Hope you are doing well. I took a deep dive into the permit. I noticed that many of these new
conditions are not actually new. Things are re-numbered and moved about, but most of these
conditions were already in the permit in some form or fashion. I only have a few minor comments
as noted below:
1. Condition II.25 is not numbered numerically, I think it should be II.19.
2. Some of the new Permit Conditions (II.10, II.11, II.12) introduce separation/set-back
requirements that are different than those in place at the time these facilities were designed,
built, and certified. I noticed that this is documented in the permit under condition II.25,
which describes the set-backs in place at the time this was permitted. I am not aware of any
non-compliance, but should the new permit conditions still be included in the permit, since
we are not proposing any new construction, and because this creates a contradicting
condition?
3. On Attachment B:
Field H-8 used to read “H-8/(2,3,38-41)” and now reads “H-8/(2,4,38-41),” The revision
appears correct based on the as-built map/figure for these irrigation areas.
As I looked into this, I noted that Field H-4 should also be changed to read “H-3/(7,9, 25)”
rather than “H3/(7,25)”
4. The cover letter indicates new condition “VI.13”, but I think it should read “IV.3”

comments or acceptance of the draft permit is November 28, 2022.
