonville to construct an 85-
room hotel on the Property.
As you are aware, LOT 10, Property stormwater discharge capacity is allocated for Pond A; see attached permit
documentation. Furthermore, LOT 10, Property site plan is currently designed to be less than the maximum 85%
impervious coverage of the Property.
In the course of site plan review by Tidewater Associates, Inc. and the City of Jacksonville, it has come to our
attention that your Stormwater Permit, above, has expired as of June 26, 2021, see attached. This
correspondence requests that you take immediate steps to renew the subject permit and not delay any
entitlement required by Purchaser to construct the development.
Please respond to this correspondence immediately upon receipt and advise current Owner,
Creole NC LLC and Purchaser that necessary steps are underway to extend this permit for an additional 10 years.

The original June 1997 permit did limit each lot to 85% and did require the recordation of a deed restriction to
that effect. The renewed permit dated May 21, 2009, did not contain the deed restriction statements, which
was an error that Kelly corrected via letter on August 2, 2011. All of the required permit deed restriction
statements are now in the recorded deed restrictions.
As we discussed, the permittee is responsible for making sure that the lots do not exceed the 85% BUA limit
and that all the drainage is directed into the permitted stormwater system. He should provide documentation of
these items for all of the sold lots that are built on that do not currently hold an offsite permit from us. The
permittee should provide copies of the plans for all of the lots that he/she leased in order to approve them as
plan revisions. If he can't or won't, I would recommend that we offer an alternative - the permittee can amend
the permit and the deed restrictions to require each lot owner or lessee to submit for an offsite permit.

I'm working on an inspection for Northwest Business Park and compile the offsite permits. I have not found permits for
2 of the developed lots. I noticed in the file that in 2001, you had requested an offsite permit for Just Sofas (now NAPA
auto parts). I can find anything in BIMS showing they ever submitted an app. I know it's asking a lot, but do you
remember what the outcome of that request was? (it's amazing what you do remember) I don't see any indication in
the file of the outcome and am just wondering what to do now...
