Explain the purpose of the proposed project: * The purpose of the proposed project will consist of the construction of a mixed density residential development and associated infrastructure in 7 phases to meet the existing and growing demand for residential housing in Wake County. The project is phased; however, impacts for all phases are being requested at this time. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * The project consists of the construction of the following: •436 single-family detached home lots •82 single-family attached units •381 townhome lots • 117 acres of open space • Construction of infrastructure (roads, greenways, utilities, stormwater management, etc.) The proposed design for the roads will result in two stream crossings. "Street S" will cross Stream 6 perpendicularly with a culvert. "Street P" will connect to Buffaloe Road by crossing Stream 2. Riprap dissipaters will be constructed below the culverts to dissipate flow velocity to prevent erosion and sedimentation of the streams. Additional impacts are proposed for one greenway trail crossing, a wetland impact due to site grading, required widening of Buffaloe Road, and offsite water and sewer force main extensions. The internal gravity sewer will be installed using conventional open trenching methodology. Temporary impacts for internal sewer lines are proposed for one stream crossing and wetland conversion impacts. Typical construction equipment and techniques will be utilized during construction. 5. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Proposed permanent impacts for construction of the subdivision and infrastructure have been minimized to only those necessary for construction of two road crossings to access developable uplands within the site and create connectivity to existing roads. There are no impacts proposed for construction of lots. All road crossings have been designed to cross streams perpendicularly to minimize impacts to streams and riparian buffers. Riprap dissipators will be constructed at road crossings such that the riprap will be installed by burying the riprap such that the top of the riprap matches the pre -construction contours of the natural stream bed, allowing for the passage of aquatic life and preventing a loss of function of stream channel. Upon completion of construction, all temporarily impacted streams will be restored to pre -construction conditions and grades, and temporarily stabilized with biodegradable matting and buffers will be seeded with a riparian seed mix. No matting will be placed on the stream bed. The internal gravity sewer was designed to minimize impacts to wetlands and stream by locating the sewer line within uplands and roads where possible. Where wetland and stream crossings could not be avoided, the alignments have been designed to cross wetlands, streams, and buffers perpendicularly to the extent possible. Impacts to riparian buffers have been minimized to the greatest extent possible. The proposed riparian buffer impacts will occur from construction of the road crossings, required road widening, utilities and SCM outlets. Sewer line construction has been designed to minimize Zone 1 impacts wherever possible. Buffer impacts for the sewer lines could not be entirely avoided due to topography and the need to install gravity sewer. All proposed riparian buffer impacts are for uses are classified as "deemed allowable", "allowable upon authorization" or "allowable with mitigation" in the Neuse River Riparian Buffer Rules' Table of Uses. lb. WR reviewed the NC Natural Heritage Program (NCNHP) database, located at https://ncnhde.natureserve.org/, as well as NCNHP GIS data to identify if there were any known occurrences of endangered species on or near the proposed project. The review of the NCNHP data did not identify any recent occurrences of federally listed threatened or endangered species or critical habitat on the subject property or within 1.0 miles of the project, see attached NCNHP project review letter. WR received a concurrence letter from the USFWS on January 3, 2022. USFWS indicated the proposed project was not likely to adversely affect any federally -listed endangered or threatened species, their formally designated habitat, or species currently proposed for listing. Please see attached USFWS letter. 6. Essential Fish Habitat (Corps Requirement) 6a. Will this project occur in or near an area designated as an Essential Fish Habitat?* Yes No 6b. What data sources did you use to determine whether your site would impact historic or archeological resources?* In April 2021, WR submitted a SHPO request review for the site. It was noted that multiple structures were present within the project area. Additionally, a gravesite was found within the eastern portion of parcel 1. The project is planned to be designed around the gravesite. SHPO issued a comment letter on June 11, 2021, that mentioned a 2013 survey which uncovered six archaeological sites and the Watkins Cemetery in the project area. SHPO did not recommend any further work for the archeological sites however, the cemeteries are protected under state law. Since the Watkins Cemetery contains additional gravesites marked with fieldstones and due to the possibility for unmarked graves, SHPO recommended an archaeological delineation of the cemetery be conducted. Terracon Consultants coordinated with SHPO to establish the survey area and protocol and then conducted a Phase 1 archeological survey for the project and identified 7 new archeological sites. In a letter dated September 9, 2022, SHPO agreed with Terracon's recommendation that the sites should not be considered eligible for listing in the NRHP. Therefore, the proposed project will not result in impacts to archeological, historic or cultural resources. The SHPO final comment letter has been provided as an attachment. 8. Your Success - We are also requesting an NC DWR Riparian Buffer Authorization for 104,652 sf of permanent buffer impacts for construction of the proposed subdivision (40,678 sf Zone 1, 63,974 sf Zone 2) The proposed project consists of the construction of a 936-lot mixed -density residential subdivision and associated infrastructure (roads, sidewalks, open recreational space, utilities, stormwater management, etc.). The proposed River Towne subdivision consists of four parcels (PINS: 1756421236, 175641190, 1756410428, 1756309588) located at 8301 Buffaloe Road in Knightdale, Wake County (Lat: 35.843044°N;-78.479931°W). The project site is ±307 acres. The project is in the Neuse River basin (HUC: 03020201) and onsite waters drain to Hodges Mill Creek. The Water Quality Classification for Hodges Mill Creek is: Class C; NSW and the Stream Index Number is: 27-26-1-(2). Proposed Project The purpose of the proposed project will consist of the construction of a mixed density residential development and associated infrastructure in 7 phases to meet the existing and growing demand for residential housing in Wake County. The project is phased; however, impacts for all phases are being requested at this time. The project consists of the construction of the following: • 436 single-family detached home lots • 82 single-family attached units • 381 townhome lots • 117 acres of open space • Construction of infrastructure (roads, greenways, utilities, stormwater management, etc.) The proposed design for the roads will result in two stream crossings. "Street S" will cross Stream 6 perpendicularly with a culvert. "Street P" will connect to Buffaloe Road by crossing Stream 2. Riprap dissipators will be constructed below the culverts to dissipate flow velocity to prevent erosion and sedimentation of the streams. Additional impacts are proposed for one greenway trail crossing, a wetland impact due to site grading, required widening of Buffaloe Road, and offsite water and sewer force main extensions. The internal gravity sewer will be installed using conventional open trenching methodology. Temporary impacts for internal sewer lines are proposed for one stream crossing and wetland conversion impacts. Project History WR conducted a delineation of the wetlands, streams, and riparian buffers in January 2021. WR received a concurrence letter from the USFWS on January 3, 2022. USFWS indicated the proposed project was not likely to adversely affect any federally -listed endangered or threatened species, their formally designated habitat, or species currently proposed for listing. An emailed concurrence letter was received from the USACE on January 4, 2022. See attached concurrence letter and delineation exhibit. NC DWR issued a Neuse River Riparian Buffer Determination Letter (NBRRO # 21-247) on August 27, 2021, which has been provided as an attachment. It was noted that multiple structures were present within the project area. Additionally, a gravesite was found within the eastern portion of parcel 1. The project is planned to be designed around the gravesite. SHPO issued a comment letter on June 11, 2021, that mentioned a 2013 survey which uncovered six archaeological sites and the Watkins Cemetery in the project area. SHPO did not recommend any further work for the archeological sites however, the cemeteries are protected under state law. Since the Watkins Cemetery contains additional gravesites marked with fieldstones and due to the possibility for unmarked graves, SHPO recommended an archaeological delineation of the cemetery be conducted. Terracon Consultants coordinated with SHPO to establish the survey area and protocol and then conducted a Phase 1 archeological survey for the project and identified 7 new archeological sites. In a letter dated September 9, 2022, SHPO agreed with Terracon's recommendation that the sites should not be considered eligible for listing in the NRHP. Therefore, the proposed project will not result in impacts to archeological, historic or cultural resources. The SHPO final comment letter has been provided as an attachment. Temporary stream impacts are also proposed for rip rap dissipators and construction/dewatering at the crossings. A single temporary stream impact is proposed for installation of the gravity sewer line. "Street S" will cross Stream 6 perpendicularly with a culvert. "Street P" will connect to Buffaloe Road by crossing Stream 2 perpendicularly. The 42" RCP culvert under "Street S" is proposed to be buried 10.5" and the 54" RCP culvert under "Street P" will be buried 12" below the stream bed to allow for aquatic life passage. Riprap dissipators will be installed below the culverts to prevent erosion and sedimentation of downstream waters. The riprap will be installed by burying the riprap such that the top of the riprap matches the pre -construction contours of the natural stream bed, allowing for the passage of aquatic life and preventing a loss of stream function. A stormwater culvert extension is proposed due to required widening of Buffaloe Road which will result in a permanent stream impact. No other stream impacts are proposed for the project. Permanent wetland impacts are necessary at both road crossings, a short segment of greenway trail where the trail crosses Stream 3 and Wetland M, widening of Buffaloe Road, and site grading impacting Wetland G. Temporary wetland impacts are proposed for a portion of a boardwalk crossing and installation of gravity sewer. Offsite sewer line installation along Old Crews Road will result in temporary wetland impacts; however, the line will be installed in the existing cleared right of way adjacent to the road. The remainder of the temporary wetland impacts are those for sewer line installation (permanent conversion impacts). Permanent buffer impacts are proposed for four SCM outfalls, the two road crossings mentioned previously, one greenway boardwalk/trail crossing, road widening, and installation of gravity sewer lines. Some temporary buffer impacts are necessary for one road crossing and for the installation of sewer and water lines within the existing and cleared right of way along Old Crews Road and Buffaloe Road. Additionally, 1,285 sf of temporary buffer impacts are proposed within the construction easement for the gravity sewer. The installation of the onsite utilities (gravity sewer & water) will be installed using traditional methods and all stream and wetland impacts associated with the installation of the utilities will be temporary. Some unavoidable impacts to buffers will result from sewer installation. The utility easements will be mowed/maintained through the wetlands and buffers in perpetuity, resulting in 0.488 acres of permanent wetland conversion impacts and 104,652 sf of permanent buffer impacts. Your Success - During construction of the culverted road crossing, sewer crossings, work will be completed "in the dry" by constructing temporary coffer dams upstream and downstream of the culverts as needed within the impact areas and pumping flow around the construction area. Upon completion of construction, all temporarily impacted streams and buffers will be restored to pre -construction contours and the banks will be stabilized using a biodegradable matting and seeded with a riparian seed mix. No matting will be placed on the stream beds. Additionally, all temporarily impacted wetlands will be restored to natural grade and seeded with a wetland seed mix to provide temporary stabilization until natural revegetation permanently stabilizes these areas. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Proposed permanent impacts for construction of the subdivision and infrastructure have been minimized to only those necessary for construction of two road crossings to access developable uplands within the site and create connectivity to existing roads. There are no impacts proposed for construction of lots. All road crossings have been designed to cross streams perpendicularly to minimize impacts to streams and riparian buffers. Riprap dissipators will be constructed at road crossings such that the riprap will be installed by burying the riprap such that the top of the riprap matches the pre -construction contours of the natural stream bed, allowing for the passage of aquatic life and preventing a loss of function of stream channel. Upon completion of construction, all temporarily impacted streams will be restored to pre - construction conditions and grades, and temporarily stabilized with biodegradable matting and buffers will be seeded with a riparian seed mix. No matting will be placed on the stream bed. The internal gravity sewer was designed to minimize impacts to wetlands and stream by locating the sewer line within uplands and roads where possible. Where wetland and stream crossings could not be avoided, the alignments have been designed to cross wetlands, streams, and buffers perpendicularly to the extent possible. Impacts to riparian buffers have been minimized to the greatest extent possible. The proposed riparian buffer impacts will occur from construction of the road crossings, required road widening, utilities and SCM outlets. Sewer line construction has been designed to minimize Zone 1 impacts wherever possible. Buffer impacts for the sewer lines could not be entirely avoided due to topography and the need to install gravity sewer. All proposed riparian buffer impacts are for uses are classified as "deemed allowable", "allowable upon authorization" or "allowable with mitigation" in the Neuse River Riparian Buffer Rules' Table of Uses. Buffer Mitigation There are eight (8) buffer impacts which are "allowable with mitigation upon authorization." Six of these impacts are B3, B8, B12, B14, B15, and B16 all of which are non -perpendicular sewer line impacts where mitigation is required for Zone 1 impacts. Permanent buffer impacts B2, B11, and B13 are also non -perpendicular sewer line impacts but do not require mitigation because there are no Zone 1 impacts. Impacts B9 and B23 are perpendicular sewer crossings that have a construction corridor of less than or equal to 40 linear feet and a permanent maintenance corridor equal to or less than 30 and therefore are considered "Deemed Allowable." Impact B5 requires mitigation for a road crossing that permanently impacts greater than a third of an acre of riparian buffer. Similarly, impact B18 also impacts greater than one third of an acre of riparian buffer. SCM outlet impacts (131, B6, B7, and B17), are "Deemed Allowable" impacts as these are considered new drainage conveyances from primary SCM's. Impact B4 for a greenway trail is an "Allowable" activity. Impact B19 for required road widening of Buffaloe Road is also an "Allowable" impact. Lastly, permanent impacts B20 and B22 are "Deemed Allowable" and are located largely within the existing road ROW and are being included for clarity. Note that only an extremely small Zone 2 impact will occur for impact B20 that is outside the ROW. Impact B22 is similar to B20 however the small area outside the ROW impacts both Zone 1 and Zone 2. An erosion and sedimentation control plan should be submitted to and approved by the North Carolina Division of Land Resources, Land Quality Section prior to construction. Erosion and sedimentation controls should be installed and maintained between the construction site and any nearby down -gradient surface waters. In addition, we recommend maintaining natural, vegetated buffers on all streams and creeks adjacent to the project site. The North Carolina Wildlife Resources Commission has developed a Guidance Memorandum (a copy can be found on our website at (http://www.fws.gov/raleigh) to address and mitigate secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality. In 2013, an archaeological reconnaissance survey identified six archaeological sites (31WA1798 — 31WA1803) and the Watkins Cemetery (31WA1804) in the project area. None of the identified archaeological sites are eligible for listing in the National Register of Historic Places, and no further work is recommended in association with them. However, cemeteries are protected under North Carolina General Statutes Chapter 14-148 and 14-149 and are afforded consideration under NCGS Chapters 65 and 70. The Watkins Cemetery contains one engraved stone marking the burial of Mollie Watkins. An archaeological reconnaissance survey identified another burial marked with fieldstones adjacent to the grave of Mollie Watkins, and it is possible that additional graves without markers are present in the cemetery. We recommend that archaeological delineation of the cemetery be undertaken, including use of ground penetrating radar as appropriate. Alternately, a cemetery avoidance plan may be developed such that the portions of the subject project area with potential for containing unmarked graves are excluded from development, inclusive of an appropriate buffer area. The cemetery delineation report or avoidance plan should be forwarded to this office for review and comment prior to any ground disturbing activities within the project area. Please note that our office now requests consultation with the Office of State Archaeology Review Archaeologist to discuss appropriate field methodologies prior to the archaeological field investigation.
