VAN DER VAART Secretary TRACY DAVIS Subject: Notice of File Review Inspection - Deficient and Request for Transfer of State Stormwater Management Permit Lucky Fish Subdivision Stormwater Management Permit No: SW8 060429 New Hanover County Dear Mr. Capps: Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for issuance of the permit. On November 5, 2015, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) conducted a file review of Lucky Fish Subdivision in New Hanover County. The project is currently operating under Stormwater Management Permit Number SW8 060429 modified and reissued on August 9, 2012, and currently set to expire on August 9, 2020. Please note that the access road is part of the lot — it is only contained in an access easement. The previously recorded deed restrictions limited the BUA to 4,300 sf for each lot. However, this amount did not match up with the permit, which was issued under the premise that the road up to the centerline was part of the permitted BUA for the lot. The deed restrictions were corrected and amended in April 2013 to include the -built -upon area for -the road as part of the maximum -- allowed BUA limit. The recorded amendment filed on April 23, 2013 indicates that as the Declarant in control of the Board, you had the right to clarify, restate, replace and supersede the recorded amendment from May 9, 2011, even though you only owned one of the seven lots at the time. The Division notes that the corporation's mailing address has changed. The mailing address provided on the June 29, 2012 permit application for Lucky Fish Subdivision is PO Box 29089 in Greensboro, NC. The latest annual report filed with the NC Secretary of State indicates that your mailing address is now 5908 Tamannary Drive, Greensboro. Please note that it is your responsibility to keep the Division apprised of any changes in your mailing address. If you do not respond to letters from the Division because you have not kept us apprised of your mailing address changes, then the Division may have grounds for revoking the permit. If the property covered by this permit has been or will be sold or legally transferred to another entity such as the HOA, or, if the project or permit holder has changed its name and/or mailing address, it is your responsibility as the permittee to submit a completed and signed Name/Ownership change form to DEMLR at least 30 calendar days prior to making those changes. However, the Division has not yet received your request to transfer the associated state stormwater management permit. Please be reminded that the permit does not automatically convey to the Association with the conveyance of the common areas. You must request a transfer of the permit and receive approval from the Division. The permit can be transferred to a Homeowners Association if the requirements of Session Law 2011-256 have been met. These requirements are: The subdivision was made subject to the requirements of Chapter 47F, aka the Planned Community Act. The permittee has submitted a completed and signed HOA Permit Transfer document, The permittee has submitted a copy of the recorded deed conveying the common areas of the subdivision to the Association; A determination by the Division that the project is in compliance with the permit. This determination must be made no more than 90 days prior to the transfer. Documents that the permittee needs to submit in order for the Division to make that determination of compliance include: a. A copy of the designer's certification for any permitted BMP's; b. A copy of the recorded deed restrictions limiting the BUA on each lot; (if required by the permit); c. Verification that the permitted maximum built -upon area per lot has not been exceeded. The permittee's review records, tax records and surveys can be used for this; d. Verification that more than 50% of the lots have been conveyed to individuals. Copies of the deeds of conveyance are acceptable. Where there are many lots, the permittee may create a chart with the lot number, lot address, owner's name, conveyance date and deed book and page number. e. Verification that the Association is registered with the NC Secretary of State and that all of the contact information and registered agent information is up to date. In a separate matter regarding the August 9, 2012, modified permit, it appears that a residential high density subdivision permit template was not used. A corrected high density residential subdivision permit that stipulates the maximum built -upon area per lot and that requires deed restrictions to be recorded will follow shortly to replace the current permit. Please provide the remaining requested information before February 1, 2016, Failure to provide the requested information, or to respond to this letter by the due date, are considered violations of the permit. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is subject to enforcement action as set forth in NCGS 143, Article 21, including the assessment of civil penalties of up to $25,000 per day. I am sorry that the result is not what you were hoping for. I am copying Jim lanucci on this email in the hopes that we can resolve the BLIA per lot issue. After you left the office, I did a bit of research. I am attaching a copy of the March 12, 2012 Notice of Inspection (2 parts) that should explain some of the history and deficiencies with this project. The developer recorded the original restrictions on May 9, 2011 (DB 5562 PG 723) which contained a blanket restriction of 4300 square feet for every lot, but the permit was not written that way. We began the process of getting the permit modified to address the deficiencies by issuing the Notice of Inspection - Not Compliant. The permit was modified on August 9, 2012. The developer filed an amendment to the recorded deed restrictions on April 23, 2013 (DB 5730 PG 698) which limited each lot to the "proposed" amounts that you saw listed on the cover sheet of the approved plans. That proposed amount for Lot 3B is 5899 sf which is comprised of 4300 sf within the lot and 1599 sf for the street in front of your lot. Your deed for Lot 3B was recorded on March 16, 2012, so it fell subject to the May 9, 2011 deed restrictions. Mr. Capps had the required 2/3 rds majority needed to amend the covenants in 2013 without the signature of anyone else, so one could argue that the amended covenants apply to your lot. Regardless, the bottom line is that the 4300 sf is mentioned in both documents for your lot. Please note that the developer conveyed the common areas of the subdivision to the Lucky Fish Subdivision HOA on May 1, 2013 (DB 5733 PG 785), however, the Division has not received a request to transfer the stormwater permit from Mr. Capps. The permit remains in the name of GCW Properties, I.I.C. The conveyance of the common area does NOT constitute a transfer of the permit. Please also note that under the terms of Session Law 2011-256, the developer can transfer the permit to the HOA without the signature or approval of the HOA upon receipt of a signed request to transfer the permit along with copies of all the necessary documents, and as long as the project is in compliance with the permit. This is a Violation of the existing NHC Stormwater Authorization -to -Construct permit. You, as the owner of the permit, are responsible for providing a plan of action that brings the project to a condition where it reflects the approved plans or modify the plans and resubmit all necessary plans and calculations for a plan revision approval. If a plan revision approval is necessary, please provide up to date plans, showing the existing conditions and all proposed revisions. Please also provide an explanation of revisions and supporting calculations that demonstrate how the revisions to the approved plan are adequate to convey and store the storm water mnoff to the same extent as the approved plan. His recorded deed restriction indicated it was 4,300 sf, but the permit allocated 5,100 square feet. A search of the New Hanover County Register of Deeds website and New Hanover County Tax Records website was conducted, but no documents were recorded under the name Vineyard at Pages Creek. It was subsequently discovered that the subdivision name had been changed to Lucky Fish Subdivision, and that the deed restrictions recorded for Lucky Fish Subdivision on October 25, 2006, in Deed Book 5097 at Page 298, and the Amended Declaration recorded on May 9, 2011 in Deed Book 5562 at Page 723 did incorrectly allocate 4,300 square feet per lot. This amount results in a density that exceeds the 25% overall maximum for the subdivision. The Division contacted you regarding this deficiency and the process of resolving the situation has been initiated. As part of the permit modification process, Linda Lewis with the Division of Water Quality conducted a compliance inspection of the site on March 6, 2012. The results of the inspection are attached. The overall low density project is only out of compliance because of the incorrect BUA limits that were recorded. Although only 1 lot is currently built on, and 1 home is in the process of being designed, it is my understanding that you have made certain representations to two other potential lot purchasers and you do not want to jeopardize those sales by changing those built -upon area limits, therefore, your only option is to modify the project to high density. Please submit the following information as part of the modified application: 1. There is a system of grassed swales, infiltration trenches and dry detention basins that were permitted through New Hanover County. If you plan on using these BMP's as the state permitted BMP's for this high density project, please either restore or redesign the dry detention basin and outlet structure on Lot 3A, which appear to have been filled in. 2. The existing BMP's must be certified by an appropriate designer that they were installed to the elevations, grades and sizes per the County's approved plans. Since you are not willing to retrofit an offline bypass, and there is no room for a vegetated filter, sealed design calculations must be provided which demonstrate that the system can deliver and infiltrate the 10 year 24 hour storm volume from the site without discharging. 3. Please include a soils report based on the borings from an actual field visit. The SHWT must be a minimum of 2 feet below the bottom of the infiltration system, and the hydraulic conductivity of the soil must be a minimum of 0.52 inches per hour. A much higher infiltration rate will be needed in order to infiltrate the 10 year 24 hour volume without discharging.
