We are also requesting a 401 WQC from NCDWR for the above referenced impacts. The project is ±105 acres in size and is located east of the intersection of Earnest Jones Rd and Turtle Creek Road in Cary, Wake County (Latitude: 35.803392 °N; Longitude: - 78.9255o6 °W). The project is located in the Cape Fear River basin and onsite waters drain to Indian Creek. The Water Quality Classification for Indian Creek is WS -IV; NSW and the Stream Index Number is: 16- 41- 1- 18 -(1). The cataloging unit for the site is 03030002. Proposed Proiect The proposed project consists of the construction of a single- family residential subdivision and associated required infrastructure (i.e. roads, utilities, greenways, stormwater management, etc.). Project History The Corps of Engineers issued a Jurisdictional Determination for the proposed project on February 7, 2014 (AID #SAW -2013- 01346). 115 MacKenan Drive I Cary, NC 275111 tel: 919.469.3340 1 fax: 919.467.6008 www.withersravenet.com I License No. C -0832 Montvale Subdivision NWP 29 PCN December 17, 2014 The Town of Cary issued a Buffer Determination Letter for the proposed project on May 3, 2013 (TCRB 12 -021). Please note that impacts to Jordan Lake Buffers will be permitted through the Town of Cary as the delegated municipality. Proposed Impacts The proposed impacts consist of 0.339 acres of permanent wetland impacts, 89 if of permanent stream impacts and 102 if of temporary stream impacts. The proposed 0.339 acres of permanent wetland impacts are required for construction of a roadway (Regent Oak Drive) (Impact 1), a proposed greenway (Impacts 5 & 6), and residential lots (Impacts 1, 2, 3 & 4). The 89 if of permanent stream impact is required for construction of a culverted greenway crossing (Impact 8) and associated dissipater pad downstream of the culvert (Impact 9). The proposed 102 if of temporary stream impacts (Impacts 7, 10 & 11) will occur from construction of sanitary sewer lines servicing the subdivision. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Proposed permanent impacts have been minimized primarily to impacts necessary to construct a road to access developable uplands, and impacts required for construction of four residential lots. The alignment of Regent Oak Drive (Impact 1) is designed provide access to developable upland areas to the east along Reserve Pine Drive. To minimize impacts, the road is located as close to the southern property boundary as setbacks allow, and the crossing will occur perpendicular to the wetland, minimizing the footprint of the impact. Impacts 2, 3 and 4 (wetland) and a portion of Impact 1 (wetland) are necessary for construction of four residential lots (Lots 34, 38, 39 & 40). The proposed development was originally designed with 164 lots, which was based the approved density of 1.8 units per acre (upa). The original design would have required additional stream crossings for roads and utilities for the cluster development design. Due to site constraints such as riparian buffers, streams, wetlands, stormwater management requirements and the American Tobacco Trail easement, the site design has been revised to propose 141 lots, which results in a density of 1.3 upa. The loss of 24 lots greatly decreases the number of lots to offset development costs (i.e. site grading, utilities, stormwater management, etc), which thereby increases both the construction costs per lot, and the selling price of the lots in order for the project to be financially feasible. Therefore, the proposed 141 lots is the minimum number of lots necessary to keep construction costs per lot down in order to keep the individual lot selling prices within the range that the current real estate market will support. The loss of any additional lots would increase individual lot costs above what the real estate market will support, potentially rendering the project financially unfeasible. Furthermore, the proposed wetlands to be impacted for construction of lots 38, 39 & 40 consist of small linear, wetlands in crenulations whose hydrology is provided primarily by runoff from adjacent uplands, with very little influence from groundwater fluctuations. The Town of Cary's stormwater WITHERS &- RAVENED Page 2 of 4 -G,MFfF s I YFi{ .X.Els I S�R4FY4F5 Montvale Subdivision NWP 29 PCN December 17, 2014 requirements in the Land Development Ordinance requires that all runoff from impervious areas be captured and conveyed to BMPs for treatment prior to discharge. If these wetlands would have been avoided by the site design, they would have been surrounded by lots, resulting in all runoff being directed away from these wetlands, greatly reducing the drainage area and severing their natural hydrologic source. As a result of the insufficient drainage area severely altering the hydrology, the function of these wetlands would be secondarily impacted and eventually dry up and become uplands. Therefore, the integrity and long term viability of these wetlands could not be maintained in the post- development condition even if direct impacts would have been avoided. It was determined that the functional value of these wetlands would be better served through the provision of mitigation in a larger, significant wetland system within a mitigation bank or EEP mitigation project. Impacts 5 & 6 (wetland impacts) and 8 & 9 (stream impacts) are required for construction of the greenway trail, which is required by the Town of Cary as part of the site plan approval. The proposed greenway trail has been designed to meet the minimum 10' width and minimum backslopes as required by the Town of Cary for public greenway trails. Furthermore, the greenway alignment at Impacts 5 & 6 has been designed as close to the rear of the residential lots as allowed in order to minimize wetland impacts. This alignment has minimized impacts to only the outer edge of this wetland to prevent segmentation and depletion of the long term integrity of this wetland. The culverted greenway crossing at Impacts 8 & 9 has been designed to cross the stream at a perpendicular angle to minimize stream impacts. The bottom of the culvert will be installed below the stream bed to allow for passage of aquatic life during periods of low flow. Furthermore, the dissipater pad associated with the proposed greenway crossing has been designed for the rip -rap to be installed with the top of the rip -rap matching the pre- construction elevation of the stream bed. This design allows for the impacted stream areas to continue functioning as a natural stream by maintaining natural water depths and allowing for passage of aquatic life. Impacts 7, 10 and 11 (stream) are temporary, and necessary for the installation of a sanitary sewer line servicing the subdivision. These lines will be installed through open cut installation. These impacts have been designed to provide for a perpendicular crossing to minimize stream impacts. After construction is complete, the stream bed and banks will be restored to pre- construction contours. Mitigation Stream Mitigation Permanent stream impacts for the project total 89 linear feet, and therefore, stream mitigation is not currently proposed. Wetland Mitigation The applicant proposes to mitigate for the 0.339 acres of permanent wetland impacts through the purchase of offsite mitigation credits at a 2:1 ratio, resulting in the purchase of 0.7o acres of riparian wetland mitigation. Stormwater Management Plan The stormwater management plan consists of a combination of grassed swales and a wet detention pond designed for 9o% TSS removal. The stormwater management plan will be reviewed and approved by the Town of Cary, and final approval will be issued upon receipt of the 404/401 authorizations. The current request is for 0.339 acres of permanent wetland impacts, 89 if of permanent stream impacts and 102 if of temporary stream impacts (see the attached maps and PCN for details).
