Previously, a Pre - Construction Notification (PCN) application was submitted on December 2, 2014 for this
project During the review of the project with the Town of Apex, an easement acquirement became an
issue for the applicant Therefore, the project designers had to re- design the utility connection on the
eastern side of the project The proposed impacts for utilities have been modified and are included within
this updated PCN application_ Through conversation with James Lastmger and Chern Smith, the
submittal process for updated PCN application has been minimized.` James Lastinger indicated that he
would accept an electronic version of the updated PCN, Cherri-Smith indicated that only two (2j copies
were necessary, no new versron # should be applied upon receipt of updated PCN application, and no "

application: Existing conditions consist of a site that was partially graded and remaining wooded land to the southeast.
The southeastern corner of the property is bounded by Beaver Creek with two adjacent wetland areas. The general land
use in the vicinity of the project is rural residential.

development

The overall project consists of the construction of a 193 unit townhome community including all roads, utilities and
stormwater infrastructure. Specifics include one (1) stream crossing associated with a utility connection to an
existing offsite Sanitary Sewer manhole and easement, one (1) wetland impact to a wetland area located within an
existing, maintained utility corridor, and one (1) wetland impact necessary for a stormwater BMP and lot rill.
Equipment typically used for earthwork and construction such as backhoes, bulldozers, excavators, graders, pavers
etc. will be used.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
la _Specifically_describe measures taken to avoid or mirnmze_the proposed impacts in desigrnng_pn9ject.
The applicant contracted with S &EC to complete a wetland delineation and Jordan Watershed Buffer evaluation for the
entire property to identify the natural resources so that the project designers could design a site plan that would minimize
impacts to wetlands, streams and buffers to the maximum extent practicable The proposed project includes three (3)
impact areas to jurisdictional wetlands, streams and riparian buffers Impact #1A includes a wetland impact for lot
fill. This proposed impact will result in 0.011 acres of permanent wetland impact necessary for a 10' utility easement
located at the rear of the townhomes, and the fill slopes associated with a retaining wall These impacts have been
minimized by utilizing a retaining wall. Impact #1B includes a wetland impact for a stormwater facility. This
proposed impact will result in 0.088 acres of permanent wetland impact necessary for the construction of the
stormwater BMP and its outfall. Impact #2 includes a stream crossing necessary to provide sanitary sewer to the
development. This proposed impact will result in 118 linear feet of temporary perennial stream. Temporary impacts
include the open -cut and a coffer dam on the north side of impact, with a pump around to minimize sedimentation
downstream during construction. Post construction, the stream channel will be brought back to original elevation
and the banks will be stabilized Impact #3 includes a wetland impact necessary to connect to an existing manhole;
this impact is within an existing utility easement. This proposed impact will result in 0.016 acres of permanent, but
not a permanent loss (i.e. wetland conversion), of wetland impact. See attached photos Impacts include open -cut
construction activities The wetland area will be brought back to existing contours and re- vegetated with a wetland
seed mix post construction.
Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 18 & 29.
With respect to the minor discharges (NWP 18- Regional Conditions section 4.0) this NWP is not being used in
conjunction with a NWP 14 to create uplands. With respect to residential developments (NWP 29- Regional
Conditions section 4 0) the applicant is proposing impacts to a wetland for a stormwater facility, but is proposing
NWP 18 for those impacts; there are no impact associated with single- family recreation facilities, there are no
permanent wetland or stream tills proposed within the floodway/floodplain; the stream classification for this project is
WS -1V, NSW (i a not Outstanding Resource Waters, High Quality Waters, Coastal Wetlands or wetland adjacent to
these waters) and any riprap utilized will be placed only on the banks or below the original stream bed elevation.
1 b Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. In
addition to typical erosion control measures, the Erosion Control Plan includes cofferdams placed on the upstream side of
the sewer installation This will provide means by which the contractor can capture and divert stream flow around the
project area via pump around during construction. The effluent from the pump will be directed into a filter bad to minimize
sedimentation downstream of the construction area.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2 1 The draft
states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill,
most residential subdivisions and small commercial developments as well as agricultural and silvicu/tural operations. The
Hempstead at Beaver Creek project is a residential development The property is located within the Town of Apex
ETJ, therefore the adjacent properties that have potential for development will have the following regulations to
protect downstream waters 1) the Water Supply, Watershed Protection Program which limits development
densities as well as requires protective riparian buffers, 2) the Jordan Watershed Riparian Buffer Protection
regulations, these regulations require limited development within the riparian buffer area in addition to "diffuse flow"
requirements at a minimum, and could require Best Management Practices that control nitrogen if diffuse flow
cannot be achieved, and finally 3) the Phase l/ NPDES Stormwater Permit Program, this program includes
permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post- construction
stormwater management requirements. We anticipate that the DWR will advise us if any additional information is
needed.

EQUIPMENT, AND SIMILAR FACILITIES ON THE ROOF, GROUND
OR BUILDING SHALL MEET THE REQUIREMENT OF SECTION 8.2.8
OF THE LIDO. SPECIFICALLY SCREENING MUST BE DONE SO
THAT:
A) IT IS INCORPORATED INTO THE OVERALL DESIGN THEME
OF THE BUILDING AND LANDSCAPING.
B) SCREENING MATERIALS ARE NOT DIFFERENT FROM OR
INFERIOR TO THE PRINCIPAL MATERIALS OF THE BUILDING
OR LANDSCAPE AND ARE SIMILAR IN MATERIAL AND COLOR.
C) SCREENING ITEMS ARE OUT OF VIEW FROM ADJACENT
PROPERTIES AND PUBLIC STREETS, AND A TOTALLY OPAQUE
SCREEN IS ACHIEVED.
D) ANY GROUND -MOUNTED HVAC OR OT} -'ER MECHANICAL
OR UTILITY EQUIPMENT SIX -FEET TALL OR HIGHER MUST BE
