The Wilmington Regional Office received and accepted a State Stormwater .NbWement Permit Transfer

2022. As a result of the additional motion. requested, Raiford G. Tragic Jr. asked to withdraw the subject
ffi order to pursue the renewal of the expired permit as well as address the property ownership issues
the February 7, 202", letter prior to resubmitting a new tmsfer.
Per this request, this Office is hereby withawing the inject application. The $505.00 applicatim fee has been
forfeited and a new fee will need to be provided if you choose to resubmit this application in the future.
If you wish to pursue transferring this project, you must reapply to the Division. Yon application pw&W must
include a completed and signed application farm;. supplement form; signed O&M agreement; application fee, and
any supportnig documentation necessary to assess thee items identified in the latest request for additional
infarction.

Per your Request for Additional Information dated February 7, 2022, for the above referenced permit, it was
determined by a January 12, 2022, inspection that the site is not in compliance with the terms and conditions
of the permit. This letter is the response to your request for additional information and our plan of action to
address the compliance issues that were determined per the notice of inspection.
Request for Additional Information
1. We were originally instructed by your Renewal Specialist to transfer the permit before proceeding
with the renewal application. We now understand this is not correct. We are in the process of
renewing the application prior to the transfer. The renewal application is included. Please apply the
check for $505 (check #2308) that is in your possession to this renewal application.
2. Please disregard the transfer application that is in your possession. We will be submitting a new
transfer application. Current ownership is as follows:
a) DA 13A/13
1) originally BC&RT, LLC
ii) transferred to Bruce Carlson & Raiford Trask Jr Trustee as tenants in common
iii) transferred to Raiford Trask Jr Trustee (current ownership)
IV) under contract to be sold to Hawthorne Residential Partners

3. We have a copy of the current recorded O&M Agreement for all SCMs, and I will continue to keep
this on file with the permit.
4. No improvements have been made on property under this permit except for Lots 62-74. Lots 76-82
have been deleted. We are in the process of requesting plot plans from the builders on the lots that
have homes and will submit as soon as we receive them. Plot plans for Lots 71-74 are included.

I. See item #1 above.
II. Based on an a -mail from Kelly Johnson September 1, 201 the included partial certification was
sufficient. It was labeled partial because it only included the constructed facilities (1 pond and 5
sand filters) from the original permit which included 3 ponds, 2 infiltration basins and 7 sand filters.
We are in the process of confirming this with the engineer that handled this permit and have
requested that if constructed as determined in most recent inspection to please send Designer
Certification. We will forward as soon as received.
III. The Amendment and Supplemental Declaration of Covenants, Conditions, and Restrictions for
Peggy's Cove at Southbridge recorded in Book 3814 Page 974 in the Onslow County Register of
Deeds was provided to Kelly Johnson in response to her July 1, 2015, Request for Additional
Information. E-mail correspondence from the engineer on February 16, 2012, confirms the BUA
restrictions that were included in the Recorded Amendment were submitted to DENR. We are in
the process of confirming if they were approved by DENR and if possibly there was mistake in the
modified permit. If that is not the case, we will take corrective measures to adjust the Recorded
Amendment.

Good Afternoon Madison,
I can confirm that the package has been received. It is noted that the current transfer will be withdrawn and a new
transfer will be submitted following the renewal. I will work on getting the withdrawal letter for the current transfer
sent and the renewal logged in for review.
Regarding the new transfer, all of the property owners (not including the owners of individual single family lots) will
need to be represented in the transfer. Please note the list on the letter inadvertently omitted DA 1, which is owned by
Southbridge Lot Development LLC. Additionally, based on the Onslow County GIS database, it appears that Peggys Cove
Homeowners Association, Inc. is the entity responsible for the common area of DA 8.
Any changes to the approved plans, including any further subdivision (such as separating out the DA 13 A/B area) would
require a modification to the permit. If it is desired to separate the DA 13A/B area, then two application packages will
need to be submitted at the same time. These packages would be:
1. An application to modify SW8 090903. This modification package would remove the DA 13A/B are from the
project area to be covered under a separate permit; and
2. Anew permit application covering the area removed from SW8 090903.
Both of the above applications must be submitted, and will be reviewed, at the same time and are contingent on each
other.

will get some of the missing information from the builders & engineer today so I can include it. Mr. Trask is on the way
here to sign where needed. If you can review this draft and let me know of any comments beforehand I would
appreciate it. Would like to have everything needed with my submittal today.
There are multiple owners for the property under this permit. BC&RT LLC (current permittee) is being dissolved. Would
it be best for me to use Raiford G. Trask, Jr. as the new proposed permittee? Also, since we will be selling the property
where DA 13A/B is located we would like that to be separated. What is the process for doing that?

Good Afternoon Ms. Robideau,
The Request for Additional Information letter sent on February 7, 2022 had a due date of February 22, 2022.
To date, a response has not been received. As indicated in the letter (reattached for reference), "Ifadditional
time is needed to submit the requested information, please email your extension request prior to this due date to the email
address provided below with a justication and a date of when the requested information will be submitted, which shall
be no later than 15 days past the original due date." As such, I am unfortunately not able to grant a 30 day
extension. I can, however, grant the 15 day extension from the original due date of February 22, 2022. The
new due date to provide all of the requested information would be March 9, 2022. If all of the additional
information cannot be provided by this date or additional time is needed, the project will need to be returned
to allow for that additional time.
In the meantime, please let me know if you have any additional questions.

Dear Mr. Trask and Mr. Carson:
The Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) received and
accepted a signed Permit Transfer Application Form for the subject project on November 16, 2021. The current
and proposed permittees have requested to transfer the permit in accordance with 15A NCAC 02H.1045(1)(a). A
preliminary in-depth review of the documentation submitted with the transfer request determined that the
application is incomplete and that additional information is needed.
Since the transfer was submitted under NCAC 02H.1045(1)(a) and the proposed permittee selected the option in
Section F of the application form where they agree to be the entity responsible for addressing any compliance
issues. To continue the review and processing of this transfer request, please provide the following documentation
in a single, hard copy submittal package to complete the application and demonstrate compliance with the
permit:
15A NCAC 02H. 1 045(3)(a): It is noted that previous communications with our Renewal Specialist
indicated that this permit needed to be transferred before it could be renewed due to the current permittee,
BC&RT, LLC, not being active with the NC Secretary of State (NC SOS). Unfortunately, this
information was incorrectly conveyed, as BC&RT, LLC is still the entity responsible for compliance with
the permit conditions. Furthermore, BC&RT, LLC is still within the winding -up period of entity
dissolution. As such, the permit must be renewed by the current permittee, BC&RT, LLC prior to
proceeding with the permit transfer. Please provide a Renewal Application Form from the current
permittee, BC&RT, LLC. It is noted that a check for $505.00 (check #2308) was submitted with the
renewal application submitted by the proposed permittee, Raiford G. Trak, Jr. and Bruce Carlson as
tenants in common, to follow the permit transfer. If the Renewal Application Form from the current
permittee can be submitted quickly, this check can be used for the renewal and a new check would not be
needed. If it is desired to use a new check and have check #2308 returned, that can be arranged by
emailing me using the email address provided below. Upon receipt of the revised Renewal Application
form, the renewal will be processed and once it is approved, the transfer will then be logged back in.
2. 15A NCAC 02H.1045(2)(c): Legal documentation supporting the proposed permittee, Raiford G. Trask
Jr. and Bruce Carlson as tenants in common, as the property owner was not provided. Furthermore, a
search of the Onslow County GIS database indicates that the property covered by this permit is owned by
Southbridge Lot Development LLC (Drainage Area to Sand Filter 1) and Raiford G. Trask Jr. under the
Raiford G. Trask, Jr. Revocable Trust (remaining project area). Please provide legal documentation of the
property transfer to the proposed permittee, Raiford G. Trask Jr. and Bruce Carlson as tenants in common.

15A NCAC 02H. 1 045(2)(d): The provided operation and maintenance agreement only includes the cover
page and does not include the maintenance requirements. Please click the red text to "Update O&M
Manual" to add the applicable tabs with the maintenance requirements. Please print off a copy of and
submit these additional tabs to pair up with the provided cover page.
15A NCAC 02H. 1045 (2)(e): Documentation supporting that the maximum allowed built -upon area per
lot has not been exceeded has not been provide for the constructed lots. Please provide documentation
that the maximum allowed built -upon area per lot has not been exceeded. The permittee's lot review
records, tax records, aerial photos, and/or lot surveys can be used to demonstrate the allocated BUA has
not been exceeded.
Notice of Inspection
On January 12, 2022, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) inspected the subject project to determine the status of compliance with this permit, most recently
issued on September 8, 2015. DEMLR file review and site inspection revealed that the site is not in compliance
with the terms and conditions of this permit. A copy of the completed form entitled "Compliance Inspection
Report" summarizing the findings of the recent inspection is attached to this letter. Please either address the
following items to demonstrate compliance with the permit or submit a plan of action that provides a
timeline in which the following compliance issues will be resolved.
I. Permit Condition III.11: The permit expired on December 31, 2021 and has not been renewed. See item
#1 above for further explanation of what is needed to resolve this issue.
II. Permit Condition II.9 and 15A NCAC 02H.10080) effective September 1, 1995: The certification for the
most recent version of the permit only includes Pond 7-12 and does not include Infiltration Basin 7-12,
Pond 13A/b, Infiltration Basin 13AB, or Sand Filter 1. Infiltration Basin 7-12 has been completed,
however, Pond 13A/b, Infiltration Basin 13AB, and Sand Filter 1 have not been constructed at this time.
Please provide a copy of the Designer's Certification for all SCMs that have been completed, including
Infiltration Basin 7-12. Any incomplete SCMs can be completed and certified by the new owner.
III. Permit Condition II.18 and II.19: The provided deed restriction and protective covenants recorded in
Book 3814 Pages 974-979 does not match the permitted maximum built -upon area (BUA) allocations.
The recorded deed restrictions grant Lots 66-70 3,500 square feet of BUA, however, the permit only
allocates 3,000 square feet of BUA to Lots 62-75 and 2,800 square feet of BUA to Lots 76-82. Please
provide a copy of the recorded deed restrictions that match the permitted, approved BUA allocations.
All of the requested information listed above should be received in this Office by February 22, 2022, or the
application will be returned as incomplete. If additional time is needed to submit the requested information, please
email your extension request prior to this due date to the email address provided below with a justification and a
date of when the requested information will be submitted, which shall be no later than 15 days past the original
due date. Please note that only two letters requesting additional information is allowed in the State Stormwater
Program for a total of 30 days to submit the requested additional information. If the information is not
satisfactorily provided after either the second request or 30 days, the project will be returned. If the project is
returned and you wish to re -submit later, you will need to resubmit all required items at that time, including the
application fee.
Please note that if, upon review of the submitted information or upon a deficient compliance inspection of the
project, it is determined that a major modification to the permit is required to resolve the compliance issues, the
transfer application will be returned as incomplete. Upon the issuance of the modified permit, and the successful
completion of any work required by the modified permit and/or the restoration of the site to design condition, the
applicant will need to submit an updated transfer application and a new fee to the Division to start the transfer
process over again.
Please remember that the permittee is responsible for complying with the terms and conditions of the permit and
the approved plans and specifications until the Division approves the transfer request.

i) The permit expired on December 31, 2021 and has not been renewed.
2) The certification for the most recent version of the permit only includes Pond 7-12 and does not include
Infiltration Basin 7-12, Pond 13A/b, Infiltration Basin 13A/B, or Sand Filter 1. Infiltration Basin 7-12, however, has
been completed and no certification has been submitted. Pond 13A/b, Infiltration Basin 13A/B, and Sand Filter 1
have not been constructed at this time.
3) The recorded deed restrictions recorded in Bk: 3814 Pg: 974-979 does not match the permitted maximum
built -upon area (BUA) allocations. The recorded deed restrictions grant Lots 66-70 3,500 square feet of BUA,
however, the permit only allocates 3,000 square feet of BUA to Lots 62-75 and 2,800 square feet of BUA to Lots

Do you have a minute to discuss on the phone? From your 10/18/21 e-mail "With 090903 it cannot be renewed by BC &
RT, LLC because they are no longer active with the NC Secretary of State business registration. We usually do issue the
renewals of permits before transfers can occur however in this instance; the permit will have to be transferred before it
is renewed. The renewal application of SW8 090903 should state the "current permittee" as the permittee you are going
to be transferring the permit too, as it will be completed before the renewal can happen." I was trying to get this permit
transferred from BC & RT, LLC to Raiford Trask Jr and Bruce Carlson as tenants in common first and then do the renewal.

I hope you had a wonderful thanksgiving.
Thank you for being patient while I process this renewal. (I have a lot of in house projects right now) but I did get some
time to review the application for the subject permit and I just need one minor change to the permit application. The
renewal application lists the current permit holder's company name as 'Raiford G. Trask, Jr. and Bruce Carlson as tenants
in common'. The previously issued permit lists the current permit holder as BC &RT, LLC. I realized these are most likely
the same people, however I do need consistency between the previous issued permit and this current renewal
application to process.
Whenever you can, please correct Section B.1 on the renewal application and send it to me so I can process this
application and issue that renewal. Once the renewal is issued, the transfer application can be logged in and reviewed as
well. Feel free to send that updated page 1 of the renewal application as an email attachment, I can print it out here in
the office.

pond is located on Bruce/Raiford property and the constructed pond is on Southbridge Master Association property.
Should the proposed permittee be Raiford & Bruce as tenants in common & Southbridge Master Association? Can

If you have transfer questions, I would be happy to help. Ashley focuses on renewals as opposed to transfers. I looked
quickly through the information from 2015. 1 see that there was a note that it could not be transferred because it was
not completely constructed. There is now a way to do that. If you go to Section F of the transfer form, there is an
option to accept a permit transfer that is non -compliant since this is not being transferred to an HOA. If you check this
box, the new land owner can become the permittee.

I am in the process of renewing permit 090903 which expires 12/31/21. Tammy Spivey is no longer with our company
and she advised me that I also needed to transfer this permit from BC & RT LLC to the current owner, Bruce Carlson &
Raiford Trask Jr as tenants in common, since that is the current ownership and BC & RT LLC is no longer an active entity. I
was looking back thru some of the old notes and saw a note that since the one of the ponds hadn't yet been constructed
we could not transfer ownership from BC & RT LLC. Is that correct or should I proceed with the transfer form?

Hi Madison,
Looking at those renewals, I made the mistake earlier of assuming both permits were owned by the same permittee.
Looking at the renewal application, and the last issued permit, and realizing it when you sent Kelly that email, I
apologize. With 090903 it cannot be renewed by BC & RT, LLC because they are no longer active with the NC Secretary of
State business registration. We usually do issue the renewals of permits before transfers can occur however in this
instance; the permit will have to be transferred before it is renewed. The renewal application of SW8 090903 should
state the "current permittee" as the permittee you are going to be transferring the permit too, as it will be completed
before the renewal can happen.

attached pdfs of the previously issued permits for SW8150413 and SW8 090903. Just as a heads up, I know some of the
documents have SW8090903 as well as another SW8 number on them, this is because SW8090903 as a master permit
holds other permit information in that file. 090903 is the master permit for 150412 (which is addressed to another

Plan sheets are not required. Renewals are processed rather easily compared to transfers and modifications. As long as
everything under Part C submittal requirements is submitted you will have everything you need. We can talk on Monday
if you need additional help but the application has all of the required documentation. A processing fee of $505.00 made
out to NC DEQ for each renewal, Business Registration documentation of a current and active status along with
managing members listed for Southbridge (articles of the organization you attached in your last email works fine), a
copy of the deed restrictions for SW8 150413 since it is a subdivision, and the designer certification. Numbers 6 & 7 on
the submittal requirements are not yet required by DEQ for renewal so they can be N/A. and Number 4 is just asking
whether you would like a copy of the operation & maintenance agreement (O&M) sent to you when the permit is
renewed, issued, and mailed back to you.
So as long as there is
1. $505.00 check
2. Copy of NC Business Registration for Southbridge Multifamily, LLC identifying members/managers and listed as a
current -active status
3. Copy of the recorded deed restrictions
4. Designer Certification
5. Complete and Notarized renewal application listing Southbridge Multifamily, LLC as the current entity with an

They must be submitted to our office as hard copies and electronic copies (you can email me the complete submittal,
burn it on a CD, or flash drive. Any of these options work for electronic submittals)

I understand that you are asking to modify SW8 150413 to exclude 6 lots and modify SWA 000110 (Southbridge SF2) to
include these lots. You also wish to renew SW8 150413 (set to expire on 12/31/2021) and transfer SW8 150413. Who do
you wish to transfer SW8 150413 to? In your email you indicate that the owners are the same.
The renewal should be submitted first as to ensure the permit does not expire. The Permit Renewal application can be
accessed on this website. Please review and complete the application. Include all peflivent checklist 6tems attd an
appkcatron fee of $ rtiSX(D to coverthe cost of pracessircg. The timeframe for the renewal process is largely dependent
on when the application is submitted and the completeness of that application, however, it is typically a straight forward
and relatively quick process.
After the renewal, modification packages can be submitted. Since these two permits are in two separate programs that
do not track well together, there is not a way to move project area from a regular program permit to an ATC Fast Track
permit. However, since you will need to submit a modification to the regular program for SW8 150413, one option
would be to apply for a regular program permit for Southbridge SF2 at the same time. With this approach, both projects
would track simultaneously through the regular program and the ATC permit would be rescinded upon issuance of the
new regular program stormwater permit for Southbridge SF2. Additionally, this option would allow you to no longer
have to meet the intense requirements of the Fast Track program and you would no longer be required to submit a Fast
Track Final application once the project was built. If it is desired to proceed with this option, a Permit Rescission Request
Form for SWA 000110 must be submitted with the new regular program application. The Permit Rescission Request
Form can be found on this website.
After the modification and new permit are approved, a transfer application can be accepted for SW8 150413. There are
several options available to transfer a permit, as summarized below. Specific submittal requirements for each type of
transfer below are listed in the referenced statute and in Section B of the transfer application form itself on this website:
1.) Upon the request of the current permittee and the proposed permittee, where both entities sign the transfer
application;
2.) Upon the request of the current permittee to an HOA or POP., where only the current permittee signs the
transfer application. (NCGS 143-214.7(c2))
3.) Upon the request of a successor owner of the property on which the permitted activity is occurring or will occur.
(NCGS 143-214.7(c5))
Upon receipt of the complete transfer application package, a site inspection will be conducted to determine compliance
with the permit. A checklist of the required items and documentation can be found in Section C of the Permit Transfer
Form linked above.

Hello Jessie —
The Southbridge project has two known permits SWA 000110 and the original the SW8 150413.
SWA 000110 correlates to the project we are actively working on and SW8 150413 for the adjacent property, both
properties luckily having the same owner.
SW8 150413 carved out 6 lots that are within the project we are actively working on.
From a horizontal perspective those 6 lots do not follow the same bearings/distances as the old site plan and from a
drainage perspective to try to get those 6 lots to drain back to the existing pond isn't working with the grading.
Moving forward we wish to revise the SW8150413 to omit the six lots and at the same time revise the recent SWA
000110 permit to include the 6 lots as well as revise the boundary to match the current site plan.
While these permit revisions are underway, could we just as easily do the renewal & permit transfer?
I hear it's as easy as filling out a few forms, but am having difficulty locating them on the NCDEQ website.
Hopefully this plan makes sense and if it doesn't feel free to call me back.
This will be my first time amending a permit and transferring a permit.
What future costs are associated and the timeline for such processes?

• The permit was issued to Raiford G. Trask, Jr, Manager & Trustee and BC & RT, LLC on September R, 2015.
• Nothing has changed since the 2015 permit to my knowledge except that BC & RT no longer exists (see
comment 3.b. on the attached comment/response letter — I'm not sure what this means).
• Current owners of the previously owned BC & RT land are Bruce Carlson & Raiford G. Trask, Jr Trustee (same
people as BC & RT). It looks like Bruce Carlson & Raiford G. Trask, Jr Trustee were the owners in 2015 as well.
1 want to make sure ! submit what's needed the 11 go -round. Do we need to submit a transfer form since BC & RT no
longer exists, or is a transfer not needed since Raiford Jr is still the responsible party?
