Cape Fear 02 Umbrella Mitigation Bank Final Prospectus — Restoration Systems
General comments:
• The Division has concerns that the restoration of low scoring intermittent streams will
disconnect these streams from groundwater. A disconnection with groundwater could result in
a channel becoming non - jurisdictional and no longer viable for mitigation credit.
Specific site comments:
Motes Creek:
• The Division prefers to see less cattle crossings throughout a mitigation site.
Orphan Creek:
• The Division prefers to see the cattle crossing relocated to the head of reach UT2.
• The Division recommends that UT3 be proposed for El instead of Ell.
Maple Hill Farm:
• The Division recommends that UT2a and UT2B be removed from the mitigation plan as they
appear to be non - jurisdictional features.
• The Division proposes that UT2 does not warrant Ell credit.
Rocky Top:
• The Division has concerns that UT2 has limited potential for functional uplift. We recommend
considering adding some protections such as fencing and invasive removal to secure a reduced
Enhancement Credit ratio such as 5:1 or similar.
• The Division has concerns that restoration of UT1 and removal of the upstream pond will result
in channel forming flows.
• There is potential for a stormwater BMP within a swale west through the pasture to the west
UT1.
Benton Branch:
• The Division has concerns that restoration of UT1 and UT2 and removal of the upstream ponds
will result in channel forming flows.
Chico Branch:
• The Division recommends that UT1 (above a very large headcut) be removed from the
mitigation plan as it appears to be a non - jurisdictional feature.
Slingshot Creek Site:
• The Division recommends that the upper portion of the Main Channel be considered for Ell
credit.
• The Division recommends that the restoration plan for the Main Channel immediately below the
upper portion be developed in a manner that will avoid disturbance to as many mature trees as
possible.
• The lower portion of the Main Channel, between UT2 and the crossing is mostly stable. The
Division recommends that the designer consider leaving as much of this channel in place.
