Hey Joanne, we have resolved the issues of our Fisheries Resource Specialist and NMFS and will be moving forward with
issuance of the Major Modification today. Below is the email exchange that took place, and I will send you another
email after this one that has the updated drawing showing the new dredge footprint.

This revised proposal has reduced the dredge footprint and represents a minimization of impacts to shellfish habitat at
this location. Clams do exist in the proposed footprint that should be relocated to the adjacent landward shellfish
habitat. This area should be raked for clams extensively previous to dredging. Any clams encountered during dredging
should . • be relocated. Marine Patrol should be notified in advance of . - contact
me for a contact person.
Also, the dredged area should be well marked to prevent impacts to remaining shellfish habitat in the area due to
boating activity.

Hey Ginger, we are still working on this project. Looking at both the originally requested dredge footprint, the initial
permit issued for the dredging once agency comments were made and the footprint scaled back, the original major
modification request, as well as the newly scaled back proposal. I don't have an update as of right now, but have taken
it to Doug Huggett and we are working on a decision. Sorry I don't have more information for you now, but I will as soon
?.s possible. I would like to say I will have something for you on Monday, but I am not sure that will be the case. Doug
?.nd Braxton are heading to Raleigh together on Monday, so I hope they will have time to discuss on their trip. I will
make a not to contact you on Tuesday, and hope to have something further then. Sorry for the delay.

Oecreased from 11,725sf to 7,350sf reducing the impact to the areas that had the higher quantity of shellfish. Please Fei

Unfortunately, the area in which you have proposed to dredge is considered a significant shellfish resource (greater
than one shellfish per square meter) and represents not only a population of shellfish but an important shellfish habitat
in Town Creek. Even if the existing shellfish were relocated, this location would still be a valuable shellfish habitat to
which dredging would cause a significant adverse impact. For these reasons, I will continue to oppose dredging in this
area.

There is no set number of shellfish removed that constitutes an adverse impact. This area is considered to be significant
shellfish resource (greater than one shellfish per square meter). Also, I do not believe that relay (shellfish transplant to
a shellfish lease) is allowed from this area.
I am reviewing the file and in discussion with DMF shellfish biologists and Marine Patrol regarding any other options
?.vailable for this project. I will respond to you soon with additional information.

I have a copy of the Memo dated December 13 to Doug Huggett. We have currently placed the project on hold to work
through the concerns with the existing shellfish. Is there a number of shellfish that can be removed or disturbed
