PUBLIC WORKS CITY OF DURHAM November 2, 2022 DEQ-DEMLR Stormwater Program Attn: Isaiah Reed 1612 Mail Service Center Raleigh, N.C. 27699-1612 Dear Mr. Reed: The Public Works Department at the City of Durham received a Notice of Compliance dated October 11, 2022 for the audit of the National Pollutant Discharge Elimination System (NPDES) municipal separate storm sewer program (MS4) program. This audit was conducted using the 2018 NPDES MS4 City of Durham permit (NCS000249) and the most recent Stormwater Management Plan. As required in the Notice of Compliance, this letter serves as the City of Durham's acknowledgment of receipt of the notice and the intent to comply with the MS4 requirements in state and federal regulations, and the NPDES MS4 Permit. The Public Works Department responded to the April 5, 2022 email from Jeanette Powell, NC Division of Energy, Mining, and Land Resources (DEMLR), requesting a self -audit of the NPDES MS4 program. The Public Works Department provided a completed self -audit form with supporting documentation to DEMLR on May 6, 2022. The supporting documentation included current and past copies of the stormwater management plans and annual reports, as well as standard operating procedures (SOPS), databases, and spreadsheets. These were provided as a link to a shared OneDrive account that DEMLR was able to access. On May 10, 2022, Alaina Mormon, DEMLR, acknowledged receipt of these self -audit files. The Notice of Compliance requires the City to provide an updated Stormwater Management Plan to DEMLR within 120 days of the notice date or February 8, 2023. The Public Works Department intends to provide an updated plan that will reflect the existing 2018 NPDES MS4 permit and self -audit findings. The Public Works Department expects an additional update to the Stormwater Management Plan may be prepared to address any proposed changes to the NPDES MS4 permit. A DEMLR timeline including the expected date of a draft permit, expectations regarding an additional Stormwater Management Plan update, and permit applications would assist the Public Works Department with planning. The Public Works Department appreciates the timely delivery of the Notice of Compliance.
