Hello,
On October 05, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on‐hold until all of the following information is received:
1. The site plan received with your application is unclear and staff are unable to determine impacts to the
shoreline above and below the normal water level. Please provide a site plan showing the property
boundaries, structures (buildings, docks, impervious surfaces, etc.), location of the shoreline, location of
the impacts to the shoreline and/or lake bottom (excavation, dredging, rip rap, retaining walls, etc.), and
the location of any vegetated areas that will be impacted (construction access corridors, etc.). In most
cases the site plans do not have to be professionally prepared. The template located on pages 4‐5 of the

2. The application received for the subject project does not contain information regarding how work will be
conducted from the water. Please provide a description of how work will be conducted, including all
measures proposed to ensure compliance with NC Water Quality Standards. [15A NCAC 02H .0502(a)(9)]
3. General Condition II.4 of GC 4502 requires that all construction activities shall be performed and maintained
in full compliance with G. S. Chapter 113A Article 4 ( Sediment and Pollution Control Act of 1973). Regardless
of applicability of the Sediment and Pollution Control Act, all projects shall incorporate appropriate Best
Management Practices for the control of sediment and erosion so that no violations of state water quality
standards, statutes, or rules occur. Design, installation, operation, and maintenance of all sediment and
erosion control measures shall be equal to or exceed the requirements specified in the most recent version
of the North Carolina Sediment and Erosion Control Manual.
Plans received with your application do not indicate the location or type of planned erosion control
measures (silt fencing, temporary or permanent ground cover). Please indicate the type and location of all
planned sedimentation and erosion control measures proposed for the control of any sediment and
erosion onsite to ensure compliance with General Condition II.4 of GC 4502. [15A NCAC 02H . 0506( b)( 2);

Please note, the shoreline stabilization application is utilized to request written confirmation under The Division of
Water Resources’ General Certification 4502. All projects must comply with all conditions of the United States Army
Corp of Engineer’s’ Regional General Permit 30 as well as meeting all conditions of the Division’s General Certification
4502 to be eligible for coverage.

Some conditions are included below.
s. Bulkhead and riprap alignments, or shoreline stabilization structures will not extend farther waterward than an average distance of two (2) feet,
maximum distance of five (5) feet from the normal pool elevation contour and may not extend more than 500 feet along a shoreline.
t. Placement of riprap should be limited to only that which is necessary to protect existing/new bulkheads. In general, riprap will be placed at the
base of all bulkheads and will extend a maximum of three (3) feet waterward on a 2: 1 slope. However, in cases of steep slopes, a maximum of six (
6) feet waterward on a 2: 1 slope is authorized provided it complies with the applicable shoreline or reservoir management program. All other fill
material will be confined landward of bulkheads.
u. Material placed for shoreline stabilization will not exceed an average of one cubic yard per running foot placed below the plane of the ordinary
high water mark. Material should only be placed where shoreline is actively eroding, and no material should be placed in excess of the minimum
needed for erosion protection.
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please respond in writing within 30 calendar days. If all of the requested
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee. Please email all requested documents to
