Attached you will find information regarding the Brewster Place Annual Meeting held November 15, 2018.
Thank you to everyone who was able to attend! Annual Meeting minutes will be posted to the I-IOA website under
documents once they are provided to A113.

Please be reminded that the quarterly assessment have increased effective January 1, 2019.
They will be: $65.00 per quarter (January I, April 1, July 1, & October 1)
Payments are DUE on the 1" day of the I" month of each quarter,
and are considered LATE if not paid by the 15" day of the quarter.

• Please do NOT park on the Street; only park in driveways! Parking on the grass is also not
permitted. It can become a safety issue for emergency vehicle. Chilmark Court, Wellflect Court, most
of West Chop Way, Brewster Lane and Tisbury Lane up to Marquette, are all DOT roads and you can
be towed at the vehicle owner's expense— please call the Sheriff Department at 910-798-4200 should
parking become an issue.

• Reminder : should you want to modify the exterior of your home, please log on to ,vww.aib-hoa.com
and download the ACC forms or feel free to contact the AIB off ice. Exterior changes or work cannot
start until your ACC forms have been approved. This includes fences and painting! Failure to comply
will result in a hearing and automatic tines.
• Owners who have fences along the conservation area, please maintain your fence by keeping vegetation
off of it. If a ditch runs behind your home, please make sure you keep it clean from debris. If you have a
ditch that runs through your property, please keep it free of debris. This is enforced by the county,
and the county may me owners in nun -compliance.
• DO NOT ALLOW LAWN CLIPPINGS. LEAVES OR PINE, STRAW TO 131-OCK DRAINAGE
GRATES! If you see a blocked drainage grate, please take a moment of your time to clear any debris;
blocked drainage grates in the community can negatively impact many properties.
• If you still have hurricane related debris, the HOA recommends contacting your trash company. We
have been advised that many (rash companies offer landscaping debris clean up for a small additional
cost. ['lease do not put any landscaping or trash/debris on any common areas.
• The HOA Board of Directors and ownership at the annual meeting were in agreement that all exterior
repairs due to hurricane damage must be completed by April 15, 2019. Now that we are past this dale,
A113 will be continuing regular covenants enforcement, and violation notices will be sent to any
properties found to not be in compliance. Should you need to request an extension, please submit this
request in writing through the www.aib-hoa.com website (if you received a violation notice, please
reply directly to the notice by logging in, then selecting "Account Info" then "violations").

All applications are missing the street address in Section B.
Number 4: the 0 & M agreement on the Avenir and Seaview Projects need to be initialed. That question is just asking
whether the permittee already has a copy of the Operation and Maintenance agreement or if they are requesting one to
be sent to them. Operation and Maintenance is the agreement on taking care of the stormwater control measure.
Both Brewster place applications Section C's are not initialed. Please have these initialed.
Also, I will need meeting minutes from all HOAs listing the positions of the signing officials.

Good morning,
Yes, the plans are always kept on file here at DEQ once approved, and designer certifications are suppose to be sent to
the correct Regional Office as well once construction is complete. Often times, we see sites completed and engineers
will go out and certify the site, but a copy of that certification will never make it to our office for our files.
This project, SW8 060806 does have the certification on file, so Section C.5 the box can be checked stating that a
certification has already been provided to the Division. For the other projects, they also should have been submitted
within 30 days of site completion but I would have to check through those files to be sure.

State stormwater permits are required by 15A NCAC 02H. 1045 (3) to be renewed by the current permit holder, Sea
View Townhomes Owners Association, Inc. Per the rules previously mentioned, only a president or vice-president may
sign the application. I have attached a request for additional information that was previously sent to the email listed on
the application for your reference. Also, all information in each Section of the application needs to be completed.
Please let me know if you have additional questions, or concerns.
Also, are we only discussing SW8 060806: Sea View Townhomes? There were multiple applications from various
homeowners' associations I have been waiting for that I believe are managed by the same company. Brewster Place
(SW8 990732 and SW8 960704) and Avenir (SW8 020406). 1 understand that these HOAs are overseen by management
groups, however it is the HOAs responsibility and President/VP that must sign and initial the permit applications.

I have heard your voicemail and decided to give you some information on the additional information requested
regarding the four (4) state stormwater permits and the applications I have received from Dawn.
Per 15NCAC.02H. 1045(3) state stormwater permits must be renewed every 8 years and renewal applications are due
180 days prior to their expiration date. As also noted, state stormwater permits are required to be renewed by the
current permit holder. Renewal applications must be completed, notarized and signed by a president or vice-president
of the current permittee. I have attached the 4 additional information requests that were sent to Ms. Gual via email
back in October. I believe the main issue with the applications were signature authority. These permits are issued to the
HOA's of each development, therefore only the president or vice-president of each HOA has the authority to sign for the
permit renewal. This also requires submission of official documentation, or "meeting minutes" like I see from many
HOA's that lists the that individual and their position on the HOA committee.
State Stormwater Permit #SW8960704: Brewster Place and #SW8990732: Brewster Place Phase II are both permitted to
Brewster Place Homeowners Association. Permit #SW8020406: Avenir is permitted to Avenir Community Association
Inc., and permit #SW8060806: Sea View is permitted to Sea View Townhome Owners Association Inc. Please submit the
above requested additional information for each permit or a new renewal application form listing the correct
information on each application to be mailed into our Wilmington Regional Office.
I hope this clarifies what is needed to renew the 4 listed state stormwater permits. I tried to give you as much
information as I could through email. I should be in the office Thursday 12/30/2021 and Monday 1/3/2021 if you would
like to discuss further. Thanks for helping Ms. Gual with this and working to get these stormwater permits renewed and
back into an active status.

Effective August 1, 2013 the State Stormwater program has been transferred Gom the Division of Water Quality
(DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will
remain in older stormwater permits issued prior to August 1, 2013 until they are modified, transferred, or

As we discussed on the phone, Brewster Place Phase 11 is still in your name. However my research of both the
Phase I and Phase II files revealed that a transfer application was sent in to this office with just SW8 960704
listed on the application but all of the information and requirements to transfer both permits (960704 & 990732)
was included with the transfer application. That information included PE Certifications for ponds under both
permits, Recorded Deeds showing the I-IOA owned the common areas, Recorded Covenants and amendments
for both phases that matched permit requirements, HOA signed O & M agreements and letters from you
showing maintenance had been completed per past inspections. An inspector from this office, David Cox, also
had performed an inspection and found the entire site in compliance.
So my question to you is, "Was it your intent to transfer both permits with this transfer application?" If this was
your intent then we can make a correction and send a letter to you and the HOA that both permits were
transferred in 2009 with your July 2007 transfer application request.
If this was NOT your intent, then I will need a new transfer application submitted by you for SW8 990732. The

extension to the expiration date of every permit that was in effect between January 12008 and

Per our phone conversation today:
SW8 960704 was last renewed July 6, 2009. The last expiration date in our correspondence was
September 12, 2016. Since this permit was renewed and active when the governor gave 4 extra
years to all permittees this permit now expires September 12, 2020. This permit was the first
phase of construction for Brewster Place and has 2 ponds associated with this permit that must be
maintained.
SW 990732 was modified on November 12, 2003. The expiration date in the modification
correspondence was November 12, 2013. Because this permit was active when the governor gave 4
extra years in 2010 Et 2011 this permit received 4 extra years and now expires November 12, 2017.
This permit also has 2 ponds associated with it that must be maintained.
Renewal Applications must be forwarded to our office 180 days prior to expiration.
The website for the renewal application is: http://deg.nc.gov/about/divisions/energy-minerat-
ta nd - resources/ energy- mineral - land - rules/ stormwater- program/ post -construction Scroll down to
the Renewal application SWU-102. This can be filled out by your company, but must be signed by
the permittee (1-10A), unless the HOA (permittee of record) gives us a legal document saying that
you can sign for them. A check for $505.00 must be sent with the permit renewal
application. When filling out the renewal you will notice other questions that pertain to the
renewal. The PE certifications for these permits have already been received and are in our files so
you do not have to send those.
If you need information or copies of the pond drawings you can request a file review of the permit
file and schedule an appointment to make copies of our documents. For a File Review appointment
call Cameron Weaver at 910-796-7303. Large Plan Drawings must be taken to Always graphics or
any print shop to make copies. The permittee will have to pay for those copies.
If the president of the HOA changes, or if you are their representative and are to receive future
correspondence for the HOA then the HOA must notify us. I have attached an address change
document for the HOA and your convenience. Please fill this out with reps and addresses where you
want future correspondence to be sent.

Jan- Here's a copy of the permit. Good news, the permit's expiration date was extended to Sept. 12,
2020, so that's one concern out of the way for now.
