Subject:DWR 22-1396_ Bridges, 6020 Rocky Mount Rd - Granite Falls_ Request for Additional Information
On October 19, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on‐hold until all of the following information is received:
1. The subject property is located within the NC Catawba Buffer. As such, impacts within 50 ft to the Lake are
subject to NC Catawba Buffer Rules and must secure a Buffer Authorization from the NC Division of Water
Resource.
Plans received with your application propose 3,300 sqft of impacts within Zone 1 of to the Catawba Buffer but
do not indicate the quantity or location of impacts to Zone 2.
Proposed impacts to Zone 1 consist of a 10 ft wide access corridor along the shoreline for 330 linear feet. The
corridor is proposed to access 100 linear feet of shoreline for the placement of rip‐rap.
Division staff believe impacts to the Catawba Buffer can be minimized by utilizing 2 perpendicular access
corridors rather than 1 longer parallel access corridor along the shoreline. Please reconfigure the access
corridors to minimize impacts or clearly explain why the project purpose cannot be achieved by reconfiguring
the access corridors to better avoid and minimize impacts to Zone 1 of the Catawba Buffer. [15A NCAC

2. Aerial imagery indicates the buffer zone on this parcel is currently vegetative with trees and underbrush. The
plan received on October 19, 2022 proposes impacts to the Catawba Buffer. The Catawba Buffer within all
temporary construction access corridors and temporary disturbed areas must be restored to pre‐construction
topographic and hydrologic conditions and replanted with comparable vegetation within two months of when
construction is complete. Plans do not indicate replanting planned for this area. Please provide a replanting
plan for all areas with proposed temporary impact. The replanting plan should include a list of tree and
understory species, planting locations identified on a map, and a maintenance schedule to ensure the
plantings survive. [15A NCAC 02B .0614]
3. Plans received with your application indicate the addition of rip‐rap to a “reservoir area leading down to
water.” Please provide a description of the proposed work and photo of the reservoir area. Please note,
stormwater cannot be piped or channeled for direct discharge to the lake. All stormwater discharges must be at
the natural elevation and discharged prior to entering the buffer directed as diffuse or sheet flow at non‐erosive
velocities to the lake. [ 15A NCAC 02B .0614(8)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please respond in writing within 30 calendar days. If all of the requested
information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the
application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division
for approval, including a complete application package and the appropriate fee. Please be aware that you have no

authorization under the Section 401 of the Clean Water Act for this activity and any work done within waters of the
state may be a violation of North Carolina General Statutes and Administrative Code.
