Subject: Request for Additional Information, Dodd Meadows - Bat Fork Restoration, Henderson County (DWR
Project #20221431)
David,
On October 12, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until all of the following information is received:
1. The Division must accurately account for the wetland impacts associated with the project. It appears that, with
the exception of the portion of W1 that will be converted to a stream, the intent of the project is that the minor
grading impacts to W1 and W2 will be of sufficiently short duration as to have minimal impacts to the ecological
function of the wetlands and within a reasonable time following construction they will return to their pre-
i
construction function. If so, the Division will consider those temporary impacts. If that's the case, please provide
the area of W1 that will be converted to a stream, which the Division will consider a permanent impact. [15A
NCAC 02H .0502]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by November 30, 2022. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and appropriate fee.
Feel free to contact me if you have any questions.
