The NOVs were dated October 7, 2022. However, the notice listed incorrect contact information causing a delay in the facility's receipt of these notices. The contact information for 3M Pittsboro was updated during the call. Additionally, I have included the updated facility information below. However, permit W00024838 states the facility shall report the monthly estimate for the flow for reclaimed water distributed from the town of Pittsboro rather than the daily flow amount. See a copy below of the table from attachment A under permit WQ0020808. P (919) 642-4000 F (919) 642-4017 Based on the monthly requirement outlined in the permit, it is 3M Pittsboro's understanding that this requirement was met with the monthly average effluent for WQ01 disclosed on page 3 of 4 for the Non -Discharge Monitoring Report (NDMR) submitted for January 2022. During our discussion, guidance was provided regarding this NOV that 3M Pittsboro include the average daily flow for PPI 003 for each calendar day to better accommodate the state database input system. 3M Pittsboro has updated this NDMR to reflect this change and is submitting an updated NDMR for January 2022 with this communication via email and hard copies sent to the Division of Water Resources Information Processing Unit. Moreover, 3M Pittsboro plans to submit updated copies of previously submitted NDMRs for 2022 to include the average daily flow for PPI 003, to the Division of Water Resources. We also will plan on reporting the average daily flow for PPI 003 for each calendar day on future NDMRs. Additionally, NOV-2022-LV-0599 alleges, per permit condition 9.e, the permittee shall report within 24 hours of first knowledge any time self -monitoring indicates the facility has gone out of compliance with its permit limitations related to a potentially higher value for the daily max for Turbidity at sample location 001 on 2/3/2022. After investigating this item, it has been determined that there is a typo on the submitted NDMR and that an exceedance of the turbidity limit did not occur. Therefore, notification to the regional office was not required since the parameter was within permit limits. 3M Pittsboro has corrected this information for the February 2022 NDMR and is submitting the corrected NDMR for February 2022 with this communication via email, and hard copies sent to the Division of Water Resources Information Processing Unit. In summary, 3M Pittsboro is submitting updated NDMRs for January and February 2022 to address NOV-2022-PC-0559 and NOV-2022-LV-0559. 3M Pittsboro plans to resubmit previous 2022 NDMRs to include the daily average flow for 003. 3M Pittsboro will implement additional administrative controls for quality assurance of submitted NDMRs. Lastly, 3M Pittsboro would like to request a rescission of the abovementioned NOVs since no violations actually occurred.
