This permit, issued on March 27, 2018 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Marina Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this manna facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the manna facility. Any sewage discharge at the marina facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Hampstead Investment Holdings, LLC Permit No. 27-18 Page 2 of 5 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 22 formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 8) The manna shall display a sign showing the location of the on -site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier. 9) The construction and/or operation of the authorized facilities shall not directly result in any closure of any waters that are open to the taking of shellfish where shellfishing is a significant use. Any such closure directly attributable to the docking facility shall require that the permittee undertake remedial actions to remedy the situation. Such actions may include, but are not limited to, a removal of any unauthorized slips or mitigative measures to reduce or eliminate the cause(s) of the closure. Excavation 10) Excavation shall not exceed -6 feet below normal low water in the access channel and -5 feet below normal low water in the basin. In no case shall the depth.of excavation exceed the depth of the connecting waters. 11) In order to protect juvenile shrimp and finfish resources, no excavation will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the North Carolina Division of Coastal Management and U.S. Army Corps of Engineers, in consultation with the appropriate resource agencies. 12) The temporary placement of double handling of fill materials within waters or vegetated wetlands is not authorized. 13) No excavation shall take place at any time outside of the alignment indicated on the attached workplan drawings. 14) All excavated materials shall be confined above normal high water level and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. Hampstead Investment Holdings, LLC Permit No. 27-18 Page 3 of 5 ADDITIONAL CONDITIONS 15) No spoil material shall be placed within 30 feet of the normal high water line. 16) The disposal area shall be properly graded and provided a ground cover sufficient to restrain erosion within 30 working days of project completion. 17) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the initiation of any dredge activities. Bulkhead 18) The alignment of the authorized, bulkhead shall not exceed a distance of two feet waterward of the existing deteriorated bulkhead. 19) The bulkhead shall be constructed prior to any backfilling activities. 20) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 21) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. 22) The fill material shall be clean and free of any pollutants except in trace quantities. Upland Development 23) Unless specifically altered herein, this permit authorizes only the land disturbing activities associated with the drystack facility and associated development, all as expressly and specifically set forth in the permit application and depicted on the attached work -plat drawings. A representative of the Division of Coastal Management (DCM) shall evaluate any additional land disturbing activities and/or construction on a case - by -case basis. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. Easement 24) Prior to construction of any new boat slips or other docking facilities under this permit, the permittee shall apply for and receive an Easement from the Department of Administration's State Property Office as required under N.C.G.S. 146-12(e). Erosion & Sedimentation Control 25) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 26) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). ADDITIONAL CONDITIONS NOTE: An Erosion and Sedimentation Control Plan will be required for this project: This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit, this plan to the Department of Environmental Quality, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. Stormwater Management 27) The Division of Energy, Mineral & Land Resources approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW8170721, which was issued on 8/25/17. Any violation of the permit approved by the DEMLR shall be considered a violation of this CAMA permit. Maintenance Clause 28). The Division of Coastal Management shall.be notified in writing at least two (2) weeks in advance of any future maintenance work, as authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. U.S. Army Corps of Engineers Conditions 29) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws. og v/nc- es/mammal/manatee guidelines.pdf. 30) Turbidity curtains shall be used during dredging. Turbidity curtains will be made of material in which listed species cannot become entangled (i.e. reinforced impermeable polycarbonate vinyl fabric (PVC)), and shall be monitored to ensure listed species are not entangled or trapped in the action area. Turbidity curtains will be removed promptly when the work is complete and the water quality in the action area has returned to background conditions. 31) The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. Hampstead Investment Holdings, LLC 1 Permit No. 27-18 Page 5 of 5 ADDITIONAL CONDITIONS 32) Approval of the structure is based on determinations that there would be no obstruction to navigation. The structure may be damaged by wave wash, from passing vessels. Issuance of this permit should not be construed, as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash. 33) The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre - project condition. General 34) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 35) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 36) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 37) No excavation or filling of any vegetated wetlands is authorized by this permit. NOTE: This facility will be a transient non -community public water system. Please contact the Division of Water Resources, Public Water Supply Section, at (910) 796-7441 before initiation of construction for sampling requirements. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned the proposed Action ID No. SAW-2015-01047. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Certification No. 4144 (DWR Project No. 2017-1604), which was issued on 1/29/18. PROJECT SUMMARY: The applicant is proposing to construct a 224-slip dry stack facility (open metal framing) and 22 slip open water marina (floating dock system) with concrete driveways and parking areas, forklift boat launch pad and retaining wall. In additional, the applicant proposes to initiate new dredging around the proposed docking system and maintenance dredge the existing entrance channel. Hampstead Investment Holdings, LLC Page 2 9. PROJECT DESCRIPTION: The project site is located at 579 Lewis Road (SR 1564), adjacent to the AIWW/ Topsail Sound, north of Hampstead, Pender County. To access the site from Wilmington, take US Hwy 17 N to Sloop Point Loop Road (SR 1563). Turn right onto Sloop Point Loop Road and travel approximately 2.7 miles to Lewis Road (SR 1564). Make a right on Lewis Road and follow it approximately 0.6 miles to the sharp right turn in the road. The project site will be located on the left hand side of the road (at the terminus), adjacent to the public boat ramp and Pecan Grove boat launch area. Currently, the site is operating as Quartermaster's ship store. The site consists of one large parcel totaling approximately 2.2 acres with roughly 316 linear feet of water frontage along the eastern shoreline, which is bulkheaded. The majority of the parcel is highground located on the northern side of Lewis Road. According to the applicant, the high ground portion of the property has an elevation of approximately 6' above Normal High Water (NHW). Most of project site is undeveloped highground, and features are limited to an existing septic system (to be abandoned and replaced), well and pump house, ship shore, bulkhead and docking facility. Vegetation on the highground portion of the lot consists primarily of lawn grasses, with several Live Oak (Quercus virginiana) and Wax Myrtle (Myrica cerifera) near the shoreline. There is a thin stand of Coastal Wetlands (predominantly Spartina alterniora, commonly known as Smooth Marsh Cordgrass) bordering the property's eastern shoreline, just waterward of the existing bulkhead. Water dependent features existing on the project site include an 8' x 76' parallel shore side dock, two shore perpendicular finger piers (1 @ 8' x 107' and 1 @ 8' x 115') and multiple mooring piles. According to the application package, current water depths adjacent to the bulkhead range from approximately +2' to -3 feet at Normal Low Water (NLW). Water depths beyond the existing finger piers taper to approximately -6' @ NLW near the edge of the existing man-made (and maintained) channel, which runs parallel to the Atlantic Intracoastal Waterway (AIWW). The existing channel intersects with the existing access channel for the Lewis Brothers Boatyard. Dredging of the Lewis Brothers boatyard channel has been previously authorized under the CAMA general and major permit process. It should be noted that a previous field investigation report (NC WRC Lewis Road Boat Access Area prepared by Holley Snider and circulated on 7/06/1 1) reported the presence of Eelgrass (Zostera marina), a type of Submerged Aquatic Vegetation (SAV), in close proximity to the proposed project area during 2011. According to Ms. Snider's field report an "SA V survey was conducted by Division of Marine Fisheries staff on April 25, 2011 (see provided survey). Eelgrass was present in sparse patches along the shoreline in areas where water depths were less than 3 feet at NLW. Patches of SAV were observed within the two southernmost boat slips. " The project site has a CAMA permit history dating back to at least 2005 (CAMA Major 440-05), with a recent scope of work being authorized in 2015 (CAMA Major Permit #98-15). Adjacent land uses include a commercial boat yard to the north, a community docking boat ramp to the south, residential development to the west and the AIWW to the east. Based on historical records, a known archaeological site, Pd 17 is located within one-half mile of the project site. The waters of the AIWW adjacent to the project site are classified as SA by the North Carolina Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish in the immediate vicinity of the project site. Hampstead Investment Holdings, LLC Page 3 PROPOSED PROJECT: The applicant is proposing to construct a 224-slip dry stack facility (open metal framing) and 22 slip open water marina (floating dock system) with concrete driveways and parking areas, forklift boat launch pad and retaining wall. In additional, the applicant proposes to initiate new dredging around the proposed docking system and maintenance dredge the existing entrance channel. The proposed upland development associated with the dry stack facility would include travel lanes and parking area (both constructed using permeable concrete and gravel according to NC State Stormwater Permit No. SW8170721, issued 8/25/17) and an "open" metal frame boat storage structure. Please refer to see Sheet C-3.1 for a schematic of the proposed upland development. Essentially, the entire site is to be graded and resurfaced as part of the construction plan. An existing septic tank, which is currently located within the AEC, would be removed and relocated outside of the AEC, as would the associated drain field. As proposed, no new additions or expansion would occur at the ship store; However, a new retaining wall, bulkhead and fork lift drop zone would be installed along the southern property line, adjacent to the existing building. Based on the attached plans, the only work to be performed within the 30' Coastal Shoreline buffer, would be those water dependent activities associated with the boat launch/landing. All other work associated with the upland dry stack facility (including driveways, parking areas, storage, sidewalks, etc.) would be at least 30' from the normal high water line. Regarding the proposed docking facility, the applicant has indicated all existing docks would be removed and replaced. The new facility would consist of a new dock spine, which would run parallel to the shoreline and would span the waterfront area immediately east of the existing ship store. The spine would measure approximately 8' x 202' and would provide access to the four (4) new floating finger piers. For simplicity and clarification, please refer to sheet 5 of 10 for a detailed layout of docking system. In short, twenty-two (22) wet slips would be created as a result of this project, incorporating approximately 4,552 sq. ft. of public trust and estuarine waters. The proposed docking facility would be located between two longer finger piers and would be outside of the existing maintained channel. Current water depths beneath the proposed floating spine range from 0 to +2' @ NLW, and depths beneath the proposed finger piers range from +2 to -3' @ NLW. In addition to the proposed floating structures, the applicant is requesting authorization to construct a new bulkhead along the southern shoreline. The new wall would extend from the southern property line toward the north, a distance roughly 118'. As designed, the proposed bulkhead would extend approximately 5' beyond the existing wall at the southern terminus and would taper back to 1.5'-2' beyond the existing wall near the northern terminus. In total, approximately 80 sq. ft. backfill would be associated with constriction of the new wall. According to the application package, no additional open water fill would occur as a result of the proposed project. Similarly, no Coastal Wetlands would be excavated or filled as a result of the proposal. The final component to the development plan would include dredging the marina basin (new) and entrance channel (maintenance). According to Sheet 1 of 10, the entire marina basin (196' x 265') would be dredged to a final depth of -6.0' @ NLW. The proposed foot print for the marina would extend from the near shore edge of the Pecan Grove boat ramp dock, north beyond the footprint of the northern most proposed finger pier, and a distance. approximately 196' offshore of the proposed bulkhead. The site plans show the western most dredge limits in close proximity to Coastal Wetlands; however, the applicant has indicated no Coastal Wetlands would be impacted as a result of the project. Existing water depths vary in the proposed boat basin, and range from +2' @ NLW to -4' @ NLW. Based on DCM's calculations, approximately 6,700 cubic yards of material would be removed as part of the boat basin excavation. In addition to the new boat basin excavation, the applicant is planning to perform maintenance excavation within the existing channel, leading from the NCWRC boat ramp to the AIWW. As proposed, and according to Sheet 4 of 10, a 50' x 535' x -6' cut would be made within the footprint of the existing channel. Current depths within the existing channel are documented in the application package at -4'to -6' @ NLW and the applicant is proposing to make the channel uniform throughout. DCM's calculations suggest the removal of approximately 1,981 cubic yards of material would result from the project, bringing the total yardage of material for the project to 8,681 cubic yards. Hampstead Investment Holdings, LLC Page 4 As designed, the dredging methodology for this project would consist of a bucket -to -barge operation. The application indicates material would be transported over the water to the future boat lift loading area. From there the material would be offloaded and transferred to the dry stack area where it would be dewatered. From there, the material would be transported (via dump truck) to a designated disposal site located at "Sparrows Bend", located along Highway 117, in Hampstead, Pender Co. Based on supporting documentation, the applicant has received a "Letter of Approval" from the NC Div. of Energy, Mineral and Land Resources (NCDEMLR), under Project No. PENDE-2017-015, allowing for the deposition of dredge spoil at the off -site facility. The letter of approval from NCDEMLR is dated July 27, 2017. The off -site tract is comprised of 68 acres; however, the applicant is limiting the deposition area to a size of roughly 500' x 500', or 250,000 sq. ft. Based on the attached spoil deposition plans, the proposed fill would not impact any wetlands or open water areas. Considering the nature of the area, bottom contours and the potential for impacts to Shellfish and SAV, because of the project, the applicant's agent performed a Shellfish and SAV survey on September 1, 2017. Sheet 6 of 10 in the application packet depicts the area where the samples were collected and where the SAV was investigated. According to the project narrative, Land Management Group (LMG) sampled an area approximately 0.69 acres in size (within the basin foot print) using a ratio of 25 square meter plots per acre. Information provided by LMG indicates 18 square meter plots were raked for the presence of SAV rhizomes along with visual inspections, and `no SAV or SAV rhizomes were identified". 10. ANTICIPATED IMPACTS The construction of the dry stack area (driveway, parking area, travel pad, frame storage area, etc.) would result in the disturbance of most of the entire project site, or approximately 85,377 sq. ft. of high ground, with roughly 2,345 sq. ft. of impact with the 75' AEC. Approximately 22.8% of the total site would be covered with either existing or proposed impervious coverage. The proposed construction of the docking facility would result in the incorporation of approximately 4,552 sq. ft. or Estuarine and Public Trust Waters. Approximately 80 sq. ft. of open water area would be filled as a result of the bulkhead installation. According to historical records, the proposed boat basin excavation has the potential to impact areas of SAV or SAV habitat. Approximately 78,690 sq. ft. of shallow bottom habitat would be disturbed as a result of the proposed basin and channel excavation. Additionally, approximately 250,000 sq. ft. of high ground would be disturbed as a result of the dredge spoil deposition. As designed, the proposed floating docks would not encroach into the riparian corridor setbacks on either side, nor would they extend beyond 1 /4/ of the width of the water body, or beyond the near shore edge of the adjacent channel. Project Narrative 5.1.1 Introduction and Project Location The applicant, Hampstead Investment Holdings, LLC, purchased the existing ship's store and docking facility in November of 2016 with the intent to improve the existing store, grounds, docking facilities and add 224 dry storage slips. The property is located at 579 Lewis Road in Hampstead, Pender County (See Appendix A). 5.1.2 Existing Conditions The property currently functions as a ship's store (Quarter Master Store at Marker 90) with commercial and charter fishing leased slips. Much of the property is used for trailer and boat storage (Appendix A, Sheet 1). On September 12017, LMG staff conducted a shellfish and SAV survey at the site. The survey area encompassed all the shallow waters within the proposed dredge area out to the edge of the existing channel and totaled 0.69 acres. Using a ratio of 25 square meter plots per acre sampling methodology, 18 square meter plots were raked for the presence shellfish and SAV or SAV rhizomes while visual inspections were also performed throughout the survey area. No significant shellfish resource and no SAV or SAV rhizomes were identified. See Appendix A, Sheet 6 of 10. 5.1.3 Proposed Action Within the 75' AEC, upland work includes removal or abandonment in place of the existing septic system holding tank. New impervious and pervious pavement for parking, walkways and fork lift access to the boat launch area. New bulkhead will be installed waterward of the existing bulkhead from the southwestern property boundary extending northward around the existing building. A 224-slip dry storage structure will be located outside of the 75' AEC. The dry storage structure will be an open metal frame with concrete footings and gravel underneath. Pervious and impervious pavement will surround the structure for fork lift access See Appendix A and D for details. Waterward work consists of removing the existing docking structures and replacing them with new floating docks that contain 22 temporary holding slips to support the 224-slip dry storage. New and maintenance dredging is requested to -6 feet MLLW to ensure navigable depths and decreased maintenance event frequency. Approximately 8,500 cy of material will be dredge from around the proposed floating docks and within an existing access channel out to the AIWW, connecting to similar depths (-6 MLLW). A bucket -to -barge dredge is proposed, material will be offloaded at the proposed boat launch area and then staged at the proposed parking area before being transport to the permanent disposal location located on upland portions of property owned by the applicant located near the intersection of INC 17 and Hoover Road (Pin 3293-01-3594-0000). The developer is responsible for the control of sediment on -site. If the approved erosion and sedimentation control measures prove insufficient, the developer must take those additional steps necessary to stop sediment from leaving this site (NCGS 113A-57(3)).
