On April 28, 2016, the Wilmington Regional Office received a complete request to revise the approved
plans for Stormwater Management Permit Number SW8 081209. The revisions include modification of
the drainage network from the original plans. It has been determined that a formal permit modification is
not required for the proposed changes. We are forwarding you an approved copy of the revised plans for
your files. Please replace the old approved plan sheets with the new sheets attached.
Please be aware that all terms and conditions of the permit issued on March 23, 2015 shall remain in
full force and effect, including the requirement to record the deed restrictions, as per the signed,
notarized form attached Please also understand that the approval of this revision to the approved
plans or to the permit for the subject State Stormwater project is done on a case -by -case basis. Any
other changes to this project must be approved through this Office prior to construction. The issuance
of this plan revision does not preclude the permittee from complying with all other applicable
statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity, and
obtaining a permit or approval prior to construction.

In accordance with Title 15 NCAC 2H.1000 and S.L. 2006-246, the Stormwater Mana ment Regulations,
deed restrictions and protective covenants are required for High Density Residential ' wherep
lots will be subdivided and sold and runoff will be treated in an engineered stormwater control facility. Dee
restrictions and protective covenants are necessary to ensure that the development maintains a "built -upon"
area consistent with the design criteria used to size the stormwater control facility.
I; Anthony W. Svdes , acknowledge, affirm and agree by my signature below, that I will cause
the following deed restrictions and covenants to be recorded prior to the sale of any lot:
The following covenants are intended to ensure ongoing compliance with State Stormwater
Management Permit Number SW8 081209 , as issued by the Division of Energy, Mineral and Land
Resources under the Stormwater Management Regulations.
2. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to
maintain compliance with the stormwater management permit.
3. These covenants are to run with the land and be binding on all persons and parties claiming under
them.
4. The covenants pertaining to stormwater may not be altered or rescinded without the express written
consent of the State of North Carolina, Division of Energy, Mineral and Land Resources.
5. Alteration of the drainage as shown on the approved plan may not take place without the concurrence
of the Division of Energy, Mineral and Land Resources.
6. The maximum allowable built -upon area per lot is 3,500 square feet. This allotted amount includes
any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way
between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to,
structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not
include raised, open wood decking, or the water surface of swimming pools.

This allotted amount includes any built -upon area constructed within the lot property boundaries, and
that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area

parking areas, but does not include raised, open wood decking, or the water surface of swimming
pools.
Each lot will maintain a 30"" foot wide vegetated buffer between all impervious areas and surface
waters.

8. All runoff from the built -upon areas on the lot must drain into the permitted system. This may be
accomplished through a variety of means including roof drain gutters which drain to the street, grading
the lot to drain toward the street, or grading perimeter swales to collect the lot runoff and directing them
into a component of the stormwater collection system. Lots that will naturally drain into the system are
not required to provide these additional measures.

As for Item 3.1 From the calculations that I have seen on the original plans and the original drainage area map that was
submitted to NCDEQ, the offsite BUA was assumed to be 100% impervious. This is by all means pretty conservative, and
explains the pond size for pre/post flood control for New Hanover county. As stated before the pond is still twice as big
as it needs to be to handle the BUA. The original engineer did this because they(the developer) has no control of the
offsite areas. We couldn't limit them to what they might want to do, plus I also think it was part of the "agreement"
between the two parties. They get a free pond, and the developer gets to have access to the property in the back.
We have had no working relationship with the previous engineer (despite paying him several thousand dollars to
help). I will look through our old permits files and plans to see if I can find any additional documentation that will satisfy
this question.

recorded to date.

This letter is in response to your letter dated

J1. The project drainage area has not changed since NC DEQ issued the original permit,
it includes all the areas mentioned in your additional information request letter.
2. We have the same number of lots. The only revisions we made were "cleaning up"

some of the odd shapes on a few of the lots to be more uniform for house
construction. The BUA for the lots will remain the same.
The pond has not changed. The original permit and drainage area shows
687,032 square feet of offsite drainage area tributary to the pond, of which it
all is assumed to be Impervious Area. It is listed in the original permit. Pond
#2 serves very little for the Riverside development and is mostly for the
offsite area. The ponds are also very much oversized. This is due in part to
the New Hanover County flood control requirements that restrict post
development peak flows. Let's look at pond #2:

Total Drainage Area= 1,514,008 ft'
Total BUA to pond = 851,192 ft2
% Impervious = 851,192/1,514,008 = 56.2%
Pond SA/OA charts for 90%TSS Removal Rates with a 3 ft. average
depth at 60% BUA = 7%
Surface area required = 0.07 (1,514,008 ftZ) = 105,980 ft'
Surface area provided = 199,723 ftZ
So we have roughly 88% MORE surface area than what is required. I would like to think
that this would suffice.
V/b. The swale continues on and enters Pipe H4. See attached plan.
Jc. It may be difficult to see on a plan copy but between Lots 37/38, 45/46 and
54/55 there are drainage pipes located on the property lines. The invert
elevations are the pipe inverts at these locations. The pipes are F1, E1 and B1
on the respective property lines.
4. All offsite areas are calculated as having 100% Impervious Surface Areas. I don't see
much need in recording the covenants when they can cover as much or little as they
want/need.
5. The developer has agreed to build the pond and provide maintenance costs as the
deal to allow a road to be constructed through their property otherwise there would
be no project.
6. As previously discussed, let's look at Pond H2 storage volume using the average -end
area method to calculate volume:
- PPE = 20.5—199,723 ft'
21.0 — 214,204 ftZ
- (199,723 ftZ + 216,395 ftZ) _ 2 x 0.5 ft (depth) = 103,481 ft'
21.25 = 216,222 ftZ
- (214,204 ftZ + 216,395 ftZ) _ 2 x 0.25 ft (depth) = 53,824 ft'
- Total Temp Pool Volume = 157,305 ft'
- Required Storage Volume = (1.5 in/12 in/ft) x 0.56 x 1,514,008 ftZ
= 105,222 ft'

As you can again see, the storage volume for the pond is much greater than is required.
7. The easement is shown; however, since it corresponds to the surrounding fence, it
would be difficult to see in a copy of the plans.
Please find enclosed two (2) copies of the Grading Plans and Preliminary Plats. Also find
enclosed a copy of the Drainage Area Map that corresponds to the original Drainage Area Map
for this project.
Please keep in mind that this project has a long history and we have had what I would
describe as a poor relationship with the original engineer. Lucky for both of us (Developer & NC
DEQ) the ponds were oversized greatly enough to provide adequate stormwater treatment for
our needs, the drainage area's needs, plus much more.

The Wilmington Regional Office received and accepted a Plan Revision for State Stormwater
Management Permit SW8 081209 on November 20, 2015. A preliminary in-depth review of that
information has determined that the application is not complete. The following information is needed to
continue the stormwater review:
Supporting Information requirements applicable to all projects:
J1. 02H.1003(g)(5) and 02H.1005(d) - Delineate all relevant boundaries including drainage
areas, SHWT, coastal wetlands, property/project boundaries and drainage easements.
Coastal wetlands above the mean high water line must be excluded from the project area
prior to calculating density. Recommendation: The required vegetated buffer should be
delineated. The definition of the vegetated buffer can be found in 02H.1002(23). If there
are no coastal wetlands on site, please note so on the plans. Lot lines should be
considered a `property boundary".
For this project, you will need to provide a drainage area map showing all onsite
and offsite areas. The offsite area should include all of Wrightsboro Plaza,
including both of the entrance roads off Hwy 117. In addition, there are 3 offsite
lots on the north side of the property (Advance Auto, fronting Hwy 117) and 2 lots
behind (undeveloped) that should be included as offsite development.
f2. 02H.1003(g)(6) — Delineate the existing and the proposed built -upon area including
roads, parking areas, sidewalks, buildings, etc.
Please provide calculation of the BUA, if any lots have changed, etc.
3. 02H. I 003(g)(7) — Provide technical information showing final numbers, calculations,
assumptions, drawings and procedures associated with the stormwater management
measures including but not limited to: Built -upon area, runoff coefficients, runoff
volume, runoff depth, flow routing, inlet and outlet configuration (if applicable), and
other applicable information as specified.
Ol. Confirm by calculations that all offsite area is accounted for in Pond #2 design.
✓2. Swale 3-3 appears to end at the sewage pump station, then picks up again at a
RCD on the other side of the building. Please explain how this will work.
3. RCDs on the north property line show inverts in. Is there supposed to be a yard
inlet at those locations? Special design of check dam? Please advise.

J 4. 02H. I 003(g)(9) — Provide recorded deed restrictions and protective covenants. As an
alternative, proposed deed restrictions and protective covenants and a signed agreement
to provide the final recorded documents shall be accepted when final documents are not
available at the time of submittal. Per 02H.1003(d)(1) and (2), the permit requires
recorded deed restrictions and protective covenants to ensure that the development
activities are maintained consistent with the approved plans and specs. Recommendation:
The recorded language will necessarily need to limit the BUA (per lot for subdivisions
and per BAP for non -subdivisions), limit the addition of driveway piping, prohibit the
piping of any vegetated conveyances (low density and curb outlet swales), stipulate the
width of the vegetated buffer, prohibit the construction ofBUA in the buffer, and provide
the enforcement authorityfor any individual or entity who fails to comply with the
stormwater permit or the rules. The statements will vary depending on whether the
project is high density or low density. The Division has prepared boilerplate language for
each situation for your use.
/ For this project, as noted in the previous inspection, copy of the recorded deed
✓/ restrictions needs to be submitted for as much of the property as possible, including'
offsite lots. For new lots, a notarized form should be filled out stating that deed
restrictions will be recorded in the future.
General Engineering Design Criteria for all projects. Session Law 2008-21 1 Section 2(b.)(4) all
stormwater management structures shall be designed per the requirements of 02H.1008(c):
/ 5. 02H.1008(c)(]) —The size of the system must take into account the runoff at the ultimate
/ built -out potential from all surfaces draining to the system, including any off -site
drainage. Recommendation: if the offsite drainage is coming from property that is not
owned by the applicant or is not part of the development project and there is no written
maintenance cost -sharing agreement or a recorded deed restriction limiting BUA
between the parties to treat that amount of BUA in the proposed system, the offsite
drainage should be rerouted such that it bypasses the proposed stormwater system. If
there is an agreement/or and a deed restriction, request that the applicant provide
copies.
6. 02H. 1008(c)(1) — The storage volume of the system shall be calculated to provide for the
most conservative protection using any approved runoff calculation methods.
J 7. 02H. I 008(c)(3) - Locate all stormwater management structures in recorded drainage
easements for the purposes of operation and maintenance and provide recorded access
easements to the nearest public right-of-way. These easements shall be granted in favor
of the party responsible for operating and maintaining the stormwater management
structures. Recommendation: the runoff collection system ofpipes, ditches, and swales
are considered a stormwater management "structure " and must be located in a recorded
drainage easement, dedicated common area, or public right-of-way.
I noticed that there didn't appear to be an easement around the relocated sewage
pump station. Please advise.
Please remember that a change to one number may have a domino effect on other numbers. Please check
all plans, calculations and forms to ensure that the numbers are consistent throughout.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received in this Office prior to March 16, 2016 or the application will be
returned as incomplete. The return of a project will necessitate resubmission of all required items,
including the application fee.

If you need additional time to submit the information, please mail, email or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information, which shall be no later than 30
days past the original due date. The Division is allowed 90 days from the receipt of a completed
application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.

Do you know whether your developer has to accept all offsite flow from Wrightsboro Plaza? Or, is it just
the outparcels such as Advance Auto? Previously, they were going to handle all. However, I don't know
the reason why for sure. I suspect that it was because the current swale and wetlands situation was not
working well. Your thoughts?

Steven,
Here is our plan for Riverside. First I will submit the ownership change form information to
you. Next I will begin a redesign of the project. The Layout and road network, number of lots
etc... will not change. However I hopefully will be able to make substantial changes to the
drainage network and pond design to make this job more economically feasible.
In regards to OFFSITE stormwater. We will be required to accept the offsite flow from the
Zimmer property. FYI this property is landlocked and our only access is through the Zimmer
property. It appears that the original developer had to agree to some demands. These demands
are bound within a contract that our developer has agreed to, at least if he wishes to develop the
property. I have spoken with the developer this morning and he has told me to move forward. I
still must talk to the original Engineer and get all the information I need to do a redesign. But
that is our direction as of today.

As I have already spoken to Mrs Scott about this project, this email
is just a quick follow up to let you know where I am currently. I
have a meeting next week with the New Hanover Planning
department to discuss the Riverside project. After the completion
of that meeting, we along with the owner will be collectively
deciding what the fate of this project will be. Our two options are
to one, continue as is with the project, at which point I will transfer
the permit to the new owners name. Beyond that, we may decide
to revisit the pond design with NCD) NR. As I have explained
before I feel that there is a potential cost savings with some
reworking of the pond design. The second option is to completely
redesign the project from start to finish. These answers depend
completely upon how well our meeting goes with the planning
department and what time frames and requirements they have. I
have never worked with New Hanover so this is new ground for
me. When a decision has been made 1 will contact you
accordingly.

I have an email problem! My email program is broken and I've had to sift through hundreds of emails from the email
server (mostly junk),
What was sent was a plan modification. We are not changing the ponds or the BUA areas, the only real things we are
changing are how the pipes are run through the subdivision. I apologize if my submittal was vague, I had been talking
directly with Steven Pusey about what we were doing, and he was helping me gather the info I needed to finish this
project. I will be leaving today and heading on vacation so I will not be back until the week of the 13th. I will contact
you then, and hopefully be able to fix my email as well.
