Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water Quality
(DWQ) to the Division of L'nergy, Mineral and Land Resources (DEMLR). All previous references to DWQ will
remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that any
updated pages or addendums to this permit will now reference DEMLR as the Division responsible for issuance
of the permit
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development approval
issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which
was current and valid at any point between January I, 2008, and December 31, 2010. The law extended the
effective period,of any stormwater permit that was set to expire during this time frame to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra
year for a total of four (4) years extension.
On February 23, 2015, the Wilmington Regional Office received a request to transfer the ownership of the state
stormwater management permit for the subject project. Staff of DEMLR has inspected the project and determined
that the documentation is in order. Although the project is not in compliance with terms and conditions of the
state stormwater permit at this time, it is recognized that this permit needs to be transferred due to foreclosure of
the previous permit owner and resale of the property. Our office will work with you to get this project into
compliance after the permit is transferred. Please reference our previous inspection report dated October 14; 2014
for further information.
As indicated on the Name/Ownership Change form, you have acknowledged receipt of a copy of the permit,
which includes the application and supplement forms, a copy of the approved plans and a copy of the required
Operation and Maintenance agreement from the previous permittee. By acknowledging receipt of the permit, and
by signing the Name/Ownership Transfer form, you have accepted the responsibility for complying with the terms
and conditions outlined in this permit. The Division is hereby notifying you that the subject permit has been
transferred on March 23, 2015 and to remind you that this permit shall be effective until December 30, 2021,
which includes all available extensions. The terms and conditions of this extended permit sliall remain in full
force and effect. For your records, please find enclosed a copy of the original permit issued with an updated page
3, a copy of the inspection report, and a copy of the Name/Ownership Change form submitted on February 23,
2015.

Please be aware that the project's built -upon area and stonmvater controls must be built and maintained in
compliance with the permit documents and the approved plans. Maintenance of the approved system shall be
performed in accordance with the signed Operation and Maintenance agreement. Any modifications to this project
must be submitted to DEMLR and approved prior to construction. The issuance of this approval does not preclude
you from complying with all other applicable statutes, rules, regulations or ordinances, which may have
jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request
an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The
written petition must conform to Chapter 150B of the North Carolina General Statutes. Per NCGS 143-215(e) the
petition must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process at 6714

Construction, operation and maintenance of two (2) wet detention ponds in compliance with the
provisions of Session Law 2008-211 and 15A NCAC 2H .1000 (hereafter referred to as the
"stormwater rules') and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Energy, Minerals and
Land Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until December 30, 2021, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater described
in the application and other supporting data.
This stormwater system has been approved for the management of stormwater runoff as
described in Section 1.5 on page 4 of this permit. The subdivision is permitted for 166 lots,
each allowed a maximum of 3,500 square feet of built -upon area, and three multi -
residence units.
3. The runoff from all built -upon area within the permitted drainage area of this project must
be directed into the permitted stormwater control system.

4. The built -upon areas associated with this project shall be located at least 50 feet landward
of all perennial and intermittent surface waters.
5. The following design elements have been permitted for this wet detention pond stormwater
facility, and must be provided in the system at all times.

II. SCHEDULE OF COMPLIANCE
No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature (such as
swales) shown on the approved plans as part of the stormwater management system
without submitting a revision to the permit and receiving approval from the Division.
2. Decorative spray fountains will be allowed in the stormwater treatment system, subject to
the following criteria:
a. The fountain must draw its water from less than 2 foot below the permanent pool
surface.
b. Separated units, where the nozzle, pump and intake are connected by tubing, may
be used only if they draw water from the surface in the deepest part of the pond.
c. The falling water from the fountain must be centered in the pond, away from the
shoreline.
d. The maximum horsepower for the fountain's pump is based on the permanent pool
volume. The maximum pump power for a fountain is listed in Section 1.5.o.

3. The permittee is responsible for verifying that the proposed built -upon area for the entire
lot does not exceed the maximum allowed by this permit. Once the lot transfer is
complete, the built -upon area may not be revised without approval from the Division of
Energy, Minerals and Land Resources, and responsibility for meeting the built -upon area
limit is transferred to the individual property owner.
4. If an Architectural Review Board or Committee is set up by the permittee to review plans
for compliance with the BUA limit, the plans reviewed must include all proposed built -upon
area. Any approvals given by the Board do not relieve the homeowner of the responsibility
to maintain compliance with the permitted BUA limit.
5. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the notice,
the permittee shall submit a written time schedule to the Director for modifying the site to
meet minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
6. The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
7. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision, acquisition, or sale of all or part of the project area. The project
area is defined as all property owned by the permittee, for which Sedimentation
and Erosion Control Plan approval or a CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved
plan.
8. The permittee shall submit for approval, final site layout and grading plans for any
permitted future development areas shown on the approved plans, prior to construction.
9. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
10. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
11. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior
to operation of this permitted facility, a certification must be received from an appropriate
designer for the system installed certifying that the permitted facility has been installed in
accordance with this permit, the approved plans and specifications, and other supporting
documentation. Any deviations from the approved plans and specifications must be noted
on the Certification.
12. If the stormwater system was used as an Erosion Control device, it must be restored to
design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.

13. Records of maintenance activities must be kept by the permittee. The records will indicate
the date, activity, name of person performing the work and what actions were taken.
14. This permit shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting data.
15. The permittee shall at all times provide the operation and maintenance necessary to
assure that all components of the permitted stormwater system function at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in its entirety
and maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and re -vegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans.
f. Debris removal and unclogging of structures, orifice, catch basins and piping.
g. Access to all components of the system must be available at all times.
16. The permittee shall submit to the Division of Energy, Minerals and Land Resources an
annual summary report of the maintenance and inspection records for each BMP. The
report shall summarize the inspection dates, results of the inspections, and the
maintenance work performed at each inspection.
17. Prior to the sale of any lot, the following deed restrictions must be recorded:
a. The following covenants are intended to ensure ongoing compliance with State
Stormwater Management Permit Number SW8 081209, as issued by the Division
of Energy, Minerals and Land Resources under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to the extent
necessary to maintain compliance with the Stormwater Management Permit.
C. These covenants are to run with the land and be binding on all persons and parties
claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded without
the express written consent of the State of North Carolina, Division of Energy,
Minerals and Land Resources.
e. Alteration of the drainage as shown on the approved plans may not take place
without the concurrence of the Division of Energy, Minerals and Land Resources.
f. The maximum built -upon area per lot is 3,500 square feet for 166 lots. The total for
the project is 1,869,401 square feet of BLIA. This allotted amount includes any
built -upon area constructed within the lot property boundaries, and that portion of
the right-of-way between the front lot line and the edge of the pavement. Built upon
area includes, but is not limited to, structures, asphalt, concrete, gravel, brick,
stone, slate, coquina and parking areas, but does not include raised, open wood
decking, or the water surface of swimming pools.
g. All runoff on the lot must drain into the permitted system. This may be
accomplished through providing roof drain gutters, which drain to the street,
grading the lot to drain toward the street, or grading perimeter swales and directing
them into the pond or street. Lots that will naturally drain into the system are not
required to provide these measures.
h. Built -upon area in excess of the permitted amount will require a permit
modification.

If permeable pavement credit is requested, the property owner must submit a
request, with supporting documentation, to the permittee and receive approval prior
to construction of BUA.
18. A copy of the recorded deed restrictions must be submitted to the Division within 30 days
of the date of recording the plat, and prior to selling lots. The recorded copy must contain
all of the statements above, the signature of the Permittee, the deed book number and
page, and the stamp/signature of the Register of Deeds.
19. Prior to transfer of the permit, the stormwater facilities will be inspected by DEMLR
personnel. The facility must be in compliance with all permit conditions. Any items not in
compliance must be repaired or replaced to design condition prior to the transfer. Records
of maintenance activities performed to date will be required.
20. If permeable pavement credit is desired, the permittee must submit a request to modify the
permit to incorporate such language as required by the Division of Energy, Minerals and
Land Resources. The request to modify must include a soils report identifying the type of
soil, the Seasonal High Water Table elevation and the infiltration rate. Upon the successful
completion of a permit modification, the individual lot owners that request to utilize
permeable pavements must submit the necessary forms and documentation to the
permittee and receive approval prior to construction of the permeable pavement.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director. In the
event of a change of ownership, or a name change, the permittee must submit a
completed Name/Ownership Change form signed by both parties, to the Division of
Energy, Minerals and Land Resources, accompanied by the supporting documentation as
listed on page 2 of the form. The approval of this request will be considered on its merits
and may or may not be approved.
2. The permittee is responsible for compliance with all permit conditions until such time as
the Division approves a request to transfer the permit.
3. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to enforcement action by the Division of Energy, Minerals and Land Resources,
in accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances, which may be imposed by other government
agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
as may be required by this Division, such as the construction of additional or replacement
stormwater management systems.
6. The permittee grants DENR Staff permission to enter the property during normal business
hours for the purpose of inspecting all components of the permitted stormwater
management facility.

7. The permit issued shall continue in force and effect until revoked or terminated. The permit
may be modified, revoked and reissued or terminated for cause. The filing of a request for
a permit modification, revocation and re -issuance or termination does not stay any permit
condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater control
must follow the guidelines established in the North Carolina Erosion and Sediment Control
Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.
10. The issuance of this permit does not prohibit the Director from reopening and modifying
the permit, revoking and reissuing the permit, or terminating the permit as allowed by the
laws, rules and regulations contained in Session Law 2006-246, Title 15A NCAC 2H.1000,
and NCGS 143-215.1 et.al.
11. The permittee shall notify the Division in writing of any name, ownership or mailing
address changes at least 30 days prior to making such changes.
12. The permittee shall submit a permit renewal application at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate
documentation and the processing fee.

SUBMISSION REQUIREMENTS
The application will be regarded as incomplete until the following items are received by Planning & Zoning.
Your application must include a $300.00 fee and 15 folded maps of the proposed Performance Residential Development.
This fee should be payable to New Hanover County and must accompany this application. Applications for Performance
Residential Development are received and acted upon by the County's Technical Review Committee. Planning & Zoning
staff will send a copy to each appropriate agency. Written agency comments must be received three (3) weeks prior to
the meeting before being placed on the TRC agenda.
1. Streets - Written comments from the North Carolina Department of Transportation approving the design of all public
streets or a letter from the County Engineer approving the design of all private streets.
2. Water and Sewer- A letter from the appropriate Slate or local health agency approving the design of such systems and
commitment allocation to serve the project.
3. Drainage- The location of all marshes, watercourses, ditches, drainage channels, with proposed drainage and utility
easements water and sewer for the proposed subdivision.
4. A letter from the Soil Conservation Service indicating any acreage from Class 1V soils on the property.
5. A letter from County Fire Services approving fire hydrant location and street design.
6. You are encouraged to arrange an informal conference with planning staff at least two (2) weeks prior to
submitting an application. By attending this conference, you will improve your chances of submitting a complete
and acceptable application. You should bring a rough sketch of your proposal to this conference. Planning & Zoning
staff will proceed to advise you of environmental problems, point out significant design problems, describe the required
improvements, and advise you regarding the required approval letters for water and sewer. A checklist outlining these
requirements is available to help you through this process.

A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.
1. This completed and signed form. This certification must be completed and signed by both the
current permit holder and the new applicant if this is a change of ownership.
2. Legal documentation of the property transfer to a new owner.
3. A copy of any recorded deed restrictions, covenants, or easements, if required by the permit.
4. The designer's certification (DWQ Engineer and Designer Certification Forms are available from
each DWQ Regional office), if required by the permit and if not already submitted to DWQ.
5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. If this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.

Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in
our custody readily available to the public for review and copying. We also have the responsibility to the
public to safeguard these records and to carry out our day-to-day program obligations. Please read
carefully the following guidelines signing the form:
I. Due to the large public demand for file access, we request that you call at least a day in
advance to schedule an appointment to review the files. Appointments will be scheduled
between 9:00am and 3:00pm. Viewing time ends at 4:45pm. Anyone arriving without an
appointment may view the riles to the extent that time and staff supervision is available.
2. You must specify files you want to review by facility name. The number of files that you
may review at one time will be limited to five.
3. You may make copies of a file when the copier is not in use by the staff and if time permits.
Cost per copy is $.05 cents. There will be no fee if the total calculated charge is less than
$5.00. Payment may be made by check money order, or cash at the reception desk.
Copies can also be invoiced for your convenience.
4. FILES MUST BE KEPT IN ORDER YOU FOUNT) THEM. Files may not be taken from
the office. To remove, alter, deface, mutilate, or destroy material in one of these files is a
misdemeanor for which you can be fined up to $500.06. No briefcases, large totes, etc. are
permitted in the file review area.
5. In accordance with General Statue 25-3-512, a $25.00 processing fee will be charged and
collected for checks on which payment has been refused.

Do you know whether your developer has to accept all offsite flow from Wrightsboro Plaza? Or, is it just
the outparcels such as Advance Auto? Previously, they were going to handle all. However, I don't know
the reason why for sure. I suspect that it was because the current swale and wetlands situation was not
working well. Your thoughts?

Here is our plan for Riverside. First I will submit the ownership change form information to
you. Next 1 will begin a redesign of the project. The Layout and road network, number of lots
etc... will not change. However I hopefully will be able to make substantial changes to the
drainage network and pond design to make this job more economically feasible.
In regards to OFFSITE stormwater. We will be required to accept the offsite flow from the
Zimmer property. FYI this property is landlocked and our only access is through the Zimmer
property. It appears that the original developer had to agree to some demands. These demands
are bound within a contract that our developer has agreed to, at least if he wishes to develop the
property. I have spoken with the developer this morning and he has told me to move forward. I
still must talk to the original Engineer and get all the information I need to do a redesign. But
that is our direction as of today.

I look forward to hearing about your meeting with New Hanover County. As you probably know, it appears that the
current pond at Riverside was designed to handle the runoff from Wrightsboro Plaza. However, they already have a
treatment system, which is an alternate design system that uses a long swale and the natural wetlands to treat the
runoff. I feel that there will be substantial maintenance required of the current stormwater system for Wrightsboro
Plaza, so Zimmer may be interested in having their stormwater treated in the Riverside pond so they won't have to do
the maintenance on their current system. In addition, the Advance Auto, owned by Ronald Hughes, located north of
Wrightsboro Plaza definitely needs treatment for their runoff. We plan to do an inspection of the Wrightsboro Plaza in
the near future but we will wait to hear about your meeting first.

III. REQUIRED ITEMS
A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.
1. This completed and signed form. This certification must be completed and signed by both the
current permit holder and the new applicant if this is a change of ownership.
2. Legal documentation of the property transfer to a new owner.
3. A copy of any recorded deed restrictions, covenants, or easements, if required by the permit.
4. The designer's certification (DWQ Engineer and Designer Certification Forms are available from
each DWQ Regional office), if required by the permit and if not already submitted to DWQ.
5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. If this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.

Mr. Murphy:
I'm trying to clean up some loose ends regarding the old Wrightsboro Food Lion project. The Riverside
Development permit that was issued to you on January 5, 2009, included the Wrightsboro Food Lion as offsite
drainage area. However, it is my understanding that you are also the current owner of the Wrightsboro Food
Lion project.
If this is the case, please submit a permit modification to change the ownership of the facility, to initiate transfer
of the permit to you, and to change the permit type from high density to offsite.
I hope that you provided for a prorated sharing of the maintenance costs for the BMP's between all of the users
of the facility: Wrightsboro Plaza, the single family lots in Riverside and the multi -family part of Riverside. Has a
homeowner's association been formed to implement Riverside's deed restrictions and hopefully take over the
permit at some point in the future?
I don't recommend combining the Riverside and Wrightsboro Plaza permits as the Riverside development has
no control over the development at Wrightsboro Plaza.
The Riverside permit appears to have accounted for all the built -upon area within the Food Lion; the
outparcels, the future development Phase II area and several additional offsite areas at 100% impervious,
meaning that deed restrictions are a moot point.
I am getting ready to let the Autozone owner, Ron Hughes, know that his issue with drainage will be addressed
shortly, after 4 years, and that we can issue him a permit to use the offsite Riverside stormwater facility for his
project, which is part of Wrightsboro Plaza. However, prior to issuing Mr. Hughes' permit, I will need
confirmation from an appropriate designer that Pond #2 of Riverside has been constructed in substantial
conformity with the approved plans.
If you do not currently own the Wrightsboro Food Lion project, do you have any idea as to who the current
owner is? Thank you for taking the time to read all of this, thank you for taking care of the Wrightsboro Food
Lion runoff, and thank you for any information you can provide.

On January 5, 2009, the Wilmington Regional Office issued a Stormwater Management
Permit to you for Riverside. Per the requirements of the permit, a copy of the recorded
deed restrictions must be forwarded within 30 days of the date of recording.
Additionally, the permitted Best management Practices must be certified by an
appropriate design professional upon completion and prior to operation as a stormwater
treatment device. A review of our files indicates that, as of this date, neither a copy of
the recorded deed restrictions nor the required Designer's Certification has been
received in this Office.
Failure to provide the Designer's Certification and/or failure to record and/or provide a
copy of the recorded deed restrictions prior to selling lots is a violation of your permit,
and subject to enforcement action. Please forward a copy of the Designer's Certification
and a copy of the recorded deed restrictions to this Office at the address below by
September 9, 2010, or enforcement action may be initiated and may include
recommendations for civil penalties and revocation of the permit.
If construction has not taken place please advise the Division in writing. If you have any
