Characteristics of jurisdictional wetlands in the study area .....................................7 Natural Resources Technical Report STIP U-6018,Guilford and Randolph Counties, N.C. 1 September 2019 1.0 INTRODUCTION The North Carolina Department of Transportation (NCDOT)proposes to widen a portion of NC 62 and realign several intersections (STIP U-6018)from Kersey Valley Road (SR 1154) to Weant Road (SR 1162)and from E Fairfield Road (NC 610) to Liberty Road (NC 62)in Guilford and Randolph Count ies (Figure 1).The following Natural Resources Technical Report (NRTR) has been prepared to assist in the preparation of a document for the purposes of the National Environmental Policy Act (NEPA)or the State Environmental Policy Act (SEPA). 2.0 METHODOLOGY All work was conducted in accordance with the NCDOT Environmental Coordination and Permitting’s Preparing Natural Resources Technical Reports Procedure and the latest NRTR Template,November 2017.Field work was conducted on August 1-2, 2018,and on August 14, 2018.Jurisdictional areas identified in the study were verified by the U.S. Army Corps of Engineers (USACE) and the North Carolina Division of Water Resources (NCDWR)on August 8, 2019.The Action ID for this project is SAW-2018-00773, however the PJD document has not been issued by USACE as of this report.The principal personnel contributing to the field work and document preparation are provided in Appendix B. 3.0 TERRESTRIAL COMMUNITIES Seven terrestrial communities were identified in the study area.Figure 4 shows the location and extents of these terrestrial communities. Terrestrial community data are presented in the context of total coverage of each type within the study area (Table 1). Table 1. The study area also is not within the known watershed range of Cape Fear shiner in Guilford and Randolph Counties.A review of NCNHP records,accessed August 2019, indicates no known occurrence of Cape Fear shiner within 1.0 mile of the study area. Roanoke logperch USFWS Recommended Survey Window:Year-round,April-June (optimal) Biological Conclusion:No Effect Suitable habitat for the Roanoke logperch does not occur in the study area. The study area lacks small to medium sized rivers with moderate to low gradient with riffles and runs.The study area also is not within the known watershed range of Roanoke logperch in Guilford County.A review of NCNHP records,accessed August 2019, indicates no known occurrence of Roanoke logperch within 1.0 mile of the study area. Atlantic pigtoe USFWS Recommended Survey Window:Year-round Biological Conclusion:No Effect Suitable habitat for Atlantic pigtoe does not occur in the study area.The streams within the study area lack the coarse sand and gravel substrate and water flow that are required for this species.The study area also is not within the known watershed range of Atlantic pigtoe in Guilford and Randolph Counties.A review of NCNHP records,accessed August 2019, indicates no known occurrence of Atlantic pigtoe within 1.0 mile of the study area. Schweinitz’s sunflower USFWS Recommended Survey Window:Late August-October Biological Conclusion:No Effect Potential habitat for Schweinitz’s sunflower is present within the study area. Suitable habitat, consisting of disturbed roadside edges, was identified in portions of the project study area.ESI biologist Jeff Harbour completed surveys for this species on September 27, 2018. Reference populations of this species were visited by the ESI biologist prior to the survey occurring. No individuals were observed during this survey of potential Schweinitz’s sunflower habitat within the U-6018 study area.A review of NCNHP data,accessed August 2019,indicates no occurrences of Schweinitz’s sunflower within 1.0 mile of the study area. Natural Resources Technical Report STIP U-6018,Guilford and Randolph Counties, N.C. 4 September 2019 Small whorled pogonia USFWS recommended survey window:Mid-May through Early-July Biological Conclusion:No Effect Potential habitat for small whorled pogonia, consisting of forest edge and small canopy gaps within the mixed hardwood and mixed pine/hardwood forest areas is present within the Guilford County portion of the study area.ESI biologist Jeff Harbour completed surveys for this species on May 16, 2019 based on consultation with Dale Suiter of USFWS regarding potential habitat types in Guildford County.No individuals of small whorled pogonia were observed in any areas of potential habitat during this survey of the U-6018 study area.A review of NCNHP data,accessed August 2019,indicates no occurrences of small whorled pogonia within 1.0 mile of the study area. Northern long-eared bat USFWS has developed a programmatic biological conclusion (PBC) in conjunction with the Federal Highway Administration (FHWA), the USACE, and NCDOT for the northern long-eared bat (NLEB) in eastern North Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT projects and activities. The programmatic determination for NLEB for the NCDOT program is “May Affect, Likely to Adversely Affect”. The PBO provides incidental take coverage for NLEB and will ensure compliance with Section 7 of the Endangered Species Act for five years for all NCDOT projects with a federal nexus in Divisions 1-8, which includes Guilford and Randolph Count ies, where STIP U-6018 is located. 4.2 Bald and Golden Eagle Protection Act The bald eagle is protected under the Bald and Golden Eagle Protection Act and enforced by the USFWS. Habitat for the bald eagle primarily consists of mature forests in proximity to large bodies of open water for foraging. Large dominant trees are utilized for nesting sites, typically within 1.0 mile of open water. A desktop-GIS assessment of the project study area, as well as the area within a 1.0-mile radius of the project limits, was performed on July 30, 2018 using recent color aerials. Surface waters PA and PD,within the study area,and other unnamed open waters that are within 1.0 mile of the study area may provide suitable foraging habitat for bald eagles. No bald eagle nests were identified within the study area or within 660 feet of the study area based on review of any suitable nest trees visible from publicly accessible roads. Additionally, a review of the NHP database, which was accessed August 2019,revealed no known occurrences of this species within 1.0 mile of the project study area. Due to the lack of known occurrences and minimal impact anticipated for this project, it has been determined that this project will not affect this species. Natural Resources Technical Report STIP U-6018,Guilford and Randolph Counties, N.C. 5 September 2019 5.0 WATER RESOURCES Water resources in the study area are part of the Cape Fear River basin [U.S. Geological Survey (USGS) Hydrologic Unit 03030003]and are part of the Randleman Lake Watershed, which is a Critical Supp ly Watershed.Fourteen streams were identified in the study area (Table 3). The location of each stream is shown on Figure 3. There are no designated Outstanding Resource Waters (ORW),High Quality Waters (HQW) or water supply watersheds (WS-I or WS-II) within or within 1.0 mile downstream of the study area.The North Carolina 2018 Final 303 (d)lists of impaired waters do not identify any impaired waters within the study area.The streams identified in Table 3 are located within a Critical Supply Watershed and are subject to special management strategies. Four surface waters were identified within the study area (Table 4).The location of each surface water is shown on Figure 3. The location of these streams is shown on Figure 3. NCDWR stream identification forms are included in a separate PJD Package.All jurisdictional streams in the study area have been designated as warm water streams for the purposes of stream mitigation. The location of these wetlands is shown on Figures 3a-3c. All wetlands in the study area are located within the Cape Fear River Basin (USGS Hydrologic Unit 03030003). USACE wetland determination forms and NCWAM forms for each site are included in a separate PJD Package. No construction moratorium is anticipated for this project. 6.3 N.C. River Basin Buffer Rules Streamside riparian zones within the study area are protected under provisions of the Randleman Lake Riparian Buffer Rules administered by NCDWR. Table 5 indicates that all streams within the study area are subject to buffer rule protection. Surface waters PA and PD are also subject to buffer rule protection. Potential impacts to protected stream buffers will be determined once a final alignment and design have been determined.
