Dear Mr. Lastinger and Ms. Higgins,
On behalf of Standard Pacific of the Carolinas, LLC, we are requesting authorization from the USACE
to use NWP 29 for 0.437 acres of permanent wetland impacts, o.o66 acres of temporary wetland
impacts and 148 if of permanent stream impacts for construction of the proposed Lake Castleberry
residential subdivision. We are also requesting a 401 WQC from NCDWR for the above referenced
impacts.
The project is ±128 acres in size and is located in the southwestern quadrant of the intersection of
Green Level West Road and Wimberly Road in Apex, Wake County (Latitude: 35.764489°N;
Longitude: - 78.932961 1W). The project is located in the Cape Fear River basin and onsite waters
drain to White Oak Creek. The Water Quality Classification for White Oak Creek is WS- V;NSW;CA and
the Stream Index Number is: 16- 41- 6- (3.5). The cataloging unit forthe site is 03030002.
Proposed Project
The proposed project consists of construction of a 155 lot residential subdivision and associated
infrastructure (i.e. roads, utilities, stormwater management, etc) to meet the growing demand for
housing in Apex.
Project History
The Corps issued a formal Jurisdictional Determination (AID SAW -2013- 01277) for the Johnson
Assemblage project in September 2013, which comprises most of the proposed project area. A copy
of the JD has been provided as an Appendix.
The proposed project also incorporated two additional parcels (PIN 0723059640 — 5 acres & PIN
072315414 — 6 acres) that were not included in the original JD. W &R conducted a wetland
delineation for these additional parcels in July 2014. There were no wetlands on the additional
eastern parcel (PIN 072315414)• The wetland delineation for the additional northern parcel (PIN
0723059640) simply extended the limits of the Wetland A and Stream 1, which were approved under
the JD for Johnson Assemblage (SAW -2013- 01277). This parcel also contained a non - jurisdictional,
man -made pond constructed in uplands. There are no jurisdictional wetlands or waters between the

pond and Stream 1 to the west. The results of the wetland delineation and supporting
documentation have been provided as an Appendix.
The Town of Apex issued a Buffer Determination for the project on August 29, 2013. Impacts to
riparian buffers will be permitting through the Town of Apex as a delegated municipality.
Proposed Impacts
The proposed impacts consist of 0.437 acres of permanent wetland impacts, 0.066 acres of
temporary wetland impacts and 148 if of permanent stream impacts.
Of the proposed 0.437 acres of permanent wetland impacts, 0.209 acres of impact (Impacts 1, 3, 6,
11, 12, 13 & 14) will occur from construction of internal access roads and 0.257 acres of impact
(Impacts 2, 4, 5, 8, 9 & 10) will occur from construction of six residential lots.
The 148 if of permanent stream impacts will occur from construction of a road crossing needed to
access developable uplands on the east side of the stream which bisects the property.
The o.066 acres of temporary wetland impacts will occur from installation of a sewer line. Also,
please note that the entire 20' sewer easement will be maintained /mowed in perpetuity, resulting in
0.066 acres of permanent conversion impacts as a result of conversion from forested wetlands to
herbaceous wetlands.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and "waters" could be minimized.
Proposed permanent impacts have been minimized to only those impacts necessary to construct
roads to access developable uplands and the construction of 5 lots. Road crossings have been
designed to cross the wetlands at perpendicularly at the most narrow points where possible, and to
cross the stream at a perpendicular angle.
The culverted stream crossing at Impacts 13 & 14 will actually impact 2 separate streams and is
necessary to access developable uplands to the east. Impact 13 will occur to a small, unimportant
intermittent stream that is located entirely within the footprint of the road. Impact 14 will occur to a
perennial stream for installation of the 96" box culvert and dissipater. The alignment of this
crossing was determined based on two primary factors. First, a shift of the alignment to the north to
avoid Impact 13 would result in substantial additional wetland impacts. Also, the alignment could
not be shifted farther south to avoid Impact 13 would have impacted a significant meander in the
stream, resulting in additional stream impacts beyond what is currently proposed. Therefore, the
proposed alignment represents the minimization of stream and wetland impacts for a road crossing
at this location. The box culvert for this crossing will be installed 12" below the stream bed in order
to maintain aquatic life movement during periods of low flow.
Impacts 2, 4, 5, 8, 9 & 10 are necessary for construction of six residential lots (Lots 68, 77, 82, 83, 84
& 88). The proposed subdivision was originally approved at 160 lots. However, in order to minimize
impacts, the site plan was redesigned to 155 lots, resulting in a loss of 5 lots. The proposed 155 lots
represent the minimum number of lots needed to support development costs while maintaining a

feasible project. Please note that beyond the typical site development costs (i.e. land purchase
price, onsite infrastructure costs, grading costs, etc.), the project is also burdened with substantial
offsite improvements as well. Specifically, prior to construction of the proposed subdivision, the
applicant had to rehabilitate the 300 if dam of the ±17 acre Castleberry Lake in order meet current
dam safety measures to avoid a catastrophic failure of the dam. Also, as part of the site plan
approval, the Town of Apex is requiring the applicant to construct the following offsite
improvements:
• a satellite pump station with 9,000 if of 6" forcemain;
• a regional pump station with 3,600 if of 16" forcemain and 1,300 if of 16" gravity sewer
• 2,000 if of 8" waterline &
• 8,000 if of 12" waterline.
These improvements are being required to be constructed by the applicant as a direct cost to the
applicant, creating a financial burden in excess of $4 million on the proposed project that must be
offset by the lot yield of the subdivision. These offsite improvements have driven the per lot
construction cost to a point that the selling price of the lots is on the extreme upper end of what the
real estate market will support. The loss of any additional lots will increase the per lot construction
cost for the remaining lots, pricing the lots above what the real estate market will support and
potentially rendering the project unfeasible. Therefore, the proposed impacts from lot fill have been
minimized to the greatest extent possible while maintaining the minimum number of lots necessary
to sell the lots at a price point that the current real estate market will support.
It should be noted that the applicant has minimized impacts from lot fill where possible, such as the
use of retaining walls to stabilize lot fill on lots 54 & 86 (Sheet B) and the adjacent mail kiosk. The
proposed wetland impacts on lots 83 & 83 (Impact 5) are required both for the construction of the
lots and to elevate the lots above the adjacent bioretention basin (BMP #3) to prevent these lots
from being flooded in the event of BMP #3 overflowing during a storm event.
Furthermore, the proposed wetlands to be impacted for construction of lots 68, 77 & 82 consist of
small linear wetlands in crenulations whose hydrology is provided primarily by runoff from adjacent
uplands, with very little influence from groundwater fluctuations. These wetlands are already being
severed by road crossings, further decreasing the value of these wetland fingers. Additionally, the
Town of Apex's stormwater regulations require that all runoff from impervious areas be captured and
conveyed to BMPs for treatment prior to discharge. If direct impacts to these wetlands would have
been avoided by the site design, they would have been surrounded by lots, resulting in all runoff
being directed away from these wetlands and greatly reducing the drainage area and severing their
natural hydrologic source. As a result of the insufficient drainage area severely altering the
hydrology, the function of these wetlands would be secondarily impacted and eventually dry up and
become uplands. Therefore, the integrity and long term viability of these wetlands could not be
maintained in the post- development condition even if direct impacts would have been avoided. It
was determined that the functional value of these wetlands would be better served through the
provision of mitigation in a larger, significant wetland system within an EEP mitigation project.
It should also be noted that when subdivisions are designed to avoid direct impacts to these type of
wetland fingers, the removal of the surrounding forest and exposure to direct sunlight results in the
wetlands becoming overgrown with early successional invasive vegetation. This creates an
undesirable feature for the adjacent property owners, and often, the adjacent property owners will
eventually clear, fill or disturb these wetlands to eliminate perceived hazards such as snakes, as
well as protect their property values. These actions often result in violations if identified, or worse,

unmitigated loss of wetland function. The applicant is attempting to avoid these unmitigated
secondary impacts by addressing these issues with the permitting of proposed site design and
mitigating the functional loss in a regionally significant wetland system.
Mitigation

Since the proposed permanent stream impacts are less than 150 If, the applicant is not proposing
stream mitigation.
Wetland Mitigation
Based on the avoidance and minimization of impacts to the majority of wetlands on the site, the
applicant proposes to mitigate for the 0.437 acres of permanent wetland impacts through the
purchase of offsite mitigation credits at a 2:1 ratio. Therefore, the applicant proposes to purchase
0.90 acres of riparian wetland mitigation from EEP. A copy of the EEP Letter of Reservation has been
provided as an Appendix. Please note that mitigation banks servicing the project HUC were
contacted and did not have riparian mitigation available.
The applicant does not proposed mitigation for the o.006 acres of permanent conversion impacts
from the sewer crossing (Impact #7) since the permanent conversion impacts are less than o.10
acres.
The current request is for 0.437 acres of permanent wetland impacts, 0.066 acres of temporary
wetland impacts and 148 if of permanent stream impacts (see the attached maps and PCN for
details).

The culverted stream crossing at Impacts 13 & 14 will actually impact 2 separate streams and is necessary to access
developable uplands to the east. Impact 13 will occur to a small, unimportant intermittent stream that is located entirely within
the footprint of the road. Impact 14 will occur to a perennial stream for installation of the 96" box culvert and dissipater. The
alignment of this crossing was determined based on two primary factors. First, a shift of the alignment to the north to avoid
Impact 13 would result in substantial additional wetland impacts. Also, the alignment could not be shifted farther south to
avoid Impact 13 would have impacted a significant meander in the stream, resulting in additional stream impacts beyond what
is currently proposed. Therefore, the proposed alignment represents the minimization of stream and wetland impacts for a
road crossing at this location. The box culvert for this crossing will be installed 12" below the stream bed in order to maintain
aquatic life movement during periods of low flow.
Impacts 2, 4, 5, 8, 9 & 10 are necessary for construction of six residential lots (Lots 68, 77, 82, 83, 84 & 88). The proposed
subdivision was originally approved at 160 lots. However, in order to minimize impacts, the site plan was redesigned to 155
lots, resulting in a loss of 5 lots. The proposed 155 lots represent the minimum number of lots needed to support development
costs while maintaining a feasible project. Please note that beyond the typical site development costs (i.e. land purchase
price, onsite infrastructure costs, grading costs, etc.), the project is also burdened with substantial offsite improvements as
well. Specifically, prior to construction of the proposed subdivision, the applicant had to rehabilitate the 300 If dam of the ±17
acre Castleberry Lake in order meet current dam safety measures to avoid a catastrophic failure of the dam. Also, as part of
the site plan approval, the Town of Apex is requiring the applicant to construct the following offsite improvements:
• a satellite pump station with 9,000 If of 6" forcemain;
• a regional pump station with 3,600 If of 16" forcemain and 1,300 If of 16" gravity sewer
• 2,000 If of 8" waterline &
• 8,000 If of 12" waterline.
These improvements are being required to be constructed by the applicant as a direct cost to the applicant, creating a
financial burden in excess of $4 million on the proposed project that must be offset by the lot yield of the subdivision. These
offsite improvements have driven the per lot construction cost to a point that the selling price of the lots is on the extreme
upper end of what the real estate market will support. The loss of any additional lots will increase the per lot construction cost
for the remaining lots, pricing the lots above what the real estate market will support and potentially rendering the project
unfeasible. Therefore, the proposed impacts from lot fill have been minimized to the greatest extent possible while
maintaining the minimum number of lots necessary to sell the lots at a price point that the current real estate market will
support.
It should be noted that the applicant has minimized impacts from lot fill where possible, such as the use of retaining walls to
stabilize lot fill on lots 54 & 86 (Sheet B) and the adjacent mail kiosk. The proposed wetland impacts on lots 83 & 83 (Impact
5) are required both for the construction of the lots and to elevate the lots above the adjacent bioretention basin (BMP #3) to
prevent these lots from being flooded in the event of BMP #3 overflowing during a storm event.
Furthermore, the proposed wetlands to be impacted for construction of lots 68, 77 & 82 consist of small linear wetlands in
crenulations whose hydrology is provided primarily by runoff from adjacent uplands, with very little influence from groundwater
fluctuations. These wetlands are already being severed by road crossings, further decreasing the value of these wetland
fingers. Additionally, the Town of Apex's stormwater regulations require that all runoff from impervious areas be captured and
conveyed to BMPs for treatment prior to discharge. If direct impacts to these wetlands would have been avoided by the site
design, they would have been surrounded by lots, resulting in all runoff being directed away from these wetlands and greatly
reducing the drainage area and severing their natural hydrologic source. As a result of the insufficient drainage area severely
altering the hydrology, the function of these wetlands would be secondarily impacted and eventually dry up and become
uplands. Therefore, the integrity and long term viability of these wetlands could not be maintained in the post - development
condition even if direct impacts would have been avoided. It was determined that the functional value of these wetlands would
be better served through the provision of mitigation in a larger, significant wetland system within an EEP mitigation project.

It should also be noted that when subdivisions are designed to avoid direct impacts to these type of wetland fingers, the
removal of the surrounding forest and exposure to direct sunlight results in the wetlands becoming overgrown with early
successional invasive vegetation. This creates an undesirable feature for the adjacent property owners, and often, the
adjacent property owners will eventually clear, fill or disturb these wetlands to eliminate perceived hazards such as snakes, as
well as protect their property values. These actions often result in violations if identified, or worse, unmitigated loss of wetland
function. The applicant is attempting to avoid these unmitigated secondary impacts by addressing these issues with the
permitting of proposed site design and mitigating the functional loss in a regionally significant wetland system.
