Subject: State Stormwater Management Permit No. SW8 910405
Permit Transfer
Port City Collision (6101 Market Street)
I1igh Density Commercial Project w/Outparcel
New Ilanover County
Dear Mr. Harrell:
On March 1, 2018, the Division of Energy, Mineral and Land Resources (DENILR) received a Permit
Transfer Application Form and $505.00 fee under NCAC 02P1.1045 for the subject project. By
acknowledging receipt of the permit, and by signing the Permit Transfer Application form and O&M
agreement, you have accepted the responsibility for complying with the terms and conditions outlined in
the attached permit. You have also agreed to waive the inspection and to address any compliance issues.
Please find attached a copy of the transfer application, the permit, and a copy of the signed Operation and
Maintenance agreement. The Division is hereby notifying you that permit SW8 910405 has been
transferred on May 1, 2018 and shall be effective from the date of issuance mail October 2, 2021.
In addition to the ownership change, this permit was updated on May 1, 2018 as follows:
The name of the project was changed from P&S Alpha to Port City Collision.
This permit was previously corrected and updated on October 2, 2013, as follows:
I . This permit is the "master" permit for the stormwater BMP which treats the runoff from the main
tract and from the outparcel approved under SW8 960504.
2. The requirement to record a deed restriction limiting the BUA on the outparcel was removed
because the outparcel has received a separate offsite permit (SW8 960504), which limits the BUA
on the outparcel to a maximum of 47,916 sf.
3. An expiration date (October 2, 2021) and a requirement to submit a renewal application 180 days
before the expiration date, were added to the permit.
4. The language regarding the conditions under which the permittee must provide a completed Permit
Transfer Application form was updated.
This permit is subject to the conditions and limitations as specified herein. Please pay special attention to
the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation
of deed restrictions, procedures for changing ownership, transferring the permit, and renewing the
permit. Failure to establish an adequate system for operation and maintenance of the stormwater
management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result
in future compliance problems.

Mr. Harrell:
I am reviewing the transfer application that you submitted on March 2, 2018.
Unfortunately, since the last transfer occurred to PBS Alpha, there has been a regulation change
which I failed to mention to you. The proposed permittee is now required to sign an operation and
maintenance agreement in order to transfer the permit. I have completed as much of the wet pond
design information as is available in the file. Please sign, date and notarize the attached document
and return the original signed and notarized document to me by May 7, 2018.
Thanks,
Linda

Wet Detention Pond Maintenance Requirements I
The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the vegetated filter if one
is provided.
Important maintenance procedures:
Immediately after the wet detention basin is established, the plants on the vegetated shelf and perimeter of the
basin should be watered twice weekly if needed, until the plants become established (commonly six weeks).
No portion of the wet detention pond should be fertilized after the first initial fertilization that is required to
establish the plants on the vegetated shelf.
Stable groundcover should be maintained in the drainage area to reduce the sediment load to the wet detention
basin.
If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through the
emergency drain should be minimized to the maximum extent practical.
Once a year, a dam safety expert should inspect the embankment.
After the wet detention pond is established, it should be inspected once a month and within 24 hours after every storm event
greater than 1.0 inches (or 1.5 inches if in a Coastal County). Records of operation and maintenance should be kept in a known
set location and must be available upon request.
Inspection activities shall be performed as follows. Any problems that are found shall be repaired immediately.

New Hanover Comity
Dear Mr. Harrell:
On Febmary 12, 2018, Ms. Ann Brown, former owner of the above referenced property, came by our
offices to discuss her difficulties in getting you to accept the state stormwater management permit.
According to the County 'fax Records, Port City Collision, Inc., purchased the property on or about Juh
2, 2015. It is my understanding that Ms. Brown has made several attempts since that time to contact you
via phone and/or mail regarding the paperwork that needs to be completed in order to transfer the current
stormwater management permit to fort City Collision, Inc. Please be advised that you are currently
operating a stormwater treatment system without a valid permit.
Please note that per NCAC 02I-1.1040(10), any individual or entity found to be in noncompliance with the
provisions of a stormwater management permit or the requirements of the stormwater rules shall be
subject to enforcement procedures as set forth in NCGS 143, Article 21. If the Division determines that
you are impeding Nis. Brown's ability to comply with her permit, or if you fail to provide the signed
transfer application by March 12, 2019, the Division may initiate enforcement action against you
including the assessment of civil penalties of up to $25,600 per day.
Please take a moment out of your busy schedule to sign the transfer application as the "Proposed
Permittee" and sign an Operation & Maintenance Agreement for the continued maintenance of the
permitted wet detention pond. The permit transfer application form and the supplemental 0&M TZ form
are available on the Division's website at litt sp //deq nc (,ov/about/divisions/eiier,,v-mineral-land-
resouroes/energy-m inera I-land-ru les/stormwater-prop rain/post-construction.
Upon receipt of the signed transfer application and the required documentation, a site inspection will be
scheduled. "file perntittce and the property owner will receive a copy of the inspection report outlining
any observed deficiencies. The project had been inspected in 2013 prior to Ms. Brown taking over the
permit, all(] it was in compliance at that time.
If you have any questions about the transfer process, please contact Linda Lewis at the Wilmington
Regional Office, telephone number (910) 796-7215 or via email at linda.lewis Octncdenr. ov_.
