Hello, 

On October 20, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water 
Quality Certification from the Division for the subject project. The Division has determined that your application is 
incomplete and cannot be processed. The application is on‐hold until all of the following information is received: 

1. The application received for the subject project does not contain information regarding the type of 
proposed shoreline stabilization, how work will be conducted, how proposed impacts have been avoided or 
minimized, and calculated permanent impacts to surface waters.  Please provide a detailed description of 
the project. This document should include a detailed description of the proposed impacts to the shoreline 
and surface waters, a description of any impacts to the protected Trout Buffer, a description of how work 
will be conducted including all measures proposed to ensure compliance with NC Water Quality Standards.

2. Provide a site plan showing the property boundaries, structures (buildings, docks, impervious surfaces, etc.), 
location of the shoreline, location of the impacts to the shoreline and/or lake bottom (excavation, dredging, 
rip rap, retaining walls, etc.), and the location of any vegetated areas that will be impacted (construction 
access corridors, etc.).  In most cases the site plans do not have to be professionally prepared.  The template 
located on pages 4‐5 of the help document linked below may be used to assist with this requirement. [15A

3. General Condition II.4 of GC 4502 requires that all construction activities shall be performed and maintained 
in full compliance with G. S. Chapter 113A Article 4 ( Sediment and Pollution Control Act of 1973). Regardless 
of applicability of the Sediment and Pollution Control Act, all projects shall incorporate appropriate Best 
Management Practices for the control of sediment and erosion so that no violations of state water quality 
standards, statutes, or rules occur. Design, installation, operation, and maintenance of all sediment and 
erosion control measures shall be equal to or exceed the requirements specified in the most recent version 
of the North Carolina Sediment and Erosion Control Manual. 

Plans received with your application do not indicate the location or type of planned erosion control 
measures (silt fencing, temporary or permanent ground cover). Please indicate the type and location of all 
planned sedimentation and erosion control measures proposed for the control of any sediment and erosion 
onsite to ensure compliance with General Condition II.4 of GC 4502. [15A NCAC 02H . 0506( b)( 2); 15A NCAC

Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the 
proper consideration of the application.  Please respond in writing within 30 calendar days. If all of the requested 
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the

application and it will be denied as incomplete.  The denial of this project will necessitate reapplication to the Division 
for approval, including a complete application package and the appropriate fee. Please email all requested documents to
