Hi Faith,
Thank you so much for your response! I have been trying to reach Mr. Helmick at the email address on the letter with no
luck and unfortunately, we can only have these applications in house for so long under review before we must return
the project and the fee that was submitted with the application is accepted. This project is wayyyy past the timeline and
should have been returned a while ago but I decided to give it one more try so I am happy to hear from you!
On August 30, 2021, our office received and accepted a stormwater permit renewal application and $505.00 processing
fee for the subject project signed by a Mr. James Helmick. During review, I did not have all information to complete my
review and issue a permit. Additional information was requested in September, February, and June for this project.
Stormwater renewal projects are by rule only allowed to be in review for 30 days and/or allowed 2 requests for
additional information. As you can tell, both of these circumstances are way overdue.
What I need to issue the permit are two things: an original, hard copy signed application (I have attached this application
for you). The one our office received is a copy and unfortunately cannot be processed. The other item I need is official
documentation that Mr. Helmick is indeed the President of Ashcroft at the Commons POA usually reflected by the North
Carolina Business Registration on the Secretary of State. Being a PDA, I understand that a yearly report is not required to
be submitted by the PDA, so I will accept a copy of the meeting minutes stating the position held by Mr. Helmick.
The June request for additional information has a due date of today. Because I appreciate the acknowledgement of the
letter, I will grant an extension until Friday June 17" to have the additional information received by our office (or at least
let me know if it has been in the mail). If I do not, unfortunately I will have to issue a return of the renewal application I
do have, the initial $505.00 fee will be forfeited and to reapply a new application and fee will have to be submitted.

of that information has determined that the application is not complete and that additional information is needed.
To continue the review, please provide the following additional information in a single, hard copy submittal

1. Our office must have a hard copy, original signature on all documentation. The signature on the
application that was submitted on August 30, 2021 is a copy. Please send resubmit an application with an
original signature to our Wilmington Regional office.
2. 15A NCAC 02H.I040(I)(a):.The application was signed by James Helmick; however the provided
documentation from the NC Secretary of State does not identify Mr. Helmick as a president or vice
president of this corporation. In the case of a corporation, the application must be signed by a principal
executive officer of at least the level of vice-president. Please:
a. Provide official documentation showing that Mr. Helmick is a president or vice-president and
authorized to sign for the corporation.
Please remember to confirm that any revised information is presented consistently throughout the application
documents. Please also remember to provide a hard copy of any updated documents per 15A NCAC

On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that is set to expire during this time frame to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-
177 which grants an extra year for a total of four (4) years extension.
Accordingly, Stormwater Permit # SW8 000505 which has already expired on August
16, 2010, is now in effect until August 16, 2014. Please resubmit the renewal
application and fee at least 180 days prior to August 16, 2014, which would be February
16, 2014. A copy of the Renewal Application can be obtained from the following
website: http://portal.ncdenr.org/web/wq/ws/su/statesw/forms_docs.
