Church Street Mail Code EC3XP Charlotte,NC 28202 Subject: Seep Management Amendment to Corrective Action Plan Conditional Approval & Termination of Special Order by Consent S 19-006 Duke Energy Progress, LLC—Weatherspoon Steam Station NPDES Permit NC0005363 Robeson County Dear Ms. Bednarcik: On August 29, 2022, Duke Energy Progress, LLC (Duke Energy) submitted a Seep Management Plan Amendment to the proposed Corrective Action Plan(CAP)for the Weatherspoon Steam Station to satisfy the terms of Section 2(b)(7) of Special Order by Consent(SOC) S 19-006. The Department of Environmental Quality (DEQ)has reviewed this submittal and hereby provides its conditional approval of the Seep Management Plan as an amendment to initial groundwater Corrective Action Plan(CAP) documents prepared for the site and submitted in November 2015 and February 2016. This approval has been provided as conditional because it is anticipated that an updated, comprehensive CAP will be submitted for this site. This conditional approval shall remain effective until an updated CAP for the Weatherspoon Steam Station is approved, at which time the management of seeps will be regulated by its terms. As an interim measure,this conditional approval requires Duke Energy to conduct semiannual monitoring for the constituents listed in Table 1 of the SOC at SOC monitoring locations S-15 and S-16. Reporting of the results of testing should continue to be submitted to DEQ via the email address used for the reporting of SOC data Cdesocdata@ncdenr.gov). This conditional approval concurs with the dispositioning of seeps as requested in the Seep Characterization Report submitted in June 2022 for the Weatherspoon Steam Station; however,this approval is also cognizant of the potential for changes in the circumstances of the seeps at the site while it is in effect, and DEQ reserves its rights to require further monitoring of seeps should circumstances warrant. This conditional approval is sufficient to activate the SOC termination provision for the Weatherspoon Steam Station found in Section 2(b)(8)of SOC S 19-006. As a result,the SOC shall terminate on December 8, 2022 (30 days following the date of this letter).
