RE: Dillsboro dam -FERC license surrender and removal of the dam
DWQ # 04-1224
Jackson County
Thank you for your letter of July 15, 2005 requesting clarification for the 401 Water
Quality Certification issued by DWQ on May 15, 2005 to Duke Power regarding the above-
mentioned project. This Certification was for the proposed surrender of the FERC license for
the dam as stated in the first paragraph of the Certification. From the review of the application
and as stated in condition 5 and 6, DWQ understands that a 404 Permit will be required for the
actual removal of the dam. At that time, a 401 Certification will also be required for that
removal. The Certification also states that if (for some reason) a 404 Permit is not required for
the removal of the dam, then additional written approval from DWQ is required for the dam
removal and monitoring. As you know, DWQ continues to support the removal of the dam and
restoration of flow to the Tuckasagee River as a compensatory mitigation measure for other
hydroelectric projects being reviewed by DWQ and other stakeholders for Duke Power.
