WITNESSET H:
WHEREAS, Otis Homer Shell and wife, Eleanor Wyatt Shell (a/k/a Eleanor Mae Shell and Eleanor Mae Wyatt
Shell) (together, the "Shells") acquired four (4) tracts of land in Jonas Ridge Township, Burke County, North Carolina,
more particularly described in a deed recorded in Book 195 at Page 64, Burke County Register of Deeds, as tenants by the
entireties (the "Burke Land"); and
WHEREAS, the Shells conveyed a portion of the Burke Land to their son, Raleigh Moyer Shell and wife,
Rosemary Francis A. Shell in a deed dated June 29, 1966, and recorded in Book 290 at Page 592, Burke County Registry
("the Raleigh Shell Tract"); and
WHEREAS, Otis Homer Shell died on July 20, 1967 in the state of Illinois, thereby vesting title to the Burke
Land, less and excepting the Raleigh Shell Tract, in Eleanor Wyatt Shell, his surviving spouse; and
WHEREAS, Raleigh Moyer Shell, authorized by that power of attorney dated February 8, 1978, and recorded in
Book 543 at Page 136, Burke County Registry, sold and conveyed additional portions of the Burke Land, less and
excepting the Raleigh Shell Tract, said portions being more particularly described in a deed dated February 21, 1978,
recorded in Book 544 at Page 199, and in a deed dated February 20, 1978, recorded in Book 544 at Page 201, Burke
County Registry (the "Out Conveyances") (the Burke Land, less and excepting both the Raleigh Shell Tract and the Out
Conveyances hereinafter referred to as the "Property"); and
WHEREAS, a certificate of death registered in Houston County, Georgia, indicates that Eleanor Wyatt Shell died
a widow on January 4, 1980; and
WHEREAS, EIeanor Wyatt Shell died unremarried and intestate, a citizen and resident of Burke County, North
Carolina, and no estate or administration file for her estate was ever opened with the Office of the Clerk of Court for
Burke County, North Carolina; and
WHEREAS, Eleanor Wyatt Shell's heirs under the North Carolina Intestate Succession Act are her children or
their descendants; and
WHEREAS, the Shells, together, had seven (7) children: Evelyn Neuhaus Shell; Alice Clare Donahue; Oscar
Eugene Shell; Jerome Shell; Raleigh Moyer Shell; Jerome Quentin Shell; and Flora Shell Ciocco; and
WHEREAS, the Shells' first child, Evelyn, died intestate, widowed, and unremarried in August of 1974, survived
by her three (3) children: Kathy Kemp Kabelis; Debbie Kemp Wilhelmi; and James (Jimmy) Blake; and
WHEREAS, James (Jimmy) Blake died in June of 2000 in DuPage County, Illinois without surviving spouse,
child, or parent; and
WHEREAS, the Shells' second child, Alice, died testate on January 22, 2006 in Boone County, IIlinois, survived
by her spouse, Robert Lawrence Donahue, and four (4) children: Richard Lawrence Donahue; Carol Jean Wisz; Barbara
Ann Horne; and Lynda Joan Coleman; and
WHEREAS, pursuant to her Will, the residue of the estate of Alice C. Donahue, including real property, was
given, devised, and bequeathed in trust to Robert Lawrence Donahue, trustee of the Donahue Family Revocable Trust
dated June 4, 1998, a copy of her being recorded in File 22E078, Office of the Burke County Clerk of Court; and
WHEREAS, pursuant to the Declaration of Trust creating the Donahue Family Revocable Trust dated June 4,
1998, Richard Lawrence Donahue and Carol J. Wisz were appointed as successor co -trustees, both being willing and able
to serve in such capacity, and being empowered, without joinder of the other, to both receive additional assets from any
source and sell real property at public or private sale; and
WHEREAS, Robert Lawrence Donahue died on April 7, 2018; and

WHEREAS, the Shells' third child, Oscar Eugene, died both a widower and testate on November 23, 2011 in
Kane County, Illinois, survived by his three (3) children: Theresa Jean Shepard (a/k/a Theresa Dees); Robert Eugene
Shell; and Marjorie (Marcy) Bowman (together, the "children of Oscar Eugene Shell"); and
WHEREAS, Oscar Eugene Shell was also survived by his five (5) stepchildren: Margaret Malloy; Mary Taylor;
James Arnold; Mark Arnold; and Ann Morris (together, the "stepchildren of Oscar Eugene Shell"); and
WHEREAS, pursuant to the Will of Oscar Eugene Shell, all of his estate of every kind and character, whether
real or personal, wheresoever situated, was given, devised, and bequeathed to the children of Oscar Eugene Shell and the
stepchildren of Oscar Eugene Shell, a copy of his will being recorded in File 22E079, Office of the Burke County Clerk of
Court; and
WHEREAS, the Shells' fourth child, Jerome, died in 1933 at the age of four years; and
WHEREAS, the Shells' fifth child, Raleigh Moyer Shell, died intestate, widowed, and unremarried on August 9,
2009, in Houston County, Georgia, survived by two (2) of his three (3) children: Beth Ann Shell; and Thomas Bruce
Shell; and
WHEREAS, Raleigh Moyer Shell had a son, Steven Wayne Shell, who predeceased him on March 9, 2005 in
Houston County, Georgia, without surviving spouse or child; and
WHEREAS, Thomas Bruce Shell died testate on December 25, 2020 in Houston County, Georgia, survived by
his spouse, Sherrie R. Shell and his daughter, Heather Shell Ray; and
WHEREAS, pursuant to his Will, the entire estate of Thomas Bruce Shell, including all property, both real and
personal, of every kind and character, wherever situated, either owned at the time of his death or thereafter acquired, was
given, devised, and bequeathed to his wife, Sherrie R. Shell, while his daughter Heather Shell Ray has an intestate share
until such time as his Will is admitted to probate in Houston County, Georgia; and
WHEREAS, the Shells' sixth child, Jerome Quentin, died intestate on June 23, 1995 in Cook County, Illinois,
survived by his spouse, Elizabeth Charlene Shell, and two children: Scott Allen Shell; and Michael Allen Shell; and
WHEREAS, Elizabeth Charlene Shell died both a widow and testate on January 29, 2014 in Cook County,
Illinois, survived by her two children: Scott Allen Shell; and Michael Allen Shell.
WHEREAS, pursuant to the Will of Elizabeth C. Shell, all of her residuary estate, being all property passing
under her will, was given to her then living descendants, per stirpes, a copy of her Will is recorded in File 22E80, Office
of the Burke County Clerk of Court; and
WHEREAS, the Shells' seventh child, Flora, died unremarried on January 25, 2013 in Bibb County, Georgia,
survived by three (3) of out of her (4) children: Sharon Roeder McDonald; Donald Roeder; and Bruce Roeder; and
WHEREAS, Flora Shell Ciocco had a daughter, Dianne Roeder, who predeceased her on August 20, 1973 in
Lake County, Illinois; and
WHEREAS, Dianne Roeder died unmarried and intestate, and was survived by a daughter, Charity Ann Teresi;
and
WHEREAS, the aforenamed represent all known heirs of Eleanor Wyatt Shell; and
WHEREAS, all heirs, and their spouses, have executed a Limited Power of Attorney to Richard L. Donahue to
convey this property, except for Sharon Roeder McDonald and Heather Shell Ray, who are not parties to this transaction;
and

WHEREAS, the heirs who are Grantors herein represent an undivided eleven -twelfths interest in the Property;
and
WHEREAS, the Grantee has requested and the Grantors, by and through their attorney -in -fact, Richard L.
Donahue, empowered by that Limited Power of Attorney recorded in Book 2604 at Page 149, Burke County Registry,
have agreed to convey the property described herein; and
NOW THEREFORE, the Grantor, for valuable consideration paid by the Grantee, the receipt of which is hereby
acknowledged, has and by these presents does grant, bargain, sell and convey the Property unto the Grantee in fee simple
and more particularly described as follows:

The Grantor grants and conveys the title to the property without any warranties of title.
