Dear Ms. Bednarcik:
On February 23, 2022, Duke Energy Progress, LLC (Duke Energy) submitted a Seep Management
Plan Amendment to the Closure Plan for the H. F. Lee Steam Electric Plant to satisfy the terms of
Section 2(b)(7) of Special Order by Consent(SOC) S18-006. The Department of Environmental
Quality (DEQ)has reviewed this submittal and hereby provides its conditional approval of the Seep
Management Plan as an amendment to initial Closure Plan documents prepared for the site and
submitted in December 2019 and April 2020. This approval has been provided as conditional because
it requires slightly different monitoring than what is called for in Seep Management Plan Amendment
until such monitoring may be further refined per the terms of the forthcoming Groundwater Corrective
Action Plan Update. Details regarding the conditions are described below.
• DEQ concurs with the semiannual monitoring of non-dispositioned seeps as called for in section
3.6 of the Seep Management Plan Amendment. In addition, continued monitoring of the following
SOC monitoring locations is required on a semiannual basis:
S-03A& S-09 (partially addressing a goal stated in section 3.5 of the Plan Amendment)
Halfmile Branch Upstream and Downstream
Neuse River Upstream and Downstream
• This conditional approval concurs with the dispositioning of seeps as requested in the Seep
Characterization Report submitted in December 2021 for the H. F. Lee Steam Electric Plant;
however, this approval is also cognizant of the potential for changes in the circumstances of the
seeps at the site while it is in effect, and DEQ reserves its rights to require further monitoring of
seeps should circumstances warrant.

• Reporting of the results of testing should continue to be submitted to DEQ via the email address
used for the reporting of SOC data(desocdata@ncdenr.gov).
• In the future,regulation of Cooling Pond Seeps shall be governed by the terms of NPDES permit
NC0003417 (modification issued October 21,2022; effective December 1, 2022). As a result,
further monitoring at the Downstream 2 Neuse River location is no longer required.
This conditional approval is sufficient to activate the SOC termination provision for the H. F. Lee
Steam Electric Plant found in Section 2(b)(8)of SOC S 18-006. As a result,the SOC shall terminate on
December 8, 2022 (30 days following the date of this letter).
