9. PROJECT DESCRIPTION
The project site is located at three separate adjoining lots with the addresses 126 SE 75a' Street (Lot
1), 127 SE 76`h Street (Lot 7) and 129 SE 76h Street (Lot 6) The project area is located near the
Atlantic Ocean, within the Town of Oak Island, in Brunswick County To find the project site, travel
south on US Highway 17 to NC Highway 133 South Travel approximately 22 miles south on NC-
133 to Dosher Cutoff SE/ NC -133 Turn onto Dosher Cutoff and then turn right at Southport- Supply
Rd SE/ NC -133 Travel approximately 0 8 mile and turn left onto NC -133 Travel on NC -133 to
Oak Island and turn right on East Oak Island Drive Travel approximately 0 9 miles to SE 76th
Street Make a left on SE 76th Street and Lots 6 & 7 will be located before the intersection of E
Beach Drive and SE 76th Street on the right The third parcel is located immediately adjacent to the
western (back) property line of Lot land is accessed from SE 75ffi Street
The three lots have a total area of approximately 20,625 square feet with each individual lot's area
being 6,875 square feet The site is vegetated with Eastern Red Cedar (Juniperus virginiana), Wax
Myrtle (Myrica cerzfera) and Yaupon (Ilex vomztoria) The site plan shows §404 wetlands with an
area of 6,669 7 square feet on Lot 1 The plans show Lot 6 has a total wetland area of 1,839 6 square
feet and the total wetland area of Lot 7 is 5,636 7 square feet There are two small ditches with
wetland vegetation along the right -of -ways along both SE 75th Street and SE 76`h Street It appears
that there may be §404 wetlands within the Town right -of -ways and outside of the property
boundaries that may not be depicted on the plans A Notification of Jurisdictional Determination was
not submitted with the application package According to the applicant, the property has an
approximate elevation of 8 feet above mean sea level The frontal dune is located approximately
450' oceanward of the southern property lines and the static line is located approximately 340' -360'
oceanward of the southern property lines
The longterm erosion rate for this portion of Oak Island is 2 feet per year The 100 -year storm
recession line for this area is 300 feet, creating a total Ocean Erodible AEC of 420 feet The Ocean
Erodible Area of Environmental Concern (AEC) boundary crosses through the middle of Lot 7 on
SE 76ffi Street and through the northeast corner of Lot 1 on SE 75`h Street All three lots fall entirely
within the High Hazard Flood AEC as indicated by zones V1 -30 on the Flood Insurance Rate Maps
of the Federal Insurance Administration Setbacks in this portion of Oak Island are measured from a
static or fixed vegetation line, unless the actual first line of stable, natural vegetation is more
restrictive This static vegetation line represents the first line of stable, natural vegetation that
existed prior to the large -scale spoil deposition project The vegetation line used for Oak Island is
based on the 1998 vegetation line, as described in NCAC 07H 0305(a)(6) With a 2 feet per year
erosion rate, structures with a total floor area less than 5,000 square feet must be set back a distance
of 60 feet landward from the static line The 60 foot setback is located approximately 300 feet
oceanward of the southern property lines of Lots 1 and 6 The actual first line of stable, natural
vegetation is located oceanward of the surveyed static vegetation line
There are no man -made structures currently on the property other than municipal sewer hook -up
The waters of the Atlantic Ocean in the vicinity of the project area are classified SB by the North
Carolina Division of Water Resources The area is not designated as a Primary Nursery area by the
North Carolina Division of Marine Fisheries

PROPOSED PROJECT:
The applicant is proposing to construct three 1 -story pile- supported single- family residences, one on
each of the three lots, with associated wetland fill and concrete driveways The total floor areas of
each of the houses would be 1,873 square feet With the covered porches and driveways, a total
built -upon area of 3,217 3 square feet is proposed for each of the three lots
Approximately 12,500 square feet of area on the three lots would be graded and filled for
construction, to include approximately 9,120 square feet of §404 wetlands on the lot The project
would result in the filling of 4,350 square feet (0 1 acre) of wetlands on Lot 1, approximately 992
square feet (0 022 acres) of wetland fill on Lot 6, and approximately 3,777 square feet (0 087 acres)
of wetland fill on Lot 7 The applicant proposes to make a payment to the Lower Cape Fear
Umbrella Mitigation Bank (LCFUMB) at a 0 1 credit for each lot A Statement of Credit Availability
was issued on November 25, 2014
10. ANTICIPATED IMPACTS:
The project would result in the permanent filling of 9,120 square feet of §404 wetlands and
approximately 1,249 square feet of high ground disturbance and fill It appears there may be
additional wetland impacts within the right -of -way associated with the driveway construction The
residence would result in 3,217 3 square feet of built -upon area on each lot, for a total BUA of
9,6519 square feet The proposed development would be located within the Ocean Erodible and
High Hazard Flood AEC, landward of the applicable development setback

Mr Todd Surratt proposes to construct three single- family homes on pilings within three lots located at 126
SE 75th Street (Lot 1), 127 SE 76th Street (Lot 7), and 129 SE 76th Street (Lot 6) in Oak Island, NC (Brunswick
County) The site is located within a High Hazard Flood Area and an Ocean Erodible Area Wetland impacts are
necessary for lot development

Existing Conditions
Each of the three lots are 0 157 acre in size One lot is located off of SE 75th Street and two lots are located
off of SE 76th Street in Oak Island (see attached figures) The lots are located approximately one block away from
the Atlantic Ocean and are within the VE flood zone (VE -17) The project area is located within the Cape Fear
River Basin (HUC 03030005) Freshwater wetlands were delineated within the lots by Land Management Group
and approved by Ms Emily Hughes of the US Army Corps of Engineers on October 8, 2014 No coastal wetlands
exist on site Freshwater wetlands contain wax myrtle (Morelia cerifiera), sweet bay (Magnolia virgmrana), and
winged sumac (Rhos copallinum) Uplands support eastern red cedar (Juniperus virginiana), yaupon (Ilex
vomitoria), wax myrtle, and winged sumac The existing land use map in the CAMA Land Use Plan for the Town
of Oak Island (2009) classifies these lots as Vacant Land since it is currently undeveloped The future land use map
classifies them as Medium Density Residential The lots are zoned R -6MF by the Town of Oak Island This R -6MF
district is established to provide areas for the preservation and development of quiet residential neighborhoods and
for higher density residential development with a range of housing types The principal uses in this R -6MF district
include larger sized single- family residences, multifamily residences, and other compatible uses
Proposed Project
The applicant proposes to construct three single - family homes within the three lots (one house per lot) The
one -story homes will be constructed on 8' pilings and the total floor area will be 1,873 sf per house (See Sheets 3-
8) The total area of disturbance within the lots will be approximately 12,500 square feet and the overall impervious
area will be 9,651 9 square feet (3,217 3 sf per lot) Approximately 650 cubic yards of fill material will be
distributed throughout the lots Water service will be provided by Brunswick County and sewer service will be
provided by the Town of Oak Island The contractor is currently preparing a stormwater plan that will meet the
Town of Oak Island's stormwater requirements Standard construction methods will be used during construction of
the pilings and house

Environmental Impacts
The applicant proposes to fill a total of 0 21 acre (0 10 acre on Lot 1, 0 023 ac on Lot 6, and 0.087 ac on
Lot 7) of freshwater wetlands in order to provide sufficient area on which to build three residences within the lots
Because of the location and amount of wetlands within these lots, avoiding or reducing the amount of impacts was
not possible The applicant proposes to mitigate for these impacts by buying into the Lower Cape Fear Umbrella
