Dear Mr. Butts
On May 30, 2013, the Wilmington Regional Office issued a Stormwater Management Permit for the Burton Industrial
Park — Concrete Plant for S.T. Wooten Corporation. A Certificate of Coverage NCG140428 was issued on August 8,
2013, approving the discharge of truck wash water into the permitted BMP #1 covered in the subject State
Stormwater Permit No. SW8130501. This permit is being modified to provide additional terms and conditions
regarding the use of the permitted wet detention pond as an NPDES regulated wastewater discharge for the truck
wash water. Staff review of the plans and specifications has determined that the project, as proposed, will comply
with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-211. We are
forwarding modified Permit No. SW8130501 dated November 1, 2013, for the construction, operation and
maintenance of the BMP's and built -upon areas associated with the subject project.
This permit shall be effective from the date of issuance until May 30, 2021, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the
Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changing ownership,
transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and
maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew
the permit, will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition
must conform to Chapter 150E of the North Carolina General Statutes, and must be filed with the OAH within thirty

Carolina as amended, and other applicable Laws, Rules, and Regulations

FOR THE
construction, operation and maintenance of two (2) wet detention ponds in compliance with
the provisions of 15A NCAC 2H .1000 and Session Law 2008-211 (hereafter collectively
referred to as the "stormwater rules') the approved stormwater management plans and
specifications and other supporting data as attached and on file with and approved by the
Division and considered a part of this permit.
This permit shall be effective from the date of issuance until May 30, 2021, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
This stormwater system has been approved for the management of stormwater runoff
as described in Section 1.9 of this permit. The stormwater controls labeled BMP #1
and BMP #2 have been designed to handle the runoff from 197,065 and 65,340
square feet of built -upon area, respectively.
3. A 50' wide vegetative buffer must be provided and maintained adjacent surface
waters, measured horizontally from and perpendicular to the normal pool of
impounded structures, the top of bank of both sides of streams and rivers and the
mean high water line of tidal waters.
4. A vegetated filter strip is not required for this pond as it has been designed to provide
an average annual total suspended solids removal efficiency of 90%.
5. The level spreaders shown on the plans are not required under the stormwater rules
and therefore are not considered a part of the approved state stormwater treatment
system. These additional measures are incorporated only by reference and are not
enforceable parts of the permit.
6. The tract will be limited to the amount of built -upon area indicated in this permit, and
per approved plans. The built -upon area for the future development within the
drainage areas of BMP's #1 and #2 is limited to 7,877 and 3,414 square feet,
respectively.

All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
The runoff from all built -upon area within the permitted drainage area(s) of this project
must be directed into the permitted stormwater control system.

10. BMP #1 will act in a temporary capacity to receive the truck wash water discharge as
per NCG140428. The total additional volume associated with the truck wash operation
is based on a maximum water usage of 55 gallons per truck, 15 trucks per day, each
making 3 trips per day for a total of 2,475 gallons or 331 cubic feet of additional
volume. For purposes of determining the additional wastewater volume over and
above the state stormwater design storm of 1.5", a factor of safety of 5 was applied,
resulting in a total additional volume of 1,655 cubic feet. The total minimum required
storage volume in BMP #1 is below the provided volume of 25,657 cubic feet.
II. SCHEDULE OF COMPLIANCE
1. No truck washing activities shall be allowed during a heavy rainstorm, or immediately
after a heavy rainstorm, or during the time that BMP #1 is discharging via the weir set
at the temporary pool elevation of 38.0, or during the time that the water level in BMP
#1 is rising and is within one inch of going over the temporary pool weir at elevation
38.0.
All truck wash water discharges into BMP #1 shall enter the BMP via the forebay.
3. The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built -upon surface.
During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.

5. The permittee shall, at all times, provide the operation and maintenance necessary to
assure the permitted stormwater system functions at optimum efficiency. The signed
and approved Operation and Maintenance Agreement must be followed in its entirety
and maintenance must occur at the scheduled intervals.
6. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DENR. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
Decorative spray fountains will be allowed in the stormwater treatment system, subject
to the following criteria:
a. The fountain must draw its water from less than 2' below the permanent pool
surface.
b. Separated units, where the nozzle, pump and intake are connected by tubing,
may be used only if they draw water from the surface in the deepest part of the
pond.
c. The falling water from the fountain must be centered in the pond, away from the
shoreline.
d. The maximum horsepower for a fountain in BMP 1 is 1/6 horsepower. A
fountain is not permitted in BMP 2 as the permanent pool volume is less than
30,000 ft3.
8. The facilities shall be constructed in accordance with the conditions of this permit, the
approved plans and specifications, and other supporting data on file with and
approved by the Division.
9. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification. A modification may be required for
those deviations.
10. If the stormwater system was used as an Erosion Control device, it must be restored
to design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
11. Access to the stormwater facilities for inspection and maintenance shall be maintained
via appropriate recorded easements at all times.
12. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
C. Further development, subdivision, acquisition, lease or sale of any, all or part of
the project area. The project area is defined as all property owned by the
permittee, for which Sedimentation and Erosion Control Plan approval or a
CAMA Major permit was sought.
d. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
13. Prior to the construction of any permitted future areas shown on the approved plans,
the permittee shall submit final site layout and grading plans to the Division for
approval.

14. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made.
15. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit. A copy of the approved plans and specifications
shall be maintained on file by the Permittee at all times.
16. At the time the permittee ceases operations at this site, the permittee shall restore the
permitted BMP's to the permitted design condition. The permittee shall provide written
certification to the Division that the BMP's have been restored to design condition and
shall request that the Division inspect the restored BMP's. Failure to restore the BMP's
to design condition, or failure to request an inspection of the BMP's prior to ceasing
operations are considered violations of the permit.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director. At least 30 days prior to a change of ownership, or a name
change of the permittee or of the project, or a mailing address change, the permittee
must submit a completed and signed Name/Ownership Change Form to the Director
accompanied by the supporting documentation as listed on the form. The approval of
this request will be considered on its merits and may or may not be approved.
2. The permittee is responsible for compliance with all permit conditions until such time
as the Director approves the transfer request. Neither the sale of the project in whole
or in part, nor the conveyance of common area to a third party constitutes an
approved transfer of the stormwater permit.
3. Any individual or entity found to be in noncompliance with the provisions of this
storrmwater management permit or the requirements of the Stormwater rules is
subject to enforcement procedures as set forth in G.S. 143 Article 21.
4. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, the Permittee shall take
immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement stormwater management systems.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit remains in force and effect until modified, revoked, terminated or renewed.
The permit may be modified, revoked and reissued or terminated for cause. The filing
of a request for a permit modification, revocation and re -issuance or termination does
not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate
documentation and the processing fee.

Certification Requirements:
1. The drainage area to the system contains approximately the permitted acreage.
2. The drainage area to the system contains no more than the permitted amount
of built -upon area.
3. All the built -upon area associated with the project is graded such that the runoff
drains to the system.
4. All roof drains are located such that the runoff is directed into the system.
5. The outlet structure elevations are per the approved plan.
6. The outlet structure is located per the approved plans.
7. Trash rack is provided on the outlet structure.
8. All slopes are grassed with permanent vegetation.
9. Vegetated slopes are no steeper than 3:1.
10. The inlets are located per the approved plans and do not cause short-circuiting
of the system.
11. The permitted amounts of surface area and/or volume have been provided.
12. Required drawdown devices are correctly sized and located per the approved
plans.
13. All required design depths are provided.
14. All required parts of the system are provided, such as a vegetated shelf, and a
forebay.
15. The required system dimensions are provided per the approved plans.
16. All components of the stormwater BMP are located in either recorded common
areas. or recorded easements.

Hunter:
As I was drafting a permit correction to SW8 130501 for BMP #1 to deal with the truck wash water operation
permitted under NCG140428, I noticed a problem. The methodology to arrive at the additional volume
associated with the truck washing operation is correct, however the minimum required volume for BMP #1
reported in the unsealed, undated, recently received Truck Wash Usage Summary, 14,487 cubic feet, is
incorrect. The May 1, 2013 design calculations indicate that the minimum required volume for BMP #1 is
23,550 cubic feet.
Additionally, the temporary volume provided, 16,988 cubic feet, is incorrect. The May 1, 2013 calculations
(and the permit) indicate that the provided volume in BMP #1 is 25,657 cubic feet. If I add 331 cubic feet to
23,550 cubic feet, the new required minimum volume is 23,881 cubic feet. This is still within the pond design
parameters, but you should correct the Truck Wash Water Usage Summary calculations you recently provided
to reflect accurate numbers.

I had Linda look at the storage capacity of pond one (see below). It looks ok. However we will be making a correction to
the state stormwater permit to include the info below written by Linda, referring to the NPDES General permit for pond
one and adding an 0 & M condition to prohibit truck washing during a heavy rain storm when the pond level is one inch
or less from the top of the pond. We will come up with more specific language and/or provide a marked up detail of the
outlet structure from the drawings they sent. This correction and marked up detail will be in a written letter to them
from our office.

The 2475 gallons (331 cf) associated with the truck washing is a daily amount. I think we should account for
that daily amount for a total of 5 days. If it doesn't rain for 5 days, during that 5 days, 1,655 cf of volume will
have been added to the pond from truck washing. Using that volume, there's still a cushion of 846 cf in the
pond, 14487+1655=16142. A total of 16,988 cf has been provided in the pond.
If we assume that the minimum volume required and the volume provided in the pond were calculated correctly
in the original permit, then everything looks good.
I would like to see a condition added to our permit that prohibits truck washing during heavy rain, or when the
pond is full and discharging.

Ken — thanks for reminding me about this. Georgette did ask about this when I spoke with her a few weeks ago. I've
attached my justification for the design. Essentially, the grading plan resulted in an "extra" 2500 cf of temporary storage
in the water quality pool. Based on Wooten's data, and the expected activity in the plant, an average of 330 cf of wash
water will be produced. So the wash water will not result in any significant change in the normal water level of the pond,
thereby ensuring that there is always sufficient storage for the stromwater.
This will, however, result in more frequent small discharges, which will need to be monitored by STW.

Here's a perfectly reasonable request to me from Georgette in Wilmington.
As you are aware, we no longer perform and engineering review in the NPDES program for industrial wastewater
facilities.
However, Georgette's request goes to the sufficiency of the BMP under SW8130501 in the state stormwater
management program, the 2H.1000 program. Please forward to me the calcs establishing the sufficiency of that
engineered BMP. I mean, please send me the calcs showing that BMP 1 has been designed in accordance with the
estimated hydraulic loading including the additional flows from ready -mix concrete operations, as per standard state
stormwater design requirements in her program. I'll make a copy for our files, and forward them to her for her files.
If there is something I obviously don't understand, please contact me today.

.60 Use for all subdivision projects. This permit is not transferable to any person or entity except
after notice to and approval by the Director of the Division of Water Quality. A request to
transfer the permit will be considered on its merits and mayor may not be approved. The
permittee shall complete, sign and submit one of the two Name/Ownership Change Forms
available online. The Name/Ownership Change Form must be accompanied by the
supporting documentation as listed on the form and must be submitted to, the appropriate
Regional Office of the Division of Water Quality at least 60 days prior to any one or more of
the following events:
a. The sale or conveyance of the project area in whole or in part, except for individual lot
sales which are made subject to the recorded covenants and restrictions of record;
b. The sale or conveyance of the common areas to'the HOA or POA where the
requirements of Session Law 2011-256 have been met;
c. The dissolution of the corporate entity, .LLC, or General Partnership;
d. Bankruptcy and/or foreclosure proceedings;
e. A name change of the permittee;
f. A name change of the project;
g. A mailing address change of the permittee.
Use for nonsubdivision projects only. This permit is not transferable to any person'or entity
except after notice to and approval by the Director of the Division of Water Quality. A•
request to transfer the permit will be considered on its merits and may or may not be'.

8. The Director of the Division of Water Quality (DWQ) may notify the permittee when the
permitted site does not meet one or more of the minimum requirements of the permit. Within
the time frame specified in the notice, the permittee shall submit a written time schedule to
the Director for modifying the site to meet minimum requirements. The permittee shall
provide copies of revised plans and certification in writing to the Director that the changes'
have been made. Such revisions may require a permit modification. The permittee shall
submit all information requested by the Director of DWQ or his representative within the time
frame specified in the written information request.
9. The issuance of this permit does not prohibit the Director of the Division of Water Quality
from reopening the permit to modify, revoke, reissue, or terminate the permit as allowed by
the laws, rules, and regulations contained in the North Carolina General Statutes (NCGS)
Section 143-215.1 and Section .1011 of Title 15A of the North Carolina Administrative Code,
Subchapter 2H, which states that the Director of the Division of Water Quality may modify,
revoke and reissue or terminate this permit for: cause. The filing of a request for a permit
modification, revocation and re -issuance, or termination does not stay any permit condition
10. Any individual or entity found to be in noncompliance with the provisions of this stormwater•
management permit or with the stormwater rules, is subject to the enforcement procedures
as set forth in Article 21, Chapter 143 of the North Carolina General Statutes including the
assessment of civil penalties of up to $25,000 per violation per day

standards and regulations promulgated and adopted by the North Carolina Environmental
Management Commission, and the Federal Water Pollution Control Act, as amended,

to receiving waters designated as an unnamed tributary to New River, a class C, NSW water in
the White Oak River Basin.
Special conditions of the Certificate of Coverage
1. S. T. Wooten will build and configure the facility in substantial conformity with the
stormwater and wastewater control systems shown on the Site Plan, Sheet No. 2 of 11,
dated and stamped July 2, 2013 by Withers & Ravenel, and submitted with the revised
permit application on July 3, 2013.
2. Only wastewater discharges are authorized for Outfall #01, the discharge from BMP 1 as
presented on the said Site Plan. Authorized wastewater discharges may arise from truck
and equipment washdown activities; from aggregate pile irrigation drainage; and from
truck or drum wash out activities. Any other wastewater discharges are not authorized.
All flows discharging from Outfall #01 will be regulated as wastewater discharges, -and
must comply with the wastewater provisions of NCG140000.,
3. Only stormwater-only discharges are authorized for Outfall #02, the discharge from BMP
2 as presented on the said Site Plan. All flows discharging from Outfall #02 will be
regulated as stormwater discharges. "
4. The permit application represents that this facility is a temporary installation, but the
duration of production activities is uncertain at this time. S. T. Wooten will maintain the
two BMP's shown on the said Site Plan, and at the time that ready -mix concrete
operations cease, the company will refurbish the two BMP's as necessary to insure their
full functionality as the required BMP's under the State Stormwater Management
program permit, SW 8130501. S. T. Wooten will request an inspection of the refurbished
BMP's from the Wilmington Regional Office stormwater staff. Failure to satisfactorily
refurbish the BMP's, or failure to request the stormwater staff inspection is a violation of
the General Permit. The Division may withhold rescission of the General Permit coverage
until satisfactory functionality is established for the two BMP's.
This Certificate of Coverage is an enforceable part of General Permit NCG140000, and shall
become effective for the permittee on August 8.2013.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

In accordance with your completed application for a discharge permit received on July 3,
2013, we are forwarding herewith the subject certificate of coverage (COC) to discharge
under the subject state-.NPDES general permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the US Environmental Protection Agency dated
October 15, 2007 (or as subsequently amended).
Please note that NCG140000 contains effluent limitations for process wastewater discharges
(see Part IV, Section D). Wastewater discharges must meet the requirements of these
effluent limitations. An exceedence of any of these limitations is a violation of permit
conditions.
This facility already has the additional coverage required under North Carolina water quality
rules at 15A NCAC 2H .1000. Please note that the provisions of that permit SW 8130501
continue to pertain at this site, in addition to the federal NPDES program permit,
NCG140000. The elements of coordination between the two permits are established in the
attached site -specific Certificate of Coverage, NCG140428.
Please take notice that this certificate of coverage is not transferable except upon approval
of the Division of Energy, Mineral, and Land Resources. The Division of Energy, Mineral,
and Land Resources may require modification or revocation and reissuance of the certificate
of coverage. This permit does not affect the legal requirements to obtain other permits
which may be required by the Division of Energy, Mineral, and Land Resources or permits
required by the Coastal Area Management Act or any other federal or local governmental
permit that may be required.
Please note that permit requirements in Part II, Section A, numbers 1-5, and Part II,
Section B, number 1 are no longer valid per NC Session Law 2011-394. However, note that
Part II, Section A, number 6, and Part II, Section B, numbers 2-10 are unaffected by the
Session Law. Those sections will remain in effect for the duration of this permit term.
Please be reminded that your facility must notify the appropriate DEMLR Regional Office at
least 72 hours in advance of operation of your wastewater treatment facility.
