Brunswick County, NC. The tract is 5.23 acres in size. The project employs the use of an existing
stormwater pond, and two infiltration basins added to intercept runoff from a recent building/parking

have been resolved, the Professional Engineer's Certification has been received, and the project has been
determined to be in compliance with the Stormwater Certification issued on February 5, 1992.

Dear Mr. Causey:
I found the Engineer's Certification for the project, but I will be checking for the completion of
the items associated with the vegetated filter, the rip rap, and the pavement coverage discrepancies (no
revised plans dealing with the deleted planted islands have been submitted). I believe the additional paved
area created by deleting the planted islands can be accounted for in the submittal of plans for the next
phase. While the pond has been sized for all phases, any changes or deviations from the originally
approved plans must be submitted for review and approval. The deletion of the planted islands is
considered a deviation from the original.
I am planning a trip to Brunswick County on Monday, January 23, 1995. I will follow up on the
remaining items at that time, and forward any concerns, or if all is well, I will forward the Compliance
Status.

In reference to your engineer's request for clarification of the assumption that the church is not
in violation of the Certification because the sum total of the impervious surfaces currently constructed
is less than 1 acre. After discussion with our Central Office personnel, we present the following facts:
The church was required to submit a plan for review that included all phases of the project.
The project was clearly a phased project, and as such, this Office had the right to request
that all future development be shown and accounted for.
2. The plan was reviewed and approved as a detention pond submittal, not as a request for
less than 1 acre of built -upon area.
It was decided that since a pond has been constructed, regardless of the fact that less than 1 acre
of built -upon area was constructed as the first phase, the pond must be maintained in accordance with
the Certification. It is specified in 15A NCAC 211.1003(k) that development must be maintained
consistent with the requirements in the approved O & M plan.
The church must be considered in violation until the items listed in the October 7, 1994 Notice
of Violation have been satisfactorily addressed.

On July 1, 1994, Wilmington Regional Office personnel performed a Compliance Inspection of the
project known as Seaside United Methodist Church, located Highway 904 in Seaside in Brunswick County,
North Carolina. The inspection was performed as a follow-up to the March 22, 1994 Notice of Violation
and to determine the current status of compliance with Stormwater Certification Number 910805, issued
to Mr. Paul Justice on February 5, 1992.
The project has been found in violation of Stormwater Certification Number 910805, issued
pursuant to the requirements of 15A NCAC 2H.1003(i). The violations found are:
1. Failure to submit the required Engineer's Certification within 30 days of completion of pond
construction.
2. No trash rack for the outlet structure.
3. Discrepancies between the approved plan pavement layout and the as -built condition.
4. The vegetative filter was observed to be in a very eroded and bare state.
S. The rip rap has been placed in selected spots only, and does not act as a permanent bank
stabilizer.

To correct these violations you must :
Provide a written "Plan of Action" which outlines the actions you will take to correct the
violations and a time frame for completion of those actions, on or before November 7, 1994.
2. Submit the Professional Engineer's Certification, verifying pond construction in accordance
with the approved plans.
3. Add the trash rack to the outlet structure pursuant to the approved stormwater plans.
4. Repair the vegetated filter by regrading and establishing a dense vegetative cover.
5. Add rip rap to all slopes which are shown to be greater than 3:1, of sufficient depth to
provide pemanent stabilization.
On March 22, 1994, a Notice of Violation was issued to Mr. Kenneth Bridgers for all of these
items, except 114. A "Plan of Action" was received on April 14, 1994, signed by you, indicating that an
as -built survey had been conducted, that the side slopes would be permanently stabilized with rip rap, and
that the trash racks were in the process of being prepared and would be installed "in the near future".
Failure to provide the "Plan of Action" or to correct the violations by the date designated in the
"Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of
enforcement action which may include recommendations for the assessment of civil and criminal penalties,
pursuant to NCGS 143-215.6A.
By copy of this letter to the Brunswick County Building Inspector, this Office is requesting that the
Building Inspector consider withholding building permits and Certificates of Occupancy for this project
until this matter is satisfactorily resolved. It was noted during the inspection that clearing of the adjacent
parcel had begun, apparently in hopes of constructing the next phase of the project. Please be aware that
failure to correct these violations may delay construction/occupancy of your new building.

On February 5, 1992, a Certification of Compliance with Stormwater Regulations, Number
910805, was issued to Mr. Paul Justice for Seaside United Methodist Church, located in Seaside, N.C..
As stated in the Certification of Compliance:
A professional engineer must certify that the stormwater system has been installed
in accordance with the approved plans and specifications upon completion of
construction.
On August 30, 1993, Regional Office Staff conducted a compliance inspection of the project's
stormwater facilities and found construction completed and the facility occupied. A Compliance Inspection
Report was sent to Mr. Paul Justice on September 3, 1993. Please find attached a copy of that completed
report which summarizes the findings of the inspection. Our records indicate that the required
Professional Engineer's Certification has not been received. The Certification has been requested on
December 18, 1992, July 26, 1993 and September 3, 1993. Additionally, the following conditions were
observed during the inspection and are in violation of the Certification:
1. The side slopes of the pond appear steeper than 3:1 as required, especially from the edge
of the parking lot. Those slopes must be stabilized with permanent measures, or cut back
to 3:1.
2. Please provide the trashrack as required on the approved plans.

3. There are a few minor discrepancies between the approved plan and the actual construction
which must be addressed through a revised plan. Several landscaped islands have been
deleted, and curbing has been added to the rear of the parking lot.
Operation of the stormwater system prior to submission of the required certification and the above
conditions are violations of 15A NCAC 2H.1003 and are subject to enforcement action pursuant to NCGS
143-215.6A including the assessment of civil and criminal penalties.
Failure to provide the required Engineer's Certification and a "plan of action" which designates
the date by which the above items will be permanently resolved, prior to April 22, 1994, will result in
the initiation of appropriate enforcement action by this Office. That action may include recommendations
for the assessment of penalties and/or revocation of the Certification.

I am in receipt of your letter of March 22, 1994 to Mr. Kenneth
Bridges in regards to the Stormwater Project for Seaside United
Methodist Church. Mr. Bridges is no longer a member of the Board
of Trustees and, as a new member of the Trustees, my assignment
is to resolve and perfect our Stormwater Project.
I have had a discussion with Mr. Dave Atkins and Mr. Larry
Sneeden, the Design Engineer. Please be advised of the follow-
ing:
1. Mr. Rick Thompkins, a Registered Surveyor, has prepared a
survey of what is on site as of April 4, 1994. This survey
has been forwarded to Mr. Sneeden for his review.
2. Mr. Atkins, of your staff, suggested that we could use rip -
rap on the side of the pond nearest to the parking lot, since
the slop is not 3:1.
3. The trash racks are being prepared and will be installed in
the near future.
The purpose of this letter is to advise you of the actions being
taken and to request that the date of April 22, 1994 for total
resolvement be extended. Please be assured that a continuous
commitment will be made until the project is completed and
accepted.

At the request of the church, we have done a preliminary
review of the construction of the stormwater control measures.
There are several deficiencies which we will be working with the
church to correct in the near future.
The stormwater control measures were designed to accomodate
the existing and future development plans for this site. The
existing developed area consists of 0.94 acres of impervious area
which is 18 percent of the total site. It is my understanding
that this coverage is less than the 1.0 acre impervious / 30%
coverage limits in the regulations and would therefore be exempt
from stormwater management requirements at this time.
If my interpretation of the regulations is correct and the
church is in fact in compliance at this time, please notify them
in writing so that they can ease their concerns about breaking
the law and being subject to enforcement action. They have
assured me they they will diligently pursue remedying the
deficiencies in the stormwater retention system.

or cut them back to 3:1.
2. Please provide the expanded metal trashrack over 3 of the knock -out panels on the outlet
structure as required by the approved plan.
3. The inspection revealed a few minor discrepancies between the approved plan and the
actual construction, most notably, the deletion of the landscaped islands along the back
parking lot edge, and the addition of concrete curbing to direct runoff into the catch basin.
This has essentially negated the need for the baffle and the rip rap swale. A revised plan
showing these revisions should be received.
4. This Office has asked for the Engineer's Certification on December 18, 1992 and July 26,
1993. Each time, this Office was assured that the certification would be shortly
forthcoming. Please complete and return the attached Certification when the above items
have been satisfactorily addressed.

This Certification is pursuant to the revised application
for Seaside United Methodist Church received on August 9, 1991,
with additional information received on January 30, 1992. Based
on our review of the project plans and specifications, we have
determined that the stormwater control system complies with the

The runoff will be treated in a detention pond sized to achieve

This Certification shall be effective from the date of
