Demonstration of Need for a Variance The variance provision of the riparian buffer rules allows the Division or the Environmental Management Commission to grant a variance when there are practical difficulties or unnecessary hardships that prevent compliance with the strict letter of riparian buffer protection 1 Explain how complying with the provisions of the applicable rule would prevent you from securing a reasonable return from or make reasonable use of your property Merely proving that the variance would permit a greater profit from the property shall not be considered adequate Justification for a variance The Division will consider whether the variance is the minimum possible deviation from the terms of the applicable Buffer Rule that shall make reasonable use of the property possible The Dr Martin Luther King, Jr Memorial Gardens was originally constructed in 1990 through the efforts of a number of park advocates including the Martin Luther King Committee In 2003, the City acquired 167 acres of vacant land adjacent to the park for the purpose of expanding the existing Memorial Gardens The additional amenities are intended to make the park more user and family- friendly through better meeting the needs of the visiting public, including school children, college students and elderly citizens The site contains moderately sloping terrain that makes it difficult to provide accessible routes to all proposed facilities without grading and locating some necessary site improvements in zone 2 of the Neuse River Buffer The property is pinched in the middle of the site with the buffered stream on one side and the Martin Luther King, Jr Blvd right -of -way on the other There are future plans to widen Martin Luther King, Jr, Blvd and therefore expand the right -of -way at that time, which would further restrict the property In order to maintain accessible vehicular and pedestrian circulation throughout the site that meets fire /emergency access requirements, we must encroach somewhat into zone 2 of the Neuse River Buffer It should be noted that we will be removing a significant area of existing impervious material in zone 1 and 2 and restoring the buffer in FORM VAR 10 -2013 Page 5 of 6 2 Explain how the hardship results from application of the Buffer Rule to the property rather from other factors such as deed restrictions or other hardships (e g zoning setbacks, floodplains, etc) Initially it was thought that the subject "feature" was merely a drainage conveyance However, since it maintains a constant flow of water we have re- designed the site to remove as much impervious area as possible from the Neuse River Buffer, while maintaining the intended program areas of the facility Explain how the hardship results from physical nature of the property, such as its size, shape, or topography, which is different from that of neighboring property This is a very small site for a public park The total acreage of the site is roughly 2 acres with the Neuse River Buffer located in the middle of the site thereby providing a hardship in keeping all of the planned facilities accessible and consistent with the Council Approved publicly vetted park master plan that was the result of a year -long process including input from the local MLK 4 Explain whether the hardship was caused by the applicant knowingly or unknowingly violating the applicable Buffer Rule The hardship was not caused by any knowing violation of the applicable buffer rule The Neuse River Buffer Rule was not in place during the first phase of development (the existing memorial gardens) For Neuse, Tar - Pamlico, Jordan Lake and Goose Creek only: Did the applicant purchase the property after the effective date of the applicable Buffer Rule and then request a variance? No Phase one of the memorial gardens was completed prior to the effective date of the applicable buffer rule However, in 2003 the City acquired 167 acres of vacant land adjacent to the park for the purpose of expanding the existing memorial 6 Explain how the hardship is rare or unique to the applicant's property, rather than the result of conditions that are widespread The location of the Neuse River Buffer in the middle of a very small site creates a unique hardship for a facility that was completed prior to the effective date of the applicable buffer rule F.
