Yes we will modify the September 6, 2013 Approval of Minor Variance per the Neuse River Basin Riparian Buffer
Protection Rules, MacGregor Downs Deck Addition, DWR 13 -0634 Wake County - in order to approve Cedar Grove
mitigation bank per your email request listed below. You have also requested in a phone call, approval to proceed with
your project. The RRO has no objections, you may proceed with your project. The subject modification of the 401 Cert
will address the mitigation bank, only. All other conditions remain in full affect and are unchanged.
You will be receiving the updated 401 Certification in the mail in a few days.

Hey Cara,

You all are way too efficient over there at EBX O. Actually, the applicant is going to have to request a modification to
their Variance to use Cedar Grove rather than Forrest Creek. That's the proper procedure on the applicant's side. I had
a note to give him a call, but just didn't get to it fast enough O
