RE: Notice of Violation of Land Disturbing Activity
Grading Permit Number: 2-1991
Site location: Market Street
Location/Description of Violation(s): New construction has
begun on a previously permitted site without submitting a
revised land disturbing plan. Whenever additional
construction is conducted on a previously permitted site, the
site work is considered phased development, and the disturbed
area is considered contiguous even if its done at different
times and even if it is less than one acre.
Dear Sir:
This letter constitutes Notice of Violation of Sections 7-18
I and J and also Section 7-21(a)(3) of the New Hanover County's
Soil Erosion and Sedimentation Control Ordinance.
Section 7-21(a)(3) states:
Any person who fails to submit an erosion control plan for
approval as required by this ordinance shall be subject to a
single noncontinuing civil penalty of not more than one
thousand dollars ($1,000). Any person who is subject to a
civil penalty under this subdivision may be subject to
additional civil penalties for violation of any other
provision of this ordinance, or rules or orders adopted or
issued pursuant to this ordinance.
Section 18 (I) states:
Applications for amendment of an erosion control plan in
written and/or graphic form may be made at any time under the
same conditions as the original application. Until such time
as said amendment is approved by the County, the land -
disturbing activity shall not proceed except in accordance
with the erosion control plan as originally approved.

Section 18 (J) states:
Any person engaged in land -disturbing activity who fails to
file a plan in accordance with the ordinance or who conducts
a land -disturbing activity except in accordance with
provisions of an approved plan shall be deemed in violation of
the ordinance.
You must take the following immediate action to restore
compliance within the specified number of days calculated from the
mailing of this correspondence:
Corrective measure(s) needed: Submit all the necessary
information to revise your original Land Disturbing Permit
within 20 days from receipt of this notice. (permit package is
enclosed).
Time to Comply: 20 days
You can contact Beth Easley, Erosion Control Specialist,
Engineering Department, 414 Chestnut Street, Wilmington, North
Carolina 28401, (910) 341-7139, regarding the required compliance
action.
Your failure to submit a revised land -disturbing plan within
20 days will result in the assessment of a civil penalty, or other
enforcement action, pursuant to Section 21 (a) of New Hanover
County's Soil Erosion and Sedimentation Control Ordinance. You are
also subject to a $1,000.00 fine for starting work without an
approved plan. If the $1,000.00 fine is not appealed to Dave
Weaver, Assistant County Manager (341-7139) within 30 days, a
demand for payment will be issued.

Dear Mr. Nunalee:
Wilmington Regional Office personnel have observed a land -disturbing activity taking place on the front
portion of your property at 6101 Market Street. The Certification of Compliance, issued to you on June 4, 1991,
for the detention pond covered up to 1.1 acres of impervious area for the future development. The development on
this tract must be submitted to DEM for review. We will check that the stormwater is routed to the pond
appropriately and make sure that the development does not exceed 1.1 acres of impervious area, thereby
compromising the pond's ability to function as designed.
Please submit 2 sets of plans, a completed permit application, $225.00 application fee, and a cover letter of
explanation prior to March 6, 1996. Construction of impervious surfaces on the tract prior to receipt of the required
permit is considered a violation of your Certification. By copy of this letter to the Building Inspector, this Office
is requesting that he consider withholding the building permits and Certificates of Occupancy for this project until
the Stormwater Management Permit is issued.

Directions to site, address: 6505 Market Street, Wilmington, NC
2. Inspection Date: Mav 7, 1993
Weather Conditions: Sunny, Hot, Temperature 85 degrees.
3. Comparison of Approved plans vs. As -Built: Compared well.
4. Maintenance Problems: None, the pond was very well maintained, and looked beautiful.
5. Comments: A trash rack per the approved plans was not installed. Past history of this site
indicates no problems with clogging, however the threat does exist. A trash rack
should be installed.
