Pursuant to Titles 15A NCAC 02B .0295 and 15A NCAC 02B .0703 (e), a provider shall submit a project plan proposal to
the Division for review and approval that includes specific elements of the project. By copy of this correspondence and
attached Approval Letter, the final buffer mitigation plan for the Chappels Creek Mitigation Project submitted on
November 8, 2022 is approved. DMS may begin implementing the riparian restoration plan according to the approved
Plan.

Re: Chappels Creek Riparian Buffer Mitigation Plan Approval

Dear Sirs,

The Division of Water Resources (DWR) received a draft Mitigation Plan (Plan) from the Division of
Mitigation Services (DMS) for the Chappels Creek site (Site) in 2022. The Site is located in the Upper
Falls Watershed of the Neuse River Basin. The Plan was submitted to DWR for review and approval
under 15A NCAC 02B .0295 to be used primarily as a buffer mitigation project and also under 15A
NCAC 02B .0703 in order to have the flexibility to convert riparian buffer credits to nutrient offset
credits if needed. DWR reviewed the Plan and provided comments and recommendations. DMS
submitted a revised Plan that addressed all comments and recommendations provided by DWR. The
table below summarizes the timeline of the Plan:
