Wheeler, Town Manager Town of Holden Beach 110 Rothchild Street Holden Beach, NC 28462 Subject Property: Town of Holden Beach Turkey Trap Road REQUEST FOR MORE INFORMATION Dear Mr. Wheeler: On August 28, 2006, the Division of Water Quality (DWQ) received additional information concerning the Town's application fora 401 Water Quality Certification for wetland impacts associated with the proposed Turkey Trap Road Borrow Pit. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. It has been determined that the proposed borrow pit is actually a part of an existing LAMA Major Permit and US Army Corps of Engineers (USAGE) Individual Permit. In order to apply for the proposed wetland impacts at the subject site, you must apply for a modification to the CAMA Major Permit and USAGE Individual Permit. In addition you must apply for an Individua1401 Water Quality Certification. You can apply by utilizing the Major Modification to a CAMA Major Permit process or you can apply by using the USAGE Individual Permit application. 2. DWQ's August 17, 2006 "Request for Additional Information" letter (attached) listed 3 items that also need to be addressed before DWQ is able to continue to review your project. These items were not adequately addressed in the response letter that DWQ received on August 28, 2006. Please address all of these items before you reapply for an Individua1401 Water Quality Certification. 3. If the requested information listed above can be provided within 3 weeks (including a CAMA Major Modification request), a new fee will not be required and your project will remain on hold until then; however, if you determine that additional time is needed, please reapply at a later date by utilizing the LAMA Major Modification process. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ «-i11 require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by I SA NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: The site plan only shows a 25' buffer from wetlands. In order to prevent secondary impacts to the wetlands, a minimum of 50' should be maintained between all wetlands and disturbed areas associated with the borrow pit. Please revise the plan accordingly. Please provide cross section details (to scale) for the hvo proposed road crossings. The details should include culvet-ts placed 20% or 12" (whichever is less) below the existing wetland grade. Please provide a copy of the operation and maintenance plan required by the NPDES Stonnwater Permit NCG 020000. This plan should clearly demonstrate how you are proposing to maintain the hydrology of the wetlands adjacent to the borrow pit during excavation and dewatering activities.. This plan should also include a monitoring plan that clearly depicts the location of shallow monitoring wells.
