State Permit # 121-15 was originally issued on October 26, 2015, for the construction of an offshore living sill, rip rap placement and marine mattress stabilization adjacent to the Cape Fear River at Fort Anderson, near Winnabow, Brunswick County. State Permit No. 121-15 was modified on May 1, 2017 authorizing the reconfiguration of 200 linear feet of offshore living sill, the construction of a rip rap revetment and relocation of 50 linear feet of marina mattress. Another modification was issued on May 21, 2018 for additional reconfiguration of the permitted sills. State Permit 121-15 was refined on June 14, 2021 to allow for the change in alignment of "Reef -maker" structures in Phase 3B, and again on May 18 2022, to clarify the placement of the last section of "Reef -maker" in Phased 3B. As the project was divided into phases, Phase 1, 2, 3A have been completed, with phases 3B and 4 currently underway. State Permit # 121- 15 is due to expire on December 31, 2022. The current request is to modify a section of structure that contains gaps for aquatic life protections in Phase 3B to address instability in three of the existing piles, and modify the alignment of the last two sections of "Reef -Maker' Structures of Phase 4, as described in your accompanying letter of refinement request and 4 drawings (Original Phase 3B Terminus, Fish Gap Protection Detail C-1, Original Phase 4 Terminus, Revised Phase 4 Plan View Sheet 5 of 12, all dated as received by DCM 10/27/22). The permit holder is seeking to partially modify the authorized alignment of "Reef -Makers" in Phase 3B, to address erosion at three existing structures identified at station 12+66. This request would be to move three unstable pilings waterward approximately 15 ft. to a proposed angled alignment alongside the outer row of existing reef makers at station 12+63, in an effort to minimize further erosion and maintain a large fish gap. Also, the permit holder is seeking the modified alignment for Phase 4 terminus due to a change order between NCDNCR and North State Environmental due to funding which allows for additional shoreline protection with 5 additional piles. The proposed modified alignment from station 15+ 52 to station 16+38 is consistent the rest of the permitted structure with placement along the -5' MLW contour. In the future if acquisition of further funding allows for future phases, the permit holder will seek additional future permit minor and or major modifications to continue the shoreline protection further south. Upon review of the information provided, the Division of Coastal Management has determined that the proposed action continues to be consistent with existing State regulations and is in keeping with the original purpose and intent of the permit. This request combines the previously refinement requests dated October 12, 2022 and October 26, 2022. The original CAMA permit issued to NCDNCR on 10/26/2015 for shoreline stabilization at Brunswick Town/ Fort Anderson State Historic Site (BTFA). The property is located at 8884 St Philip's Rd SE Winnabow, North Carolina. The property is adjacent to the Cape River in Brunswick County. Project implementation has occurred in a phased approach as shoreline protection has been dependent upon the funding availability. Permit History Permit #121-15 was renewed on 12/10/2020 with an expiration date of 12/31/2022. There have been several refinements/ modifications related to the NCDNCR's efforts to stabilize the shoreline at BTFA. These refinements/ modifications include May 1, 20217, May 21, 2018, June 14, 2021 and May 18, 2022, Current Request This request can be divided into two parts: 1) an alignment change related to the outer fish gap protection associated with Phase 3B and 2) an alignment change related to the Phase 4 terminus at its southern terminus. Phase 3B alignment change The current request for a refinement involves outer 'fish gap' structure located in Section 3B. During construction of Phase 4 and after the Hurricane lan storm event, the construction crew noted instability for three (3) of the piles and associated ecodisks on 104.4' section on the upper river side in associated with the outer fish gap structure. Out of concern for future long-term stability, we propose to move these three piles and associated ecodisks from this portion of the alignment, and add them to the upper river side of the outer fish gap structure. With this movement, the fish gap itself would be wider, and the outer fish gap structure would be extended from eight (8) piles with associated ecodisks to eleven (11) with associated ecodisks. The change in the alignment for the three piles and associated disks is noted in blue, and moved the piles and disks are noted in red. I have also attached the original alignment. Phase 4 alignment change The current request for a refinement involves the last several structures of Reefmaker that were previously refined for Phase 4 on May 18, 2022. This refinement involves an updated placement plan for the Reefmaker structures. This updated design plan resulted from a change order between NCDNCR and North State Environmental, and this change order enabled NCDNCR to have additional shoreline protection at BTFA in the form. With these five additional piles, as a result of the change order, the design engineer re -aligned 7 piles of the structure in Phase 4 at the down -river structure of the permitted area to continue along the -5' contour. This updated design alignment maximizes shoreline protection at the down river portion of the project. The length, and therefore the number of piles, of tie-in structure is reduced from the previous alignment (from 7 to 5 piles) as the tie-in is positioned to dissipate wave energy flowing parallel to the shoreline as this alignment. An updated plan view for this refinement is attached, and this plan view is sealed with a date of September 2, 2022. The change in the alignment is noted in blue. I have also attached the original alignment. Additional information There have not been any changes to the ownership of the adjacent properties. The project is in compliance with all conditions of the current permit.
