On July 13, 2021, staff from the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) performed a follow-up inspection of the subject project, located at West Craftsman Way in
Pender County to determine the status of compliance with the State Stormwater Management Permit Number
SW8 140416, originally issued on July 3, 2014 and last modified on February 17, 2020. DEMLR file review and
site inspection revealed that the site is still NOT in compliance with the terms and conditions of this permit.
Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which
summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Phase 9 (located in Phase 2) is still under construction. Once construction is complete, a new engineer
certification will be required for this entire Phase 2 permit to address any changes to the system that are
not shown on the approved plans.
2. There is erosion on the banks of the pond above where the inlet pipe from Phase 9 enters the forebay.
3. Sediment from the erosion needs to be mucked out of the forebay.
4. There appears to be an extra curb inlet in the road and extra yard inlets in Lots 344 and 345 that are not
shown on the approved plans dated 2/17/20. *
5. The piping installed to convey runoff from Phase 9 built -upon area to the forebay does not appear to
match the approved plans dated 2/17/20. *
6. Previously submitted Lot BUA Allocation table does not match the permit, which allows 4,500 sf per lot
on all lots. Please revise and resubmit this table.
* A minor modification may be required for item #s 4 and 5.
Please be advised that, as the permittee, you are required to comply with the terms, conditions and limitations of
the Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North
Carolina General Statute 143-214.7, including the operation and maintenance of the permitted stormwater system.

Failure to provide the requested information, or to respond to this letter with a plan of action, including a timeline
to resolve the identified deficiencies, by August 30, 2021, are considered violations of the permit. If the
requested information is not submitted to this office by the due date, then DEMLR staff will re -inspect the site
and may issue a Notice of Violation. Please also note that any individual or entity found to be in noncompliance
with the provisions of a stormwater management permit or the stonmwater rules is subject to enforcement action
as set forth in NCGS 143 Article 21, including the assessment of civil penalties of up to $25,000 per day.

the banks may be too steep. This area should be re -graded at 3:1 slope where necessary, and
have sod installed on the banks that are eroding.
b. Sediment needs to be removed (mucked out) from the forebay where it has accumulated.
c. Some erosion holes around pond need to be filled and new grass seeded where necessary.
d. 'Trash rack on outlet structure needs to be secured in a manner where it can be removed when
necessary for maintenance.
4. The pond has a slightly different shape than the plans, however it appears to be sufficiently sized.

stormwater management permit], and distribute the assets as provided in NCGS 57D-6-08(2).
OR Per NCGS 55-14-05, a dissolved corporation continues its corporate existence but may
not carry on any business except that appropriate to wind up and liquidate its business;
and affairs, which includes the stormwater management permit;
f. A name change of the owner / permittee;
g. A name change of the project;

1. There is erosion where the inlet pipe from Ph 9 comes into the pond. It appears that the banks are too steep. This
should be re -graded at 3:1 slope and be re -seeded, or preferably have sod installed on the banks that are eroding.

3. All trash needs to be removed from the pond.
4. Trash rack needs to be secured to the outlet structure.

State Stormwater Management Permit No. SW8 140416
Dear Mr. Pollak:
On October 17, 2019, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected the subject project, located off Sloop Point Loop Road in Pender County
to determine the status of compliance with the State Stormwater Management Permit SW8 140416 issued
on July 3, 2014 and as modified thereafter. DEMLR file review and site inspection revealed that the site
is NOT in compliance with the terms and conditions of this permit. Please find a copy of the completed
form entitled "Compliance Inspection Report" attached to this letter, which summarizes the inspection.
As indicated in the attached inspection report, the following observations and deficiencies were found:
1. The recorded deed restrictions state that all lots have 4,500 sf allowable BUA each, whereas the
table in section 11.4 of the permit shows that lots 85-104 have different QUA allocations.
2. The orifice was not installed in the outlet structure.
3. The trash rack was damaged on the outlet structure.
4. Pipe outfall ties into the pipe that is part of Phase 3.
5. Phase 9, which is included in this permit, is under construction.
6. Pond 2 dimensions and shape were changed slightly in Phase 9.
The following actions are needed to bring this project into compliance:
1. An amendment is needed for the deed restrictions to correct the allowable BUA for lots 85-104.
2. The orifice needs to be installed in the outlet structure.
3. The trash rack needs to be repaired on the outlet structure.
Please be advised that until you receive approval from the Division to transfer the permit, as the
pemtittee, you are required to comply with the terms, conditions and limitations of the Stormwater
Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina
General Statute 143-214.7, including the operation and maintenance of the permitted system.
Failure to provide the requested information, or to respond to this letter with a plan of action, including a
timeline to resolve the identified deficiencies, by December 6, 2019, are considered violations of the
permit. If the requested information is not submitted to this office by the due date, then DEMLR staff
will re -inspect the site and may issue a Notice of Violation. Please also note that any individual or entity
found to be in noncompliance with the provisions of a stormwater management permit or the stormwater
rules is subject to enforcement action as set forth in NCGS 143 Article 21, including the assessment of
civil penalties of up to $25,000 per day.
