Director NORTH CAROLINA Environmental Quality November 17, 2022 John Hutton DWR Project #: 2020-1095 Wildlands Holdings VI, LLC Alexander County (via electronic mail: jhutton@wildlandseng.com ) Re: Wildlands Catawba Umbrella Mitigation Banking Instrument (UMBI) Double Rock Bank Parcel Credit Release — Tasks I & 7 Dear Mr. Hutton: On April 25, 2022, the Division of Water Resources (DWR) approved a Buffer Mitigation Plan (Plan) for the above -referenced site under the terms and conditions of the Wildlands Holdings VI, LLC (Wildlands) Catawba Umbrella Mitigation Banking Instrument (UMBI) to establish a buffer mitigation bank. On July 25, 2022, the US Army Corps of Engineers issued a Notice of Intent to Approve the Double Rock Stream Mitigation Plan. On October 11, 2022, the DWR received recorded conservation easements and corresponding plats for the subject site. Wildlands provided confirmation that the conservation easements for the subject site have been successfully assigned to Unique Places to Save (UPS). UPS is a 501(c)(3) non-profit corporation and has been approved by DWR as a long-term steward for this mitigation bank. Lastly, DWR received a performance bond (# 107688094) issued to Wildlands from Travelers Casualty and Surety Company of America, in the amount of $150,000, to cover performance obligations for the construction of the subject site. The term of this bond will remain in effect until DWR has provided a written approval of the As -Built Report. In accordance with the UMBI, signed on September 12, 2022, the following Project Milestones have been met and the corresponding credits shall be released: Task/Milestones Credit 1) Instrument and Buffer Mitigation Plan Approved by DWR, 20% Draft Stream Mitigation Plan Approved by the IRT, Conservation Easement Recorded & Financial Assurance Posted 7) Item B (1) of Section X in the UMBI (assign the easement 5% to stewardship) has been completed and approved by DWR TOTAL: 25% North Carolina Department of Environmental Quality I Division of Water Resources 512 North Salisbury Street 1 1611 Mail Service Center I Raleigh, North Carolina 27699-1611 NOR1H CAROL Na 919.707.9000 Double Rock Site Wildlands November 17, 2022 By copy of this correspondence, DWR confirms that you have satisfied the above requirements for the above -referenced tract and therefore, the following credits are being released and are now available to sell: • 25% of buffer restoration and buffer preservation credits (025 x 340,352 ft2 = 85,088 ft2 ) Please note that these riparian buffer credits can be provided to offset permitted impacts along the Catawba River mainstem below Lake James and along mainstem lakes from and including Lake James to the North Carolina and South Carolina border in the Catawba River Basin in accordance with guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015. Please use the Credit Ledger Templates provided in the approved UMBI to track and report credit availability for the Double Rock Mitigation Bank. Upon receiving this correspondence, please submit one (1) credit ledger to DWR reflecting the available credits released for each mitigation type (Buffer Mitigation). Buffer Restoration and Buffer Preservation credits generated with this credit release will be combined on one ledger and do not need to be differentiated.
